More troubles for Air Peace boss; wanted in Canada, as EFCC moves in on him

The travails of the chairman and CEO of Air Peace, Allen Onyema over an alleged $20 million fraud in the United States seems far from over.
More authorities are getting involved in the case, as the Canadian authorities in line with an existing agreement with the US have set in motion, mechanisms to have the Nigerian businessman arrested.

This is even as Nigeria’s anti-corruption agency, the Economic and Financial Crimes Commission has reportedly set up a panel to investigate the financial activities of Onyema, based on his indictment by the US Justice Department.

Onyema was indicted alongside the international airline’s Chief of Administration and Finance, Ejiroghene Eghagha, by the US Department of Justice (DoJ) of “moving more than $20 million from Nigeria through some United States banks in a scheme involving false documents based on the purchase of airplanes.”
Eghagha, was also accused of bank fraud and committing aggravated identity theft in connection with the scheme.
Both men on Saturday denied the charges, and stated their resolve to prove their innocence in any court, even as they noted that all transactions to buy planes for the company passed through the Central Bank of Nigeria (CBN).

But Premium Times reports that the Canadian authorities have commenced efforts to execute a corresponding arrest warrant issued for Onyema over accusations of fraud in the United States.
The newspaper said it sighted court filings in the United States, of judges issuing warrants for the arrest of both men, which have American prosecutors sought to enable Canadian law enforcement authorities take the suspects into custody if sighted in their jurisdiction, based on a longstanding tradition on cross-border crimes, between both countries.

Separate reports also claimed that the EFCC had waded into the wire fraud and money laundering case by raising what sources referred to as a ”special panel” to investigate the matter shortly after receiving the charges against Onyema.
EFCC is said to be also investigating two Nigerian banks for allegedly facilitating the transfer of the money to the US and processing letters of credit to buy planes for Air Peace.

The probe, it was gathered, would cover the activities and inflows into the accounts of four non-governmental organisations (NGOs) /non-profit groups sponsored by Onyema.
They are Foundation for Ethnic Harmony, International Centre for Non-Violence and Peace Development, All-Time Peace Media Communications Limited and Every Child Limited.

Edo state has been trending nowadays not for anything good per se, and it’s unfortunate that the state that pride itself with development in the past has now become the laughing stock in the realm of the media.

Succinctly, the reason is not farfetched than the political calculations ahead of the forthcoming gubernatorial election scheduled for 2020.

The election fever has soaked the interest of political actors and titans in the oil-rich state, and the satisfaction of the loyalty of the incumbent Godwin Obaseki to the party that brought him into power started the separation of interest.

As we know from the accepted definition of democracy as government of the people, by the people and for the people, one can gather that people have the power to install government and government must work for people(masses).
The day the incumbent Governor Obaseki decided to shift the goal post and put his tent of loyalty somewhere else signifies the beginning of the political problem being experienced by the state, and the common man on the street bears the pain.

No person would believe that the relationship between the National Chairman of APC, Comrade Adam Oshomole and his political son would go sour within the first tenure of Godwin Obaseki.
The name Godwin only appeared to the mind of the party when the former Govr. Adam Oshomole defied against all odd to ensure that Obaseki got the party ticket in 2016 as APC flag bearer against the wish of some faithful party members and loyalist.

In a democratic setting, no one can validly claim the ownership of victory; it takes the collective task to achieve success. All of them worked together to produce Obaseki’s victory at the poll, in fact, many party loyalists lost their lives in a bid to ensure the party winning at all cost.

Their lives were not insured rather were they compensated, simply because they believed in the road their political leaders went through to put Godwin at the Government house.

His only selling credential then was being the head of state economic team under Adam Oshiomole, and it won’t be out of place to say Obaseki rode on the gains, influence and achievements of his predecessor Adam Oshiomole to claim victory.

Everybody believed that Obaseki tenure is Adam’s third term agenda due to the energy and resources the former governor put to the campaign. He took him to the crook and crannies of the state, sold his candidacy for common man, re-assured them that he(Godwin) won’t abandon the ongoing projects and he would not deviate from the agenda of development and progressiveness, and he would put the interest of Edo State first above personal interest.

Less than 4 yrs, hope of the party man has been dashed, it was one day per political drama that has negatively affected the space of governance in the state, no single project started by Oshomole administration has been put to completion by Obaseki, and the much-celebrated gigantic medical tourism of the State commissioned by President Buhari at the end of Oshomole’s administration has not been put to use for the common man while many people believe the negligence of the governor aimed to spoil former governor image.

If there is a political fight between two different parties, the development will manifest because that is the only language common man understand, but political rivalry within the same party will affect development. The governor cannot do it alone, he needs the technical know-how and guidance of the State Executive Council who are made up of politicians to work together, but in a situation when they don’t trust where the loyalty of everyone lie, then governance would suffer.

It’s unbelievable that the duo belongs to the same political party but find it difficult to establish a common ground. Immediately Governor Godwin sensing getting the party ticket to fly for re-election in 2020 may be difficult under the cupboard of his former predecessor Adam Oshomole as the party National Chairman, the tougher the fight.

As they say, political problems require political solutions, the rate at which the fracas between Oshomole and his political son get messy daily need urgent party attention so as not to jeopardize the party winning in the forthcoming gubernatorial election.

The recent disruption of peace in the state due to the show of force between the two should be condemned by the good lover of peace and democracy in the country because peace enjoys in Edo state will also have a resultant effect on the masses.

What is happening signifies that the political actors only concern about their interest, either selfish or material you are entitled to decide.

The submissions of the governor that he cannot share the money of Edo state for few people cannot hold water, immediately the governor sensed of ‘Ambode Treatment’ he wants to fight all and to prove that he has the power to defend the masses (interest).

Someone should tell Mr. Governor that if you know you won’t be loyal why seeking for their assistance at the first instance?

No one became governor of the state in isolation; winning takes a collective effort of the party member, friends, associates and common man on the street.

The space on the air is enough for many birds to fly without experiencing any injury.

Taking from the saying that if we want to do something, we will find means of getting it done, but if we don’t want to do it, we find an excuse.

Even if we must prove how powerful we have become, not to the person who helped us to reach the top, and this point to the need for people to know that nothing lasts forever.

I will continue to say it that, loyalty is 100 percent not 99.9 per cent. Its either you are loyal or not. The means of bending corners to prove loyalty is wasting of time.

Comrade Adam should know that everybody wants loyalty, consistency and somebody who won’t quit which is not easy to get. Adam should swallow the humble pie and allow peace to reign, because Godwin won’t be governor forever and history would keep repeating itself.

Only Hope in God lasts forever.

BREAKING: Buhari signs Executive Order 009 ending open defecation by 2025

President Muhammadu Buhari has just signed Executive Order 009 to end open defecation in the country by 2025.

The new order states, among others, “That by this Order, Nigeria is committed to being open defecation-free by 2025.

“That the National Open Defecation-Free (ODF) Roadmap developed by the Federal Ministry of Water Resources with support from other key sector players across Nigeria be put into effect.
“There is established in the Federal Ministry of Water Resources a National Secretariat called ‘Clean Nigeria Campaign Secretariat.’

“The Secretariat is authorised on behalf of the President to implement this Order by ensuring that all public places, including schools, hotels, fuel stations, places of worship, market places, hospitals and offices have accessible toilets and latrines within their premises.

“All Ministries, Departments and Agencies (MDAs) of government shall cooperate with the Clean Nigeria Campaign Secretariat.

“The National Assembly and the State Houses of Assembly shall enact legislation on the practice of open defecation, with appropriate sanctions and penalties.”

Social media offenders risk 3-year jail, N10m fine

A Bill that prescribes a three-year jail term or fine of N10million for Social media offenders on Wednesday scaled second reading in Senate.

The controversial Bill titled: “A Bill for an Act to make provisions for the protection from internet falsehood and manipulations and for related matters, 2019,” was sponsored by Senator Mohammed Sani Musa, representing Niger East.

In his lead debate, Senator Musa said it has become imperative to curb the excesses of those using social media to cause disaffection and assassination of character through fake news.

Musa said that the Bill is not an attempt to stifle free speech but rather an opportunity to address the growing threats which if left unchecked, can cause serious damage in the country polity and equally disrupt peaceful co-existence.

He noted that while the internet has democratised information, “the fact remains that it has also been a weapon in the process which is why governments across the world are trying to mitigate the risks associated with information transmission via the internet by monitoring abuse and deliberate misconducts.”

According to him, one of the disadvantages of the internet is the spread of falsehood and manipulation of unsuspecting users.

Musa said: “Today, motivated by geopolitical interests and identity politics, state and non- state actors use the internet to discredit government, misinform people and turn one group against the other.

“The hoax about the demise of President Muhammadu Buhari in London and his purported replacement by one Jibril of Sudan, among others, are things that threaten the peace, security and harmony of our people.

“Inauthentic online accounts run by human trolls have been used to rapidly spread falsehood. For media outets, publishing a story with false contents that attract users, benefits advertisers,” Musa said.

According to the Niger East Senator, the Bill has 36 clauses and provided for the prevention of hawkers of falsehoods and manipulated contents using the internet.
He said that the penalty for defaulters goes up to N300,000 for individuals and up to N10million for corporate organisations and imprisonment of up to three years or both.

The Bill, he said, also contained guidelines for internet intermediaries and providers of mass media services as well as sanctions for offenders.
Senators Ibrahim Gobir, Ishaku Clifford Elisha Abbo, Abba Moro and Bala Ibn Na’Allah supported the Bill.

However, Senator Chimaroke Nnamani (Enugu East), “strongly” opposed the Bill.
Nnamani said: “I not only oppose this bill, I condemn it in its entirety. Based on our Constitution, there is Freedom of Information and Freedom of Speech. There is a Cyber Crimes Act that deals with this issue. There are also laws that deal with false information, libel, slander and so on.

“Yes, fake news has done a lot in America and other countries, but they have not brought any law to deal with it. I therefore strongly oppose this bill.”
Nnamani while quoting a German Pastor, Martin Niemöller, added: “First they came for the socialists, and I did not speak out because I was not a socialist. Then they came for the trade unionists, and I did not speak out because I was not a trade unionist.

Then they came for the Jews, and I did not speak out because I was not a Jew.
Then they came for me and there was no one left to speak for me.”
When the Bill was put to voice vote by Senate President Ahmad Lawan, Senators approved it for second reading.

Lawan referred the Bill to the Senate Committee on Judiciary, Human Rights and Legal Matters for further legislative work.

[Just In] Alleged Wrongful Dismissal: Industrial Court assumes Jurisdiction

Kano—The Presiding Judge, National Industrial Court sitting in Kano, His Lordship, Hon. Justice E. D. Isele has dismissed the preliminary objection filed by Kano Electricity Distribution Company challenging the court jurisdiction to hear matter brought by Mustapha Usman on alleged wrongful dismissal for lacking merit and ordered matter to proceed to trial.

The court held that the application was brought on an ambiguous provision of a staff handbook which the plaintiff may not be aware of.

The Defendant filed a preliminary objection to strike out the suit for being incompetent, that the Court has no jurisdiction to adjudicate on it, on the ground that Mustapha was entitled to file an appeal against the decision of the disciplinary panel that the local remedy is a condition precedent for setting a judicial process in motion.

In opposition, the claimant submitted that to apply the Article of the staff handbook which the defendant is seeking to invoke will permanently shut the door of justice urged the court to dismiss the objection for being frivolous, and an attempt to ridicule right of access to the court.

In his ruling, the trial Judge, Justice Isele held that the defendant failed to annex the said Handbook for the Court to peruse and there is nothing before the court to read into and give a valid decision as to the claims in the notice of the preliminary objection.

In all, the court dismissed the preliminary objection for lacking merit, ordered matter to proceed to trial.

NCC working on cheaper data services, says Danbatta

The Nigerian Communications Commission says it has begun moves to avail Nigerians with massive data Internet connection across the country at cheaper rates.

The commission noted that it had licensed and supported infrastructure development companies in deploying fibre optic cables across the country to enable data-based start-ups in harnessing and achieving their objectives.

The Executive Vice Chairman, NCC, Prof Umar Danbatta, stated these in Port Harcourt on Tuesday during an ICT innovation forum, themed ‘Developing Nigeria’s tech eco-system, imperative for improving local content.’

Danbatta who was represented by the NCC’s Secretary, Mr Felix Adeoye, said the commission was supporting the Federal Government in curtailing hate speech in the cyberspace and ensuring that data were utilised positively by Nigerians.

He said, “Within the next few years you are going to see availability of massive data all over the country. We have licensed a number of infrastructure companies to deploy fibres all over the country and they have begun operations.”

Ghana’s ex-president asks Nigeria to open borders

Ghana’s former President John Mahama on Tuesday appealed to the Nigerian government to open its land borders closed since August in order to allow resuming economic activities in West Africa, local media reported.

“With the signing of the joint border task force agreement between Nigeria and her neighbors, I will like to take this opportunity to appeal to Nigeria to open up her border so that economic activities can resume,” Mahama was quoted as saying by the Nigerian News Agency at an event in Nigeria’s Lagos.

The closure was having a significant impact on several small and medium businesses, Mahama added.
The Nigerian authorities on Aug. 22, suddenly closed the the busy Seme and Idiroko borders with Benin.

Nigeria’s President Muhammadu Buhari said the border was closed to stop smuggled rice from entering the country.

This has raised the price of local rice available in the country.

News PSC vs IGP: What court decided on Police recruitment

The Federal High Court Abuja will on Dec. 4, deliver judgment in the suit filed by the Police Service Commission (PSC) against the Nigeria Police Force over the recruitment of 10,000 constables.

The trial judge, Justice Inyang Ekwo fixed the date on Wednesday after hearing arguments from counsel representing parties in the suit.

Arguing on behalf of PSC, Mr Kanu Agabi (SAN) held that contrary to arguments earlier canvassed by the Attorney- General of the Federation, the fourth defendant in the suit, there was no distinction between recruitment and appointment.

“The fourth defendant has tried to distinguish between recruitment and appointment but recruitment simply means the filling of vacancies by appointment of people not already in the public service, there is no distinction between the two,” Agabi said.

Agabi further argued that there was no constitutional provision to back the claim that “recruitment of police personnel from time immemorial has been done by the Inspector -General of Police, (IGP)”.

He said it was the responsibility of the PSC to recruit police personnel and not that of the IGP and that allowing the IGP to conduct recruitment, would be usurping powers of the commission.
Agabi prayed the court to grant all the reliefs sought by his client in the suit.

Mr Alex Iziyon, SAN, canvassing arguments on behalf of the first to third defendants, the Nigeria Police Force the IGP, and the Minister of Police Affairs, described the suit as frivolous and scandalous.
He urged the court to dismiss the suit, saying it was an abuse of court process.

For his part, Mr Terhemba Agbe, counsel to the Attorney-General of the Federation (AGF) insisted that there was a distinction between recruitment and appointment.
Agbe told the court that the AGF had advised both parties to work in harmony, that the IGP should conduct recruitment into the police and the names of those found worthy would be forwarded to the PSC for appointment.

After hearing arguments from all parties, Justice Ekwo fixed Dec. 4 for judgment and ordered that on the day of judgement, no employee of the police or PSC should be in the court gallery.
He ordered that only legal counsel, those designated to represent both organisations and the media should be present in court.

News Agency of Nigeria (NAN) recalls that the PSC had taken the Nigeria Police Force to court over the recruitment of 10,000 constables as approved by President Mohammadu Buhari.
The suit with the number, FHC/ABJ/CS/1124/2019, was filed by the plaintiff’s counsel, Kanu Agabi.

In the motion on notice filed on Sept. 24, the commission is praying the court for an order of interlocutory injunction restraining the defendants from ”appointing, recruiting or attempting to appoint or recruit by any means whatsoever any person into any office by the NPF pending the hearing and determination of the substantive suit”.

The plaintiff also held that none of the respondents was authorised by law to play any role ”in the appointment, promotion, dismissal or exercise of disciplinary measures over persons holding or aspiring to hold offices in the Nigeria Police Force”.

The commission said the NPF was presently trying to appoint 10,000 persons into the force in a flagrant usurpation of the functions and powers of the PSC.

The commission maintained that unless restrained by an order of this Court, the respondent’s appointments/recruitments was capable of foisting a fiat accompli on the judgment of the court in the matter.

N1tn was spent on NASS constituency projects in 10-years without results – President Buhari

President Buhari has said that the over N1 trillion spent on the constituency projects of National Assembly members in the last 10 years has produced no results.

He said data collected from Nigerians in rural communities showed that they had not felt the impact of such projects. President Buhari spoke at the National Summit on Diminishing Corruption in Public Sector, which opened at the State House Conference Centre on Tuesday, November 19th in Abuja.

The event was organised by the Office of the Secretary to the Government of the Federation, Boss Mustapha, in collaboration with the Independent Corrupt Practices and other related offences Commission.
“N1tn has been appropriated in the last 10 years for constituency projects, but the impact can hardly be seen,” he stated.

The President directed the ICPC to go after the contractors who collected funds for such projects and their collaborators in government.

Why we won Bayelsa election – APC replies Dickson

The ruling All Progressive Congress (APC), has told the governor of Bayelsa State, Hon. Seriake Dickson, to leave it out of the failure of the Peoples Democratic Party (PDP), and its unpopular candidate, Senator Douye Diri, in the just-concluded November 16th governorship election.

The party was reacting to the alarm raised by Dickson, and reported by DAILY POST, that the Federal Government connived with the Independent National Electoral Commission (INEC), and used security agents to rig the election, which he described as a military coup against the nation’s democracy.

According to the state APC chairman, Mr. Jothan Amos, the PDP lost the election because it fielded an unpopular candidate for the election.

In a statement signed and sent on Wednesday to Equitynews.ng, Mr. Amos, said instead of preparing how to pay off the backlog of salaries and pension he owes civil servants and pensioners, Dickson has continued to display his arrogance and total disrespect for the people and elders of the state.

According to him, the APC won the election free and fair because they got the support of the people who were obviously tired of the tyrannical style of governance Dickson subjected them to in the last eight years.

He urged Bayelsans to ignore the comments of Dickson and remain steadfast, as the APC is more focused on drafting better policies and programs that would improve the lives of the people and the socio-economic development of the state for good.

He said, “the PDP lost the election because of the attitude of Dickson. The manner he insulted and disrespect the people of the state, especially elders, is unprecedented. He has insulted everybody in Bayelsa, including former president of Nigeria, Dr. Goodluck Jonathan.

“If Dickson has insulted the likes of Dr. Goodluck who picked him from nowhere and made him governor, then nobody should be surprised that he is bracingly accusing the Presidency and the INEC of complicity when he knows that the right thing to do at this point is to head to the Election Petition Tribunal if at all he has a case.

“What happened in the just concluded election was the manifestation of the will of the people who wanted to be librated from the bondage Dickson subjected the to. They simply expressed the fact that they were tired of darkness, underdevelopment, non-payment of salaries, too many abandoned projects, dilapidated schools, insecurity and misappropriation of public funds.

“The people expressed their disappointment in the PDP led government at the polls, this was done without any form of financial inducements. If at all Dickson has learnt to receive wise cancel, I would suggest he rather start offsetting the many debt he owes Bayelsa civil servants and not to continue to make comments that would bridge the existing peace Bayelsans currently enjoy.

“He should start preparing his hand-over note because the battle is lost. In spite of the fact that he has failed to congratulate our governor-elect, Chief David Lyon, the people are happy about the way the election turned out. Go to the streets of Yenagoa, you would see people celebrating the victory of our party. And the APC is more focused on how to bring the needed change the people desire, and not to pay attention to hate speeches of Dickson.”
