Woman Docked For Allegedly Breaking Landlady’s Leg In Osun

One Abiola Oseyemi, 30, was on Monday docked before an Ile-Ife Magistrate’s Court, Osun State for allegedly breaking her landlady’s leg.

Abiola was said to have assaulted her landlady, Maria Atewolara, by pushing and caused her to fractured her leg, an offence that contravened section 355 of the Criminal Code, Laws of Osun, 2002.

The prosecutor, Inspector Sunday Osanyintuyi, told the court that the defendant committed the offence on July 10, 2020, at 7, Olaolu Street, Sabo Area, Ile-Ife.

However, Abiola pleaded not guilty to the charge of assault occasioning harm preferred against her.

Defence Counsel, Mr A.J. Awominure, urged the court to admit the defendant to bail in the most liberal term, saying she would not jump bail if granted.

Presiding Magistrate, Mr A.A. Adebayo admitted her to bail in the sum of N200,000 with one surety in like sum.

The case was then adjourned until September 14, 2020, for hearing.

JUDGMENT: Industrial Court orders reinstatement of three Federal Housing Authority General Managers

The National Industrial Court, Abuja Judicial Division has declared the action of the Federal Housing Authority in retiring ARC. U. M. Yakawu, MR. A. Y. Shehu and TPL R. O. Attah from service before attaining the age of 60 years based on redundancy and without any disciplinary proceeding culminating in the recommendation for their retirement as ultra vires, null and void, ordered the Housing Authority to reinstate them back to their position as General Managers from 12th February 2014 to the date of their respective retirement in line with the conditions of service with the sum of 1,500,000 costs of action.

The former general managers, ARC. U. M. Yakawu, MR. A. Y. Shehu and TPL R. O. Attah, were retired by the government in 2014 before attaining the 60 years mandatory age for retirement.

After hearing both parties’ arguments, the industrial court declared on Tuesday that retiring a staff based on redundancy, without any disciplinary proceeding before recommending his retirement, was null and void.

Delivering judgement on the case, Justice Sanusi Kado, added that the apex government should pay the affected staff the sum of N1.5 million as costs of the action.

Justice Kado, however, dismissed the staffs’ monetization and housing claim for lack of proof of evidence and that it was not the duty of the courts to fill gaps in pleadings for any claimant.

Delivering judgment after careful evaluation of the submissions of both parties, Kado said: “I have scrutinized the evidence before the court and it is clear to me that the 1st Defendant did not comply with the extant provision of the conditions of service in retiring the Claimants based on redundancy.

“There is no evidence before the Court to show that at that time, the two Management Committees of the 1st Defendant, which were made up of political office holders and career public servants were dissolved by press release announced via radio, on 17/5/2013, the posts of the Claimants have become redundant. The reason being that the dissolution of the two committees cannot amount or be equated to a declaration of redundancy as no such declaration was made.

“With the nullification of the retirement of the claimants, they remain in the services of the 1st Defendant with all their entitlement. But, they have failed to prove by credible evidence the exact amount they are entitled to. The Claimants claim as per this relief is vague. It is not grantable.

“This court has also held that in labour relations, the burden is on the claimant who claims monetary sums to prove not only the entitlement to the sums but how he/she came by the quantum of the sums; and proof of entitlement is often by reference to an instrument or document that grants it”.

Earlier during legal proceedings, the claimants averred that they were purportedly removed from the services before attaining the age of 60 years from birth and without any disciplinary action taken against them before terminating their appointment by the Housing Authority.

The claimant also stated that after their retirement, the government was yet to pay their full entitlement up to retirement dates.

FHA, meanwhile, contended that the government retired the claimants owing to restructuring which resulted in the redundancy of the offices, and were paid their entitlements, salary in place of notice in line with the terms of their contract.

The counsel to the defendants, Akomolafe submitted that the claimants failed to establish that their employment was wrongfully terminated because the government actions conform with provisions of the Public Service Rules and the conditions of service urged the court to dismiss this case in its entirety with substantial cost.

[BREAKING] Coronavirus: Osun Cancels Eid Prayers, Okays Juma’at Service In Mosque

The Osun State Government has announced that there would be no Eid congregation or prayers on Friday July 31.

However, the government allowed Juma’at service to hold in line with the existing safety protocols and guidelines.

This was disclosed on Tuesday in a statement signed by Prince Wole Oyebamiji Secretary to the State Government.

According to the statement, “The State Government of Osun having appraised how the state is currently faring with respect to the global health emergency, vis-a-vis the fact that Eid-el- Kabir and Juma’at fall on the same day, has announced that there would be no Eid congregation or prayers on Friday July 31. However, Juma’at service will hold in line with the existing safety protocols and guidelines.

“The State of Osun is still recording rising figures of confirmed COVID-19 cases amidst an active community transmission stage of the pandemic. This coupled with the fact that people whose COVID-19 status has not been ascertained would be travelling into the State from different parts of the country, in the spirit of the celebration.

“The State cannot afford the impact of any form of large gathering such as the kind expected at praying grounds and the associated difficulties of enforcing the safety protocols against COVID-19

“Our health managers are also worried by the recent surge in active cases , and have warned that the State could experience galloping figures due to continued disobedience of safety protocols if it allows any kind of specially high density gatherings or congregation.

“The State Government does not want its citizens exposed to this dangerous infection, especially among the aged and those with underlying health conditions.

“The State Government of Osun is not relenting in its fight to curtail the spread of the coronavirus, and to rid the State of it. The government is, and will continue to take necessary actions towards ensuring the safety and security of its people.

“The Governor and State Government of Osun wish all Muslim faithful a happy Eid-el-Kabir celebration ahead.”

Sallah: FG Declares July 30, 31 As Public Holiday

Federal Government has declared Thursday, July 30 and Friday, July 31 as public holidays to mark this year’s Eid-el-Kabir Celebration.

This was disclosed in a statement issued on Tuesday by the Permanent Secretary, Ministry of Interior, Georgina Ehuriah.

According to the statement, the Minister of Interior, Rauf Aregbesola, congratulated Muslim faithful and all Nigerians both at home and abroad on the occasion.

“He called on the Muslims to continue to imbibe the spirit of love, peace, kindness and sacrifice, as exemplified by the Holy Prophet Muhammad (Peace be upon Him) and to also use the period to pray for peace, unity, prosperity and the stability of the country especially as the world is witnessing global health challenges caused by Covid-19 pandemic,” the statement partly read.

While reiterating President Muhammadu Buhari administration’s commitment to battling the scourge of COVID-19 pandemic, Aregbesola asked for the cooperation of all Nigerians.

The Minister stressed that the Federal Government will continue to foster peaceful coexistence, national cohesion and stability in its march towards actualizing the nation’s full potentials.

He, therefore, called on the masses to support the government “in its avowed determination to build a peaceful, harmonious and prosperous country, where the rights of every citizen, are protected and guaranteed, as enshrined in the Constitution of the Federal Republic of Nigeria.”

The Minister also advised Nigerians to take responsibility against the spread of the COVID-19 virus, urging the citizens to stay safe by observing physical and social distancing, personal and respiratory hygiene, as well as other regulations issued by relevant authorities.

[JUST IN] AfDB Probe: Adesina exonerated by AfDB Independent Review Committee

Akinwumi Adesina, president of the Africa Development Bank, has been exonerated of all charges by the independent review panel led by Mary Robinson, former president of Ireland, according to AFP. Equity News can confirm.

Some whistleblower allegations of favouritism had been levelled against Adesina and although he had been cleared by the ethics committee of the bank, the US had requested for an independent investigation saying it was not satisfied with the report of the committee.

The panel of three experts, led by Robinson alongside Gambia’s Chief Justice Hassan Jallow and the World Bank’s integrity vice president Leonard McCarthy, cleared Adesina of all charges alleged by whistleblowers.

“The Panel concurs with the Committee in its findings in respect of all the allegations against the President and finds that they were properly considered and dismissed by the Committee,” Monday’s report concluded.

The African banking institution and Adesina – who is the sole candidate for the bank’s August’s presidential elections – had been in the eye of the storm over allegations of impropriety levelled against him by some whistleblowers working in the bank.

FG Opens Rail For Eid Travellers, Mandates Face Mask

The Federal Government has announced that it would be reopening rail system for Nigerians that would be willing to travel to various states during Eid, a development reached by the apex government to ensure provision of mass transit and meet the yearning of people wishing visit family and friends.

It disclosed that there would be face mask enforcement on passengers using the rail and other COVID-19 protocols to prevent spread of the deadly virus in the country.

JUST IN: Buhari Names Train Stations After Tinubu, Fashola, Osinbajo

President Muhammadu Buhari has named train stations along the Lagos-Ibadan and the Itakpe-Ajaokuta-Warri corridors after “deserving Nigerians”, the Minister of Transportation, Rotimi Amaechi, has said.

Presidency aide, Tolu Ogunlesi, revealed this on Monday in a tweet.

According to Ogunlesi, the Apapa station was named after Bola Ahmed Tinubu, while the Agege station was conferred on the Minister of Works and Housing, Babatunde Fashola.

Other personalities conferred with train station names include Lateef Jakande (Agbado station), Vice President Yemi Osinbajo (Kajola station), and Funmilayo Ransome-Kuti (Papalanto station).’



FG Increases Train Fare, as Abuja-Kaduna Service Resumes July 29

The Federal Government has announced the resumption of the Abuja to Kaduna rail services on Wednesday, July 29, 2020. The resumption of the train services is going to coming with fare increases amid precautionary measures to curtail COVID-19.

The disclosure was made by the Minister of Transportation, Rotimi Amaechi, during an inspection tour and test run of the 10 newly acquired coaches and 2 locomotives deployed on the Abuja to Kaduna rail corridor.

Amaechi also revealed that President Muhammadu Buhari has approved an increase in train fares due to the fact that the train will now be conveying half its capacity in order to maintain social distancing.

According to the Transport Minister, “In a month (pre-COVID-19), we get about N120 million, and if we run like this (half capacity), we will realize N60 million. It means that we need another N60 million to complete the running cost.” 

“It is, therefore for the above reason that the rates have been increased as follows: First class, N6,000, Business Class, N5,000 and Economy, N3,000 to enable Nigeria Railway Corporation (NRC) meet up at least with the running cost.’’ 

When asked if this increase will not be too much of a burden for the poor to pay, Amaechi insisted that they can afford it, pointing out that it was certainly cheaper than the ransom to be paid if kidnapped on Abuja-Kaduna road.

On the Itapke to Warri rail line, he also revealed that the route will be more lucrative when fully operational, than the Abuja to Kaduna route because when the Ajaokuta-Kaduna-Kano gas pipeline project starts, they will carry their pipes from Warri seaport to Itakpe.

He said that the fear of exposing the 1000 workers needed to complete the Lagos-Ibadan railway, to the coronavirus disease, stalled the project which was supposed to be completed in May 2020. He also said that lack of funds is delaying the take-off of the Ibadan-Kano railway line.

The Kaduna State Governor, Mallam Nasir el-Rufai who saw the Minister off to the rail station after a courtesy call, told journalists that the reopening of the railway could not have happened at a better time. He reminded them that COVID-19 is real, therefore people should abide by all the safety protocols.

On the issue of the increased train fare, the governor said he wished it would have been higher and called on the Ministry and NRC to consider e-ticketing as a measure of addressing ticket racketeering at the train stations.

On his part, the Managing Director, Nigerian Railway Corporation (NRC), Fidet Okhiria, said that with the arrival of these Diesel Multiple Units (DMU’s), the corporation will now increase the frequency of trips on the Abuja-Kaduna line from eight (to and fro) trips to 14 per day.

The Manager of the Abuja-Kaduna Rail Service, Pascal Nnorli disclosed that there will be fumigation of all rolling stocks and offices before the reopening of the station. He also said that the policy of no mask no entry will be enforced at all stations. He further disclosed that more DMU’s are still being expected on the route to manage the high passenger traffic.

It can be recalled that the Nigerian Railway Corporation (NRC) suspended passenger train operations nationwide following the ban on interstate travel by the Federal Government on April 28, 2020, as part of the measure to contain the spread of the coronavirus disease.

Some of the suspended train services include the flagship Abuja-Kaduna train service, Lagos-Kano express train on the old narrow gauge, Lagos-Ogun passenger services and some others.

Amaechi had earlier last month, said that the ministry was not in a hurry to resume train operations because of the danger posed by the coronavirus pandemic. He insisted that all health and safety protocols must apply when train services resume.

JUST IN: Industrial Court strikes out suit against Pension Administrator

The National Industrial Court, Lagos Judicial Division has struck out the case filed by former Managing Director of Veritas Glanvills Pensions, Mr. Adebayo Adesina against the firm for lack of Jurisdiction.

The presiding judge, Justice Nweneka held that the Court lacks jurisdiction to hear and determine the suit as presently constituted that Applicant/Respondent’s claims do not have any bearing whatsoever to employment, labour, Industrial relations, trade unionism, employer’s association or any other matter which the Court has jurisdiction to hear and determine.

The claimant- Adebayo Adesina had approached the Court via originating summon sought amongst others for a declaration that the Veritas Glanvills Pensions petition dated 12th day of February 2019 against him constitutes a violation and/or likely violation of his fundamental right to personal liberty and dignity of human persons guaranteed by the Constitution of the Federal Republic of Nigeria 1999 [as amended].

Responding to the suit, the Pension administrator counsel Umar Saka Esq. filed a notice of preliminary objection, asked the Court to strike out the suit for lack of jurisdiction, and also that the suit constitutes an abuse of court process as it prays the Court for precisely the same prayers/reliefs which has been determined by the Honourable Court.

Delivering Judgment after careful perusal of the submissions of both counsel, the presiding Judge, Justice Ikechi Nweneka held that while the facts giving rise to the petition arose from the Applicant/Respondent’s employment, the petition and the claims before the Court do not relate to the Applicant/Respondent’s employment rights.

“From the wording of Section 254C[1][d] of the 1999 Constitution [as amended], the jurisdiction of this Court on civil causes and matters relating to or connected with any dispute over the interpretation and application of the provisions of Chapter IV of the Constitution is limited to employment, labour, industrial relations, trade unionism, employer’s association or any other matter which the Court has jurisdiction to hear and determine.
