Court Adjourns Suit Challenging Funke Akindele’s Conviction

A Federal High Court in Lagos has adjourned till July 21, a suit challenging the conviction of popular Nollywood actress, Funke Akindele, her husband, Abdulrasheed Bello popularly known as JJC Skillz and 236 others.

The suit which was filed by a Lagos lawyer, Olukoya Ogungbeje is seeking a declaration that the law upon which Akindele and others were convicted was inconsistent with the 1999 constitution.

He also argues that the arrest, arraignment, trial, conviction and sentencing of Akindele and others lacks legal backing.

It’s not clear if the legal practitioner, Olukoya Ogungbeje who filed the suit in his name was briefed by the Nollywood actress to initiate the action but the lawyers insists that, “I have a duty to protect and defend the sanctity of the constitution of the Federal Republic of Nigeria from any contravention or infraction,”.

At the proceedings today, counsel representing the Lagos State Government, Jonathan Ogunsanya filed and served its preliminary objection to the suit.

In the preliminary objection, the Lagos State Government is challenging the jurisdiction of the Federal High court to entertain the suit which cause of action it says arose from the acts of the police as agents of the State under the laws of the state.

The State government also says that the suit is an abuse of court process. It, therefore, wants the court to strike out the same.

Justice Maureen Onyetenu has adjourned till July 21 to enable the applicants file their response to the preliminary objections served on them by the Lagos State Government.

Funke Akindele and others were arrested, tried, and convicted for violating the Lagos State Infectious Diseases (Emergency Prevention) Regulations 2020.

The actress had hosted a birthday party in her Lagos residence to celebrate her husbands birthday.

I Did not Collect ₦500 Million NDDC Projects – Akpabio

The Minister of Niger Delta Affairs, Senator Godswill Akpabio, on Friday, denied collecting and executing projects worth N500m in the Niger Delta Development Commission.

He stated this when he appeared before the Senate ad hoc committee on the alleged misappropriation of N40bn in the intervention agency by the Interim Management Committee between October last year and May this year.

The Chairman of the Senate Committee on Niger Delta Affairs, Senator Peter Nwaoboshi, had at a news conference recently accused Akpabio of securing the projects without executing them.

HAJJ 2020 : We will not Compromise the Safety of Nigerian pilgrims – NAHCON

As the Muslim world waits with baited breath for the Saudi official decision on Hajj 2020, the National Hajj Commission of Nigeria (NAHCON) has assured that the health and safety of Nigerian pilgrims will not be compromised.

The NAHCON commissioner in charge of Operations, Licensing and Tour operators, Alhaji Abdullahi Magaji Hardawa, gave the assurance while fielding questions from the international media organization of  France Radio and the Voice of America (VOA) in his office on Friday.

He said that while the commission was still awaiting the the official announcement of the Saudi Government on the 2020 Hajj, the commission would also take into consideration the health and safety of Nigerians in deciding its participation in the annual pilgrimage, stressing that the lives and safety of the pilgrims is more important and paramount than any other consideration.

“whatever the final decision of Saudi Arabia on Hajj 2020 may be, we on our part will make sure that the wellbeing and safety of our country’s contingent is paramount and secured”, he declared.

Asked on the commission”s position on the Hajj 2020, especially against the background of limited time to the commencement of Hajj, the Commissioner said that the Commission is currently consulting with relevant stakeholders in the country to come up with advisory paper to guide the federal government in taking final decisions.

According to him “, we have just concluded the first phase of our consultation and interface with the National assembly Committees and leadership. We will start the next phase this week with meetings with the licensed Tour operators and chief executives of State pilgrims welfare boards and after which we will collate our findings and send same to the Federal Government as an advisory to guide them in their final decision making. I can assure you that whatever decision that will be made will be in the best overall interest of Nigeria and Nigerians “,adding” we are not unmindful of the challenges and time constraints, but we will ensure that whatever advice we give to the  government will not be influenced by sentiments. ”

Alh Hardawa explained that before the suspension of the 2020 Hajj arrangements by the Saudi authorities, the commission had made tremendous progress in the pricing and conduct of flight planning arrangement which had resulted in the reduction of cost paid to service providers to the tune of Three billion (₦3 Billion Naira) for which the federal government had praised the new board. He stated that the Covid-19 pandemic might have eroded that initial achievements as transportation and accommodation arrangements hitherto made may have to  be adjusted in line with the World Health Organization (WHO) safety protocol which Nigeria is a signatory.

He however assured that that commission has prepared well enough for any eventuality if it became imperative that the 2020 Hajj would go ahead.

Olumide Akpata Deserves The Support Of All Young Lawyers, and Indeed Every Nigerian lawyer — Caleb Agyoh Terzungwe

Recently, Kelechi Ibe released a short piece titled “Three Distinctive Attributes of Olumide Akpata That No Other Candidate Possesses”. That piece can be read here. I have read that piece several times over and I found Kelechi’s reasons for supporting Olumide Akpata to be very persuasive and compelling. However, I do not agree that Kelechi has done sufficient justice to Olumide Akpata’s person and candidacy.

Olumide Akpata deserves the support of all young lawyers, and indeed every Nigerian lawyer, in his quest to lead the Bar.

1. True Mentorship and Leadership: Dolly Parton said, “If your actions create a legacy that inspires others to dream more, learn more, do more and become more, then, you are an excellent leader.” This summarizes Olumide Akpata’s style. At age 23 he started building Templars with his elder cousin. Look where Templars is now. Admittedly, the election is not about his firm, but this fact is important to demonstrate Olumide Akpata’s excellent leadership and commitment to succeed. He has created a legacy that inspires others to dream more. He has empowered people to be more.

Around Olumide Akpata, you would easily find some of the youngest partners in law firms anywhere in Nigeria. These people, with absolutely no personal or family relationships with Mr. Akpata, grew and attained those heights in record time. There are two SANs at Templars and one of them grew at the firm from associate level to Senior Advocate of Nigeria with the right mentorship and leadership. If this doesn’t depict true mentorship and leadership, I don’t know what does. I do not know about any other candidate who comes with this history of growing others and creating a path for them to succeed without feeling threatened.

Juxtapose this with one of the candidates, whose firm has existed for about 30 years but has just two (2) partners, the candidate as Managing Partner and his son, as a partner. Is it the other candidate that has been a SAN for 13 years and hasn’t groomed anyone to becoming like him, or increased the number of partners at his firm? These are indicators of what true mentorship and leadership is and isn’t.
Consistent with his antecedent of supporting others and his understanding that as lawyers our knowledge determines our output and value, Olumide Akpata had sponsored 30 young lawyers selected on a competitive basis from different parts of the country to Lagos on an all-expense paid 2 weeks Legal Practice Preparation Course on new and emerging areas of law. My interaction with some of the beneficiaries indicate that those two weeks marked a watershed in their careers and have equipped them for a better future. Indeed, one of them, Ms. Ubong Onwioduokit (then of NBA Uyo Branch), confirmed that she secured a job in a renowned Lagos law firm about a month after this training and that the knowledge which she gained at the training clearly stood her apart from others who applied for, and interviewed for the role. That, for me, is a true testimony of how the supposedly little things that we do impact the lives of others and set them up for a better future.

2. Key Relationships and Contacts: If we are being honest, the NBA needs someone with the right relationships which can be brought to bear in achieving results. People say somethings cannot be done, but I think that one with the right relationships like Mr. Akpata can get things done seamlessly. While I cannot comment on the relationship bank of the other candidates, I am inclined to believe, and unless anyone else argues the contrary, that Mr. Akpata has more relationships outside the Bar that could be useful in making the Bar more beneficial to its members. Mr. Akpata has promised that should he become President, his leadership will set up a number of funds including an initial 100-million-naira healthcare fund, partner with hospitals across the country and deploy a workable health insurance scheme for lawyers. To achieve these, one needs to have the right relationships and contacts at one’s disposal to drive the conversation, create the required partnerships and raise the required funds. Akpata has the pedigree and resources to galvanize people and make this possible, and I have no doubt that he will do so.

3. Consistency and Innovation: Mr. Akpata is the most consistent and innovative of all the candidates, in his service to people and the Bar. The reforms he has championed are timeless and concrete. The SBL under his leadership became a key player in the economic development of Nigeria (as it should be). His team established a partnership with the National Assembly and the Nigerian Economic Summit Group, with support from the UK Department for International Development (UK DFID), to create the National Assembly Business Environment Roundtable (NASSBER) as a platform for the legislature and the private sector to engage, deliberate and take action on a framework for improving the Nigerian business environment. That partnership resulted in a comprehensive review of the institutional, regulatory, legislative and associated instruments affecting businesses in Nigeria. His team also brokered the collaboration with the Presidential Enabling Business Environment Council on the ease of doing business in Nigeria which involved the review of extant laws and regulations and the monitoring of the productivity and response time of Ministries, Departments and Agencies Notably, in his time, the SBL Inaugurated the Corporate Counsel Committee for inhouse counsel and set up a Task Force led by Mr. Ayuli Jemide to determine the scope of legal work that is statutorily prescribed to be the exclusive preserve of Nigerian lawyers and to work out modalities for enforcing such laws.

Notably, Mr. Akpata’s leadership of the SBL started organizing the three (3) months Finishing School for lawyers interested in corporate commercial law. He has planned that the Finishing School would now be operated by the Centre for Commercial Law Studies affiliated with the Lagos Business School, the Institute of Advanced Legal Studies (NIALS). He also promises that the NBA under his leadership will collaborate with the NIALS to deliver specialized trainings to lawyers across the country.

Olumide Akpata has contributed significantly to the profession, has gained the experience required to lead the Bar, and has demonstrated that results-oriented leadership is possible. I will conclude in the words of Chief Femi Okunnu SAN, CON that “It is time we allow the likes of the brilliant and energetic Olumide Akpata to take over the reins of leadership of our Association. We cannot wait any longer and the time for the shift is now”.

Defence Health Maintenance gets New MD Retired Admiral AB Afolayan

Surgeon Admiral AB Afolayan Rtd has been appointed as the New Managing Director/ Chief Executive Officer of Defence Health Maintenance Limited DHML, a cooperate entity owned by the Ministry of Defence and the Nigerian Armed Forces as a Health Maintenance Organisation (HMO).

It was established in response to the challenges of providing access to quality health care services for all eligible military personnel (serving and retired) and their families.

DHML brings together the health resources of the Nigerian Army, the Nigerian Navy and the Nigerian Air Force. It complements these with a network of civilian healthcare providers and professionals, to provide better access to quality healthcare services.

Surgeon Rear Admiral Azeez Bayo Afolayan (Rtd) is a distinguished Consultant paediatrician with over 30 years’ experience in the practice of Military Medicine and Health Administration.

He had a Degree in Medicine and Surgery from the University of Ibadan in 1979. In 1995 became a fellow of the West African College of Surgeons specializing in Paediatrics.

During his service in the Nigerian Navy, he was awarded the General Service Star, Forces Service Star, Meritorious Service Star and the Defence Service Star.

Surgeon Rear Admiral Azeez Bayo Afolayan (Rtd) served in different capacities both afloat and ashore in the course of the career in the Navy. He served twice as the Director of Medical Services, Naval Headquarters Abuja from 2009-2012 and 2014-2015, also served as Director Medical Administration and Logistics, Defence Headquarters, Abuja (2012-2014).

He was the Secretary-General of the Pan African Committee of Military Medicine (2004-2005) and later served as the Director-General of the 39th World Congress of Military Medicine (2011-2012).

The retired Surgeon Rear Admiral also represented the Nigerian Armed Forces on the Board of the Medical and Dental Council of Nigeria (2004-2005). He is a member of Nigeria Medical Association, Paediatrics Association of Nigeria and FCAI.

Surgeon Rear Admiral Azeez Bayo Afolayan (Rtd) would be bringing his wealth of experience to bear in the smooth running of the Defence Health Maintenance Limited as the third Managing Director/ Chief Executive Officer.

President Buhari Speech At The Signing Of 2020 Appropriation Act

Speech by his Excellency, Muhammadu Buhari, President of the Federal Republic of Nigeria at the signing into law of the Appropriation (Repeal and Amendment) Act, 2020 Presidential Villa, Abuja.

Friday, 10TH July, 2020
PROTOCOLS

1. It is my pleasure and honour to sign the Appropriation (Repeal and Amendment) Act, 2020 into law today. I thank the Distinguished Senate President, the Right Honourable Speaker of the House of Representatives, and all the Distinguished and Honourable Leaders, and Members, of the National Assembly for the prompt review and passage of the amendments to the 2020 Appropriation Act.

2. You will recall that I signed the 2020 Appropriation Act into law on Tuesday, 17th December 2019. However, it became necessary to revise the Appropriation Act 2020 in response to recent developments, in particular, the COVID-19 Pandemic. Crude oil prices in the world market declined sharply from a high of $72.20 per barrel in January 2020 to below $20 per barrel in April 2020, and have since remained around $40 per barrel.

3. Nigeria’s crude oil production quota has been reduced as part of the efforts of the Organization of Petroleum Exporting Countries (OPEC) to strengthen the oil market. Global trade has generally been disrupted as almost all economies were locked down for protracted periods in the wake of the COVID-19 Pandemic.

4. All these developments are plunging the global economy into recession, and Nigeria has not escaped the impact of this. In effect, the assumptions underlying the 2020 Appropriation Act are no longer sustainable.

5. It is therefore imperative to adjust our expected revenues, considering the widespread disruptions in domestic and international economic activities due to the COVID-19 Pandemic, and the containment measures taken in response thereto.

6. Understandably too, we needed to reallocate resources in the Appropriation (Repeal and Amendment) Act, 2020 to ensure effective implementation of required health and emergency measures, as well as to mitigate the negative socio-economic effects of the COVID-19 Pandemic.

7. The 2020 Amended Budget, which I have just signed into law today, underscores our Administration’s firm commitment to effectively contain the spread of COVID-19 and protect the lives and livelihood of our people. With these budget amendments, as well as our recently launched N2.3 trillion Stimulus Programme, we are well-positioned to safeguard the economy.

8. Considering recent budget implementation challenges, I have directed that efforts be made to ensure effective implementation of the Appropriation (Repeal and Amendment) Act, 2020 in order to realise its laudable objectives.

9. All Ministers are to ensure that their Ministries, Departments and Agencies intensify capital project delivery efforts and fully cooperate with the Ministry of Finance, Budget and National Planning to achieve the laudable objectives of the Budget.
10. We have, nevertheless, made some progress in the implementation of the Appropriation Act 2020. As at 31st May 2020, the sum of N253.33 billion have been released for the implementation of capital projects.

11. The Federal Ministry of Finance, Budget and National Planning is in the process of effecting budgetary releases that will ensure that all Ministries, Departments and Agencies receive at least 50 per cent of their amended capital budgets by the end of this month.

12. The Appropriation (Repeal and Amendment) Act, 2020, that I have just signed into law, provides for aggregate expenditures of N10.81 trillion, which is an increase of N216 billion over the level of expenditure initially proposed in the 2020 Appropriation Act. The Honourable Minister of Finance, Budget and National Planning will provide further details of the 2020 Amended Budget.

13. I wish to acknowledge the efforts of the Ministry of Finance, Budget and National Planning, particularly the Budget Office of the Federation, and everyone who collaborated and worked conscientiously to produce the Appropriation (Repeal and Amendment) Act, 2020 that I have signed today.

14. I thank all Nigerians for their understanding and unflinching support, especially during these difficult times.

BREAKING: Buhari Approves Suspension Of Ibrahim Magu As EFCC Boss

President Buhari has approved the immediate suspension of Ibrahim Magu as Ag. Chairman of the Economic and Financial Crimes Commission, EFCC, to allow for unhindered inquiry by the Presidential Investigation Panel under the Tribunals of Inquiry Act & other relevant laws.

This is contained in a statement issued by Dr. Umar Jibrilu Gwandu, Special Assistant on Media and Public Relations Office of the Attorney-General of the Federation and Minister of Justice made available to newsmen on Friday the 10th day of July, 2020.

According to the statement, President Buhari has also approved that the EFCC Director of Operations, Mohammed Umar, should take charge and oversee the activities of the Commission pending the conclusion of the ongoing investigation and further directives in that regards.

JUST IN: Buhari Signs Revised 2020 Budget Into Law

President Muhammadu Buhari has signed the revised 2020 budget into law, Equity News can confirm.

According to his special assistant on digital and new media, Mr. Tolu Ogunlesi, the president signed the revised budget into law around 11:04am on Friday.

Nigeria had to revise its budget estimates and assumptions after a drop in crude oil prices and the COVID-19 pandemic affected global supply chains.
