Industrial Court Orders IGP, Police Service Commission to promote Reuben Michael to ASP within 90 Days

Uyo—The Presiding Judge, National Industrial Court sitting in Uyo, His Lordship, Hon. Justice Mahmood Namtari has ordered Inspector General of Police and the Police Service Commission to promote Reuben Micheal to the rank of Assistant Superintendent of Police (ASP) II with effect from 2011 and pay him all his financial entitlements and benefits within 90 days.

The court held that Reuben Micheal has not only earned his promotion but also brought the facts within the exceptions of the law.

The Claimant who was enlisted in the Nigeria Police Force as a Police Constable and is currently a Police Inspector, posited that having embarked on study leave on the approval of the Inspector General of Police and obtained his Degree certificate, wrote and passed ASCON ASP Examination, that he is entitled to promotion or upgrade to the rank of ASP and all efforts to make the IGP and Police Service Commission to do the needful proved abortive.

The Claimant also feels that the period of four years study leaves without pay would be counted and added up to his 35 five years in service which indeed will work as an injustice on him and by now he would have been a Superintendent of Police (SP) going by Public Service Rules.

The Claimant also noted that as a general rule, promotion from one level or position in an organization to another is not a right but a privilege; but submitted that there is no general rule without exception urged the Court to accept the unchallenged and un-controverted evidence placed before it that the defendants are presumed to have admitted the case made against them.

However, the Defendants did not enter any formal appearance nor defence and did not have any legal representation throughout the hearing of the case in spite of been put on notice at every turn.

Delivering the Judgment, the presiding Judge, Justice Namtari held that Lack of evidence or defence does not guarantee automatic victory to the claimant since the evidence does not become credible merely because it is unchallenged.

“On the state of documentary evidence and the law, I have no hesitation in finding and holding that the Claimant has not only earned his promotion but also brought the facts within the exceptions of the law. A look at the evidence will support this stance.

The court declared the Defendants’ refusal to promote the Claimant as vindictive, mala fide, and so qualifies as unfair labour practice.

Paul Okoye has shared an inspiring tale of how he saved a young Nigerian man from police brutality months ago, only to see him on TV last night playing against Barcelona in the champions league.

Paul Okoye took to Instagram to advise young Nigerians to use their phones in recording police officers whenever they are being harassed so that they can defend themselves.

He then went on to narrate how he came across a young man with dreads being harassed by police officers who were accusing him of being a fraudster (Yahoo boy) because of his appearance.

Paul said the man told the officers that he’s a footballer but they didn’t believe him and told him that all Yahoo boys claim to be footballers or musicians.

Paul said the officers became uncomfortable when he started filming them so they let the young man go.

Last night, November 5, Paul was pleasantly surprised when he was watching a football match on TV and saw the same man he saved months ago on his screen. Turns out the man is a professional footballer named Olayinka Peter Oladeji.

You are a criminal!” I told the police to stop calling him a criminal , the young man said he’s not a criminal, that he’s a footballer, and the police man said that what all you criminals and yahoo boys say… if it’s not footballer, it’s musician and all so I got pissed, brought out my phone and started making a video, the police were uncomfortable, that’s was how they decided to let him go … later that night this young man sent me a Dm and thanked me … but then his Instagram page was verified…. to cut the long story short….. yesterday I saw this same young man playing against Barcelona in champions league Barcelona vs slavia Prague azin ehh!!, I was like this guy looks familiar, had to type his name on I.g @olayinka_peter …. The Senior Special Assistant to the President on National Assembly Matters (Senate), Senator Babajide Omoworare, on Wednesday said President Muhammadu Buhari did not undermine the office of the Vice President Yemi Osinbajo, by travelling without transmitting a letter that would allow him to act, to the National Assembly.

Omoworare who addressed journalists in Abuja alongside his colleague in the House of Representatives, Mr. Umar El-Yakub, insisted that the President was free to perform his functions from anywhere in the world.

He said, “Contrary to the claims by some individuals and groups, The President has not in any way undermine or relegate the office of the Vice President. He has no reason to do so.

“I don’t think there is any way or manner that the office of the Vice President has been relegated.
“The President of the Federal Republic of Nigeria can work from anywhere he is in the world.”

He explained that the only case where people could raise issues is when a President is ill and was unable to communicate his absence to the National Assembly.

Omoworare said, “The only celebrated case was that of the late President Umaru Musa Yar’Adua, who was Ill and could not transmit any letter to the National Assembly.
“The National Assembly had to work round the situation by ensuring that the executive powers go to the vice president.”

He said the situation now was different from the Yar’Adua case and that Buhari had not done anything wrong by not transferring executive powers to his deputy before embarking on his foreign trips.

New minimum wage: Labour issues directive to state councils

Joint National Public Service Negotiating Council (JNPSNC) has directed its state councils to begin negotiations for consequential adjustment and implementation of the new minimum wage.

EQUITY NEWS.NG reported that after the Federal Government agreed on consequential adjustments and percentage increase for workers in the Federal civil service with organised labour on Oct. 18, the joint negotiating council in each state is expected to open negotiation with its state government.

However, state governments under the auspices of the Nigeria Governors Forum, had said that they would only pay according to the financial standing of their respective states.

Reacting, the Chairman of the Council, Mr Simon Anchaver at a meeting in Abuja stated that the Union has given state governors Dec. 31, as deadline for implementation of the new minimum wage.

According to him, the Union had adopted the deregulate collective bargaining style to ensure that state governments also negotiate what they can afford, so long as it was not lower than the N30, 000 benchmark.
“Any governor that said he’ll not pay stands to be impeached,” he said.

Also, the Secretary-General of the JNPSNC, Mr Alade Lawal, noted that the Union had agreed with it’s state councils to start sending our letters to state governments, saying negotiations ought to start upon receipt of such letter.

“Negotiation with state governments starts anytime from today, we have agreed that the joint national negotiating council should send letters to state governments which will be sent tomorrow, the draft for the
letter is ready.

“We will first send it to our members’ email addresses in the states and then we will send the hard copy to the state governments, Negotiation starts immediately after the receipt of the letter,” he stated.
Lawal said the council was still expecting an agreed template from the National Salaries Incomes and Wages Commission (NSIWC), to act as guideline to states for onward negotiations.

“There are three documents handed over to the state negotiating council chairmen, the first one is the agreement we signed with the Federal
Government on the consequential adjustment. I am sure the press already has it.

“We are expecting a circular from the National Income, Salaries and Wages Commission but we are being proactive. We have decided to
develop a table on consolidated public salary structure and the consolidated health sector salary arrangement.
“This is like a replica of the table that we are expecting from the NISWC based on the agreement that we signed with the FG. This was
given to state negotiating council chairmen to serve as guide so that they can have a view of what it looks like when they start their own
negotiation in their states.

“It however does not serve as the circular we are expecting from the Federal Government
through the NISWC.
“The FG will still issue the circular in respect of the new wage structure so the one we have done is not binding but just a working document between us and our counterpart in states.
“The document will not hinder their negotiation with state governments.

“It is for the personal use of our members in the states, we are not forwarding it to the state governments.
“We are hopeful that by December 31, all negotiations should be wrapped
up. In areas where we have difficulties, we have decided to move in as a group to shut down the space towards ensuring that implementation is
done.

“The agreement we had with the FG is the minimum for the states. Some will go beyond it but no one will go below it.
“There are some states that have low salary level. They have to discuss something higher that what we had with the FG. It depends on peculiarity of the states. If you say 23.2 per cent increase for a level seven officer in the federal civil service, it boils down to about N15,000.

“But if you apply the same percentage for workers on the same level in some state civil service, it translates to about N4,000. In that case,you have to be able to negotiate a higher percentage to be able to get something close to N15,000 we are talking about in this case. That is where the negotiation comes in.

“There are different peculiarities in states and that is why we don’t want to give a blanket statement on what to do. With the discussion we have with the state officers, they know what to do.
“These are what we discuss at the meeting. We also shared information
and data on some of the statistics that I told you about.

“We also shared with the state council chairmen our experiences, the intrigues to be involved, the blackmail, the need for them to be honest and
resilient; I want to believe that they are well guided.”

Cops free 259 people from illegal and abusive Islamic school in Nigeria.

Nigerian police have freed 259 men, women and children from an illegal Islamic rehabilitation centre, where children were beaten and starved.

The latest rescue operation in the southwestern city of Ibadan, is part of a wider crackdown in the country, ordered by its Muslim president Muhammadu Buhari.

Over the last few months, security forces have been clamping down on ‘rehabilitation centres’, where children are regularly beaten by clerics.

In one example, a man was refused permission to see his nephews at an institution and complained to police.
Nearly 1,500 people have been freed so far after the crackdown was launched in September.
Many reported being held in prison like buildings, with bars covering windows.

Nigeria group Muslim Rights Concern estimates about 10 million children attend Islamic institutions in the West African country, which has a mainly Christian, relatively prosperous, south and a largely Muslim north.

In September, more than 300 boys and men, some as young as five, were rescued in a raid on a building that purported to be an Islamic school in northwestern Nigeria’s Kaduna city.
Many were in chains and bore scars from beatings. Some had been there for years.

Last month also saw a series of raids, with police rescuing 67 men and boys aged between seven and 40 from an Islamic school in the town of Daura in northwestern Katsina state, where the captives had been shackled.
Former students said instructors had beaten them and some reported sexual abuse.

Later in October, police freed about 500 men and boys, many of whom had been chained to walls, molested and beaten, from an Islamic school in the northwestern city of Katsina in its eponymous state, law enforcement sources said.
Another raid on October 24, police also rescued 108 malnourished and sick captives aged from six to 45 from a so-called Islamic reform centre in Ilorin in central Nigeria’s Kwara state.

President Buhari’s office issued a statement in October saying that ‘no responsible democratic government would tolerate the existence of the torture chambers and physical abuses of inmates in the name of rehabilitation of the victims.

PDP calls for removal of Kogi Police Commissioner ahead of state polls

People’s Democratic Party Camapign Council in Kogi state has passed a vote of no confidence on the State Police Commissioner,Busari Hakeem and warned that with his presence kogi people should not expect rancourless election by November 16.

Deputy Director Public Communication of the Council,Austin Okai Usman in a statement said the police activities in the have been reduced to taking instructions from the APC led Government in the state.

The council noted with serious concern that the activities of the state police command under the current CP,has reduced the contest of November 16 to a battle between the Police and PDP.

“This is a clear indication that virtually all governmment officials in Kogi and top APC members and their thugs, were been protected and at the same time using the state police Commissioner men to chase,harrass,intimidate and threaten to kill PDP members across the state

“Specifically the council noted with serious worry,the activities of Governor Bello spokesman, Kingsley Fanwo in Mopa Muro local government,Ndamodu Ali,former Commissioner of local government in Ofu,and the clampdown of our supporters in Dekina, Ankpa,Bassa,Idah,Olamaboro and the concluded plans to spread across the state, with the aid of the state Commissioner of police,his men and the fake uniform men,including those imported by Yahaya Bello engaged in dirty and illegal duties in Kogi ”

The council said the police heirachy under Busari Hakeem lacked the partial stance to supervise and monitor the November 16 election,while urging the IG to urgently effect his removal without further delay,to avoid break down of law and order in the state.

The PDP also expressed serious reservation on the continuous detention of DCP Ejeh Suleiman Abutu in SARS custody who was abducted by APC private army from his residence,taking to Dekina Governor’s lodge,tortured for confession under duress and later forced the police heirachy to accept the records of the illegal activties of BelloOnoja’s men
PDP also appealed to the IG to without further delay remove the police Commissioner in the interest of fair play, security of lives and properties and to avoid reprisal attacks from any side of the political divide, particularly the PDP.

According to the council,it has also been informed of the plans by the state government to enlist and incorporate the army on special operation, into the unholy desire to retain power at all costs,by November 16 election
It also asked the Commandant Army Records,Major General Adewale Ogunkale to closely monitor the activities of his men, so as to insulate them from the ongoong infiltration of security agents by the state government
But when contacted for his reaction, the CP expressed sadness that inspite of all he was doing with his men to ensure a free and fair election some people are still castigating him stressing that why must it be the PDP alone in all the political parties that is always complaining.

In his words” Honestly, PDP is not fair to me for accusing me wrongly, they asked for police security we provided them, we have never treated any party above the other and if any of my men are caught conducting themselves in a way that is non professional let them call my attention to it and we will deal with them.

“I know this is the time of election and every party is using all means to get power. I Know a man was arrested with guns, they should allow the police to do their job, if he is not found wanting he would be released, but let them not give a dog a bad name inorder to hang it.”

EFCC vs Maina: What happened in court on Tuesday

The trial of former Chairman, Pension Reform Task Team, Abdulrasheed Maina and his son, charged with 12 counts bordering on “money laundering, operating fictitious bank accounts and fraud,” was stalled on Tuesday, due to his ill-health.

A medical letter was brought to the court by an officer of the Nigerian Correctional Services to Justice Okon Abang stating the reason Mr Maina could not appear in court, NAN reports.

DAILY POST recalls that the Federal High Court, Abuja, had last week also overruled Abdulrasheed Maina, former chairman of defunct Pension Reform Task Team, on his application to stop his criminal trial.
Justice Okon Abang, who declined the application of the legal team of Maina, said the defendant cannot frustrate the court’s proceedings.

Justice Abang had fixed Nov. 4, Nov. 5, Nov 6 and Nov. 7 for continuation of trial of Maina, who is being prosecuted by the anti-graft agency on a 12-count charge bordering on “money laundering, operating fictitious bank accounts and fraud.”

However, at the resumed trial on Tuesday, Justice Abang, who adjourned till Nov. 7 for continuation of trial of Maina, ordered that the Deputy Comptroller General in charge of Medical and Welfare of the Nigerian Correctional Services should examine Mr Maina and the medical report made available to the court in the next adjourned date.

Senate Confirms 15 NDDC Nominees, Rejects 1

The Senate on Tuesday confirmed the nomination of 15 persons for the appointment on board of Niger Delta Development Commission (NDDC), out of 16 names nominated by President Muhammadu Buhari.

Nunieh ,who currently serves on the interim committee overseeing activities of NDDC did not communicate to the Senate Committee on Niger Delta over her absence from the screening.

The confirmation of the 15 nominees followed the receipt of the report from the committee and consideration of same at the senate committee of the whole.

Presenting the report,Chairman of the committee Sen .Peter Nwaboshi (PDP Delta)said the nominees were screened and found suitable to serve on the board of the NDDC in accordance to section 2(2)( a) of the NDDC Act, 2000.
He,however, said the nominee for the Rivers did not appear for the screening adding that there was no official communication to the committee on reasons for her absent.

Commenting on the report, Sen Ike Ekweremadu (PDP Enugu,) before the confirmation raised the issue of the current interim management of the NDDC noting that the committee was an act of sabotage and should be set side.

President of the Senate, Dr Ahmad Lawan in his remark thanked the Senate particularly the committee on screening and confirmation of the nominees.
He urged the nominees to justify the trust bestowed on them by execution of projects for the people of the Niger Delta.

He said the nominees, when inaugurated should ensure value for money on projects given the unreputable narratives about NDDC.
President Muhammadu Buhari, had in a letter dated Oct 18, forwarded the list of the nominees for the board and management of the NDDC to senate.

President of Senate, Ahmad Lawan who had announced the list at plenary on Oct 29,directed the Senate Committee on Niger Delta to conduct the screening of the nominees and report back in one week.

The News Agency of Nigeria (NAN) reports that the confirmed nominees are the Chairman, Dr Pius Odubu (Edo), Managing Director, Bernard Okumagba (Delta),Executive Director Projects, Engr. Otobong Ndem (Akwa Ibom).
“Executive Director Finance and Admin, Maxwell Okoh (Bayelsa) as well as Delta representative, Prophet Jones Erue; Mr Victor Ekhatar (Edo) and Nwogu Nwogu Abia.

“Others are Theodore Allison (Bayelsa); Victor Antai (Akwa Ibom); Maurice Effiwatt (Cross River), Olugbenga Edema (Ondo); Hon. Uchegbu Kyrian (Imo).

North -West nominee Aisha Muhammed,from Kano, Ardo Zubairu representing North- East (Adamawa) and South West Representative Engr. Badmus Mutalib (Lagos).
The Senate also at plenary considered first reading of 11 bills.

Among the bills presented for first reading are Pension Reform Act Amendment Bill ,2019 sponsored by Sen Wamakko Aliyu (APC-Sokoto) and National Agricultural Development Fund Establishment Bill ,2019 sponsored by Sen .Adamu Abdullahi (APC-Nasarawa).

Metro EFCC arrests eight for alleged illegal broadcast of DSTV airing right

The Economic and Financial Crimes Commission, EFCC, Benin zonal office, has arrested eight officials of pay television operators, Communication Trends Limited ( CTL), JAO TV and Worldlink for alleged illegally broadcasting programmes exclusive reserved for Multichoice Nigeria Limited.

It was also learnt that the operators allegedly broadcast the English Premier League (EPL) matches and other content on their network, to the detriment of Multichoice Nigeria which acquired the rights to broadcast the content.
EFCC spokesman, Wilson Uwujaren disclosed this in a statement in Abuja.

He further explained, “They were arrested at their respective locations in Edo and Delta State through intelligence and the support of officials of Multichoice. Those arrested are Faith Ohawe, Tochukwu Nwosu, Nzemere Chika, Joshua Egboyen and Ogujor Franklin. Others Ebuaka Lola, Esekhaige Victor and Kenedy Uduobor

“The pay-TV operators allegedly charge the public between N2500 – N3000 as monthly subscriptions.
“Items recovered from the suspects at the time of their arrest include, 2 ADC Telecommunication Amplifier; Seven IRD – 2900 decoders; Three DMP – 900 decoders; Three Starting decoders; Three UMH 260 Encoders; Seven Govt decoders; Five Strong decoders; One HP Laptop computer and its charger; One CPU; One C-Sat, C8pro decoder ; Two BEIN decoders and it’s remote control; Three Trendop decodes ; One Canal decoder ; One CID 3100 decoder; Two DVB Modulator; CTL Antenna; Nexgo POS Machine issued by Zenith bank; One Cole 518E 8cH encod7er; one integrated recover decoder, UMH 150; 13 No degital encoders, Jiehao multiplexer; Four DSTV decoders; Six Gotv decoders ; Two Starting decodes; Six Strong decoders and Others”.

EFCC affirmed that the suspects would be charged to court as soon as investigations were completed.

NASS will go after those milking Nigeria dry

Nigeria’s Senate President, Senator Ahmad Lawan has lampooned the power sector in the country, saying that Expenditures have been made in the past, but no commensurate results from the expenditures, just as he said that this is worrisome.

According to Lawan, it was glaring that a few companies were milking this country dry, even as he said that the time has come for Nigeria as a country to get value for money, adding that the kind of money sunk into the power sector will not only provide light for Nigeria but also the neighbouring countries.

Against this backdrop, the President of the Senate has vowed that the Ninth National Assembly will insist on accountability and transparency in the power sector, particularly in the application of funds proposed for it in the 2020 budget. Lawan stated this yesterday when the Managing Director of the Niger Delta Power Holding Company, Joseph Chiedu Ugbo, led a delegation on a visit to the National Assembly, Abuja.

According to Lawan, the Senate and House Committees through the instrument of oversight will ensure the prudent application of all funds channelled to the power sector. In a statement by his Special Assistant, Press, Ezrel Tabiowo, the President of the Senate said that the Federal Government had severally been shortchanged in agreements entered into with generating and distribution companies in the past.

Lawan who warned that those behind shortchanging the government through power deals will be held accountable for their actions, said, “One of the challenges Nigeria is faced with today and for a very long time in the area of development is power. Until we are able to fix the power situation, development will continue to be difficult to achieve. “

This is one area we will continue to give priority to ensure we are able to meet the targets. It’s not going to be easy, but the Government of President Muhammadu Buhari has shown clear determination in ensuring we get power fixed. “The power sector has been surrounded with controversies for a long time.

When the NIPP started, so many things were said; some of which are true. “Expenditures were made in the past, and we did not see commensurate results from the expenditures. It is something to worry about. “Some persons also have the tendencies to sign agreements that sometimes are clearly against the national interest.

Time has come for people to stop doing this In most cases, the Federal Government was shortchanged in some of the agreements signed by the people. I really don’t know what they were thinking. “We need to be very careful. Time will come when people will be held responsible for their actions. “Billions of dollars will just disappear like that, and there still won’t be power.

This National Assembly will not close its eyes or not take any action if our nation is shortchanged. “We are very concerned with what is happening in the power sector because personally we have not realised the best deal at all. “In most cases, the deals were against the national interest, against the people and against the country. “What we have are a few companies that are milking this country dry. I think we must insist on getting value for money. “The kind of money sunk into the power sector will not only provide light for Nigeria but also the neighbouring countries. “

The Senate and House Committees on Power will look to see how we can make a difference this time around because we intend to monitor closely any money put in the budget. We want to see such money prudently applied,”

Lawan said. Earlier, the Managing Director of the Niger Delta Power Holding Company, Chiedu Ugbo, said that the NPDC was set up in 2005 to bridge the infrastructure gap in electric power supply industry. He said, “We started with ten generation plants, and then moved on to transmission to ensure power distribution gets to the end-users.
