Abuja—The Ag. President of the National Industrial Court, His Lordship, Hon. Justice Benedict Kanyip has dismissed the suit filed by Dr Kenneth Madiebo against Hon. Minister of Health and 3 others for lacking merit.

The claimant averred that by a letter dated 10th September 2012, he was appointed as a Project Officer by the defendants and posted to work with Nigeria Centre for Disease Control on a monthly salary of $2,500 US Dollars.

Thereafter, that he was engaged in the fight against the dreaded ebola virus and despite giving his best to battle the virus, the defendants stopped paying his monthly salaries and have been owing him for over 32 months.

He opined that failure and refusal of the defendants to pay his monthly salary amounts to a breach of a fundamental term of the contract of employment and also that the 20% monthly deductions from his monthly salaries by informal proxies of the defendants under the guise of ‘tax’ without providing proof of same are illegal, unjustifiable and fraudulent.

The claimant pointed out that the defendants refused to call evidence to defend the suit despite the service of all court processes including hearing notices on them, urged the court to grant his relief.

Delivering the Judgment, the presiding Judge, Justice Kanyip held that claimant cannot assume that he is entitled to automatic judgment just because the other party did not adduce evidence before the trial court.

On the claim for salary, Justice Kanyip maintained that claims for special damages must be particularized and strictly proved that claimant claimed for salary and presented a document that only gave him allowance dominated in USD but to be paid in Naira, that the claimant did not plead neither did he indicate dollar exchange rate to naira.

In all, the court ruled that claimant cannot thereby be said to have strictly proved his claim for salary and dismissed the suit for lack of proof.

I Offered To Drive Sowore Out Of DSS HQ But Was Turned Down -Falana

0

Rights lawyer, Femi Falana (SAN), has said that operatives of the Department of State Services turned down his request to drive out detained pro-democracy campaigner and Publisher of Sahara Reporters, Omoyele Sowore, from the headquarters of the agency in Abuja.

Falana said that he was at the DSS facility following an appointment he booked with the agency to enable him visit his client.

DSS spokesperson, Peter Afunanya, had on Tuesday morning claimed that the service was yet to release Sowore because he could be knocked down by a vehicle if left to go on his own.

Falana while reacting to Afunanya’s claim, advised the agency to stop misleading and giving false information to members of the public.

He debunked claims by the DSS spokesperson that he had not called the Director-General of the service, who had failed to respond.

Falana however, urged the DSS to restrain Afunanya from further exposing the country to avoidable ridicule in his desperate bid to justify the illegal detention of Sowore and Olawale Bakare widely known as Mandate.

He said, “Before leaving the headquarters of the SSS, I advised the management to restrain Dr Peter Afunanya from further exposing the country to avoidable ridicule in his desperate bid to justify the illegal detention of our clients.

“In view of the claim of the SSS that Mr Sowore could be knocked down by a moving vehicle if left alone, I offered to drive him out of the headquarters of the agency but my request was turned down.”

Falana further revealed that in a brief meeting with Sowore and Bakare, he informed them that upon the verification of their sureties, the Federal High Court had ordered their releases from custody.

He said, “In order to arm them to press for their rights, I gave them a certified true copy of the court order for their release which had been served on the SSS management.
“Our clients debunked the claim of Dr Afunanya that they had been given access to telephone and other facilities.”

The DSS has continued to hold on to Sowore and Bakare despite two court orders to release them after meeting bail conditions on both occasions.

Sowore was arrested in Lagos on August 3, 2019 for calling on Nigerians to take to the streets in peaceful demonstrations to demand a better country from the administration of President Muhammadu Buhari.

The government has accused him of insulting President Buhari and planning to bring down his government – charges observers around the world including leading legal practitioners describe as frivolous and laughable.

Shortly after the Independent National Electoral Commission (INEC) announced the candidate of All Progressives Congress (APC) winner of Kogi governorship election, political thugs continued on their killing spree.

According to reports from Kogi, the woman leader of Wada Aro Campaign Council, Ochadamu Ward, Hon Mrs Acheju Abuh was reportedly burnt alive in her home by alleged jubilant supporters and thugs said to be celebrating their party’s victory.

Reacting to the evil act, the spokesman, Wada/Aro Campaign Council, Faruk Adejoh-Audu was quoted saying “chanting GYB 4+4, the thugs, shooting sporadically, arrived Hon (Mrs) Abuh’s house at about 2pm this afternoon and surrounded the house, bolting every exit and escape from outside”.

“They then poured petrol on the building and set it ablaze as other terrorized villagers watched from hiding. She reportedly attempted to escape through a window but was prevented by the metal burglary proof and gun shots with bullets raining in her direction.

“The blood thirsty thugs waited, shooting and watching with relish while Mrs Abuh cried from inside the inferno until her voice died out. They reportedly left only when the entire house and Mrs Abuh had been burnt to ashes. There are fears that the killing spree may escalate over the night.

“We are calling on all men of good conscience to immediately help the people of Kogi State appeal to the Inspector General of Police to rein in Bello’s thugs and protect our people whose only crime was that they voted for their choice, a vote that was never allowed to count.

“Unless Nigerians of Good conscience immediately come to our aid innocent people may die worse agonizing deaths as the blood lust of Mr Bello and his supporters continue. “So far there’s no indication that the Kogi State Police will arrest her killers or even prevent further attacks and killings of people.”

FG vs Dino Melaye: What happened in court on Tuesday

0

An FCT High Court Maitama on Tuesday ordered the prosecution to pay N100, 000 for stalling trial of the Sen. Dino Malaye in the alleged falsehood suit filed against senator.

NAN reports that Melaye was charged with two counts bordering on giving false information to the police.

The Federal Government arraigned Melaye, alleging that he, sometime in April, 2017 deliberately gave false information to the police.

The judge, Justice Olasumbo Goodluck gave the order after the prosecution informed the court that their witnesses were not in court.

Goodluck held that by the provisions of Section 396 (4)(6) of the Administration of the Criminal Justice Act, 2015, parties are entitled to five adjournments and nothing more.

The judge said she was not pleased with the attitude of the prosecution in the matter, especially when the matter was placed on fast track, day to day hearing and the defendant’s counsel comes from outside jurisdiction.

” A cost of N100, 000 is therefore awarded against the prosecution instead of N250, 000 prayed by the defence counsel ” she ordered.

The judge said the trial was slated for Nov. 19 and Nov. 20 and both dates of trial are stalled for failure of the prosecution to bring their witnesses to court.

Goodluck then adjourned the matter until Dec. 5, for continuation of trial
Earlier, the prosecution counsel, Mrs N.O.Ezra informed the court that her witnesses were not in court.

Ezra then prayed the court for an adjournment to enable them bring their witnesses.
Responding, defence counsel Olusegun Odubela, SAN, told the court that this was unfair to the defendant because the witness could not be more involved in Kogi election than the defendant who was a candidate in the election.

”The court should be guided by the provisions of sections 396 (4)(6) of ACJA and 36 (4) of the 1999 constitution as amended.

”The prosecution have not adduced any cogent reasons why their witnesses are not available in court, in case the court grants them an adjournment, we will be asking for a cost of N250, 000, he said.

Odubela further told the court that since last sitting on July 4, the prosecution could have known and informed the court and the defence counsel who comes from another jurisdiction.
