#NBA2020DECIDES: Adesina, DASAN Group seek suspension of NBA Elections

Nigerian Bar Association (NBA) presidential candidate, Mr. Dele Adesina SAN has asked the Electoral Committee of the NBA (ECNBA) to “suspend” the ongoing National Officers Election, saying it is fraught with irregularities.

This is contained in a letter signed by him, written to the ECNBA Chairman which was sighted by Equity News correspondent.

In another development, the Dele Adesina Support Group (DASAN) has also expressed their dissatisfaction with the ongoing electoral process. This is also contained in a statement issued which was sighted by Equity News.

“There is no doubt that the ongoing NBA Election lacks all features of credibility and transparency. We are therefore by this notice demanding immediate suspension of the ongoing election process to a later date when a clean list must have been prepared and published.” It was said.

JUDGMENT: Industrial Court orders Michael Okpara University to reinstate Don Professorship rank

The Presiding Judge, Owerri Judicial Division of the National Industrial Court, His Lordship, Hon. Justice Ibrahim Galadima has declared the reversion of Professor Vincent Eleasor appointment from the rank of Professor of Mathematics to Senior Lecturer by the Michael Okpara University of Agriculture Umudike as ultra vires, null and void and of no effect.

Justice Galadima also ordered Michael Okpara University to restore Prof. Vincent to his post as Professor of Mathematics with all rights, entitlements and to continue to pay his salaries, emoluments and allowances as a Professor.

The Court held that the purported reversion was not in line with the 2017 University Conditions of Service for Senior Staff, and not only wrong but most oppressive.

From facts, the Claimant- Prof Vincent Eleasor had submitted Claimant was offered appointment in the Department of Mathematics and requested to assume duties as an Associate Professor pending the regularization of his appointment, that by letter dated 16/12/2014 he was subsequently confirmed and approved his appointment as a Professor with effect from 1/10/2014 sequel to an assessment by the institution.

However, by a letter dated 20/5/2019, that his purported demotion from the rank of Professor to a Senior Lecturer without affording him a fair hearing was an infraction of his fundamental rights and whilst the action was pending, the institution went ahead to enforce a pay cut of his salary despite his protest.

In defence, the defendant learned Counsel EMMA UKAEGBU Esq argued that the case was premature and incompetent because claimant never utilized the machinery for settlement internally before proceeding to file the suit that the Defendant had such powers to ensure that Claimant was properly placed in his rank and position as a staff of the institution that the claimant appointment as an associate professor in the past was done in error and so a subsequent administration had the powers to rectify such errors by directing for the proper placement of its staff.

Counsel submitted that it was unlawful and inequitable for the Claimant to have been given an appointment he was not qualified for and so the Defendant must be seen as acting in the overall best interests of the general public and the institution, that Claimant was not denied fair hearing but refused to take advantage of the invitation sent to him to appear before the committee.

In opposition, Learned Claimant counsel ALEX EYONG Esq and FRANCIS EYONG Esq submitted that the act of the Defendant of “proper placement” of this Claimant, amounted to a ‘demotion’ which is synonymous in the public service realm as a disciplinary action meted out to erring servants that Claimant is justified to question whether he was afforded any fair hearing before determining his civil rights that the Institution cannot rely on the provision of FUA Act to escape liability.

Delivering judgment after careful evaluation of the submissions and arguments of both counsel, the presiding Judge, Justice Ibrahim Galadima held that the suit as constituted is competent and not premature.

“This Court painstakingly perused the entire submissions and arguments made by the Defendant Counsel to find where he expressly cited or referred to such provisions of the law that grant the Defendant the power to ‘properly place’ its staff where their appointments are perceived to be irregular.

“This Court’s conclusion, and I must be pardoned for thinking so, is that there is a skewed notion by the Defendant that it has an inherent power being the Claimant’s employer, to tamper with his rank or status in office as it pleases without any sound or concrete legal backing.

“Having been so appointed, it is tangential that if his appointment is to be varied or downgraded, then at least he must be given good cause for such and possibly accorded a fair hearing. The fact is that when he was appointed in 2014, the Appointment and Promotion Committee of the institution approved same and as such, there is a presumption of regularity with regards to his qualification for that position.

“On the whole, and for all the reasons above adduced, the invalidation and withdrawal of the Professorial appointment of the Claimant by the Defendant vide Exhibit C3 dated 20/5/2019 is not only wrong but most oppressive.

The election kick-started 11pm on Wednesday and is slated to end by 11.00pm today 30th July, 2020.

A total of 29, 635 lawyers are voting nationwide in the electronic poll and as at the time of filing this report, a former Chairman of the Nigerian Bar Association Section on Business Law, Olumide Akpata, is in early lead ahead of the two other contenders in the NBA presidential race – Babatunde Ajibade (SAN) and Dele Adesina (SAN).

Supreme Islamic Affairs Director Dies after Auto Crash in Kogi

The Director of Administration, Nigerian Supreme Council for Islamic Affair (NSCIA), Yusuf Nwoha, has been confirmed dead after his vehicle had an auto crash in Kogi State.

Nwoha, who left Federal Capital Territory (FCT) Abuja for Owerri, Imo state, his home town for Eid celebration, was at Okene yesterday night when his vehicle had an accident.

Although details on what transpired before the auto crash were yet unknown, the NSCIA through a statement by its Chairman for the Media Committee, Femi Abbas, on Thursday, confirmed Nwoha’s demise to Equity News.

NSCIA, while reeling out the deceased contributions to Islamic activities, noted that Nwoha, aside his role as director of administration, was also its representative at the National Hajj Commission (NAHCON).

While expressing a grief over sudden death of the former deputy director, Independent National Electoral Commission (INEC), NSCIA hinted that details of internment, his life as a Muslim and various contribution to Islamic activities in the country would be published soon.

Numbers reduced and strict health measures in place to guard against spread of pandemic

JEDDAH: About 1,000 pilgrims converge on the Mina Valley outside Makkah on Wednesday to begin their spiritual journey
of a lifetime.

The Day of Tarwiyah (fetching water) marks the beginning of Hajj. There are no major rituals, so the pilgrims will spend their time praying and reflecting until sunrise on Thursday.

Mina, 7 km northeast of the Grand Mosque in Makkah and within its boundaries, would normally be the site of the world’s largest tent city, accommodating about 2.5 million pilgrims.

However, Hajj participation is restricted this year to curb the spread of the coronavirus pandemic, and the pilgrims are all Saudis or expatriates who live in the Kingdom.

Those selected to take part in this year’s Hajj were subject to temperature checks and placed in quarantine as they began arriving in Makkah, and health workers sanitized their luggage.

Health and safety staff with disinfectant cleaned the area around the Kaaba, the structure at the center of the Grand Mosque draped in gold-embroidered cloth toward which Muslims around the world pray.

Hajj authorities have cordoned the Kaaba this year, and pilgrims will not be allowed to touch it, to limit the chances of infection. They have also set up dedicated health centers, mobile clinics and ambulances to care for the pilgrims, who will be required to wear masks and observe social distancing.

All pilgrims were required to be tested for coronavirus before they arrived in Makkah, and they will be quarantined after the pilgrimage.

They were given amenity kits that include sterilized pebbles for the Jamarat stoning ritual, disinfectants, masks, a prayer rug and the ihram, the seamless white garment worn by pilgrims.

“There are no security-related concerns in this pilgrimage, but it is to protect pilgrims from the danger of the pandemic,” said Khalid bin Qarar Al-Harbi, Saudi Arabia’s director of public security.

On Thursday the pilgrims will travel to Arafat to listen to the sermon, the pinnacle of Hajj. They then go to Muzdalifah and stay overnight, before returning to Mina for the Jamarat ritual.

Among the pilgrims in Mina on Tuesday were Zaker Kareem and Saifullah Al-Mohammedani, two Iranian friends who met at university in Madinah 6 years ago and live in the Kingdom. Al-Mohammedani is finishing his last year at university. They both registered their names on the Hajj portal at the same time.

“I was checking the portal all the time to see if my application was accepted or not,” said Al-Mohammedani.

“I was delighted when I saw the approval. I called Zaker and he told me that he was also accepted.”

Kareem.

Zelkin, an Azerbaijani pilgrim who lives and works in Jubail, said: “I would like to thank the Saudi government for this opportunity at such a difficult time.

“I know it’s really hard when there is coronavirus disease everywhere, to make this kind of arrangement in such a short time.

“I couldn’t believe this. It’s a once-in-a-life-time opportunity. It’s not my luck, it’s Allah’s will and you should follow his will.”

World Bank Approves $500 Million to Help keep 6 million Nigerian Girls in School

The World Bank said it has approved a $500 million loan that is intended to help end female education inequality in Nigeria with the Adolescent Girls Initiative for Learning and Empowerment (AGILE). The scheme will be implemented in 7 states in Nigeria.

A detailed press statement by the World Bank, which was seen by our correspondent, noted that the credit facility is to be disbursed through the International Development Association (IDA) which provides credit for human development in developing nations.

More details: Note that the $500 million credit facility will mature in 30 years. It also has a 5 year grace period, with low to zero interest.

The Bank said that the project would be implemented mainly in Northern states including Kano, Kebbi, Kaduna, Katsina, Borno, Plateau. Ekiti is the only Southern State represented.

The project would also enable girls to gain such skills as digital literacy, life skills, and health education. The World Bank forecasts that a minimum of 6 million girls and boys would benefit from the project.

“There is no better investment to accelerate Nigeria’s human capital development than to significantly boost girls’ education. The AGILE project will enable Nigeria to make progress in improving access and quality of education for girls, especially in northern Nigeria. Addressing the key structural impediments in a comprehensive way will create the enabling environment to help Nigeria ensure better outcomes for girls, which will translate into their ability to contribute to productivity and better economic outcomes for themselves and the country,” said the World Bank’s Country Director for Nigeria, Shubham Chaudhuri.

Some quick facts: According to UNICEF, about 27.2% of girls across Nigeria are not enrolled in schools. Teenage girls in Nigeria face multiple challenges with completing secondary school. In the north, the lack of schools is even a greater challenge. Typically, there is just one secondary school for absorbing about ten primary schools within a community. And most often than not, these schools are in dilapidated conditions, lacking basic amenities.

“Poor condition of infrastructure and a lack of water sanitation and hygiene (WASH) facilities makes it difficult for girls to stay in school. In addition, close to 80 percent of poor households are in the north, which makes it very challenging for them to cover the direct and indirect costs of schooling. All these factors have contributed towards limiting the number of girls that have access to secondary school.

“ If nothing is done, 1.3 million girls out of the 1.85 million who began primary school in 2017/2018 in the northern states will drop out before reaching the last year of junior secondary school,” the World Bank said in the statement.

It is, therefore, expected that the Adolescent Girls Initiative (AGI), would help young girls to navigate the peculiar challenges hampering their access to education. AGI is a public-private partnership aimed at promoting the transition of adolescent girls from school to productive employment through innovative interventions that are tested, and then scaled-up or replicated if successful.

Report: Nigeria Contributed $1.17bn To ECOWAS In 16 Years

Nigeria has paid over 1,177 billion dollars to the Economic Community of West African States (ECOWAS) as its Community Levy contribution in the past 16 years.

According to documents from a presentation by the ECOWAS Commission to Parliament at Plenary during its Virtual Second Extraordinary Session, Nigeria paid 853,310,564 UA (West Africa Unit of Account) for the period under review.

The West African Unit of Account (WAUA) is the authorised currency used in ECOWAS. The exchange rate for July obtained from ECOWAS shows that one Unit of Account equals 1.3799633 dollars.

Nigeria’s payment represents 40.42 per cent of the total payment of 2,913,088,908 dollars payment made by all the 15 member states, and is higher than payments made by 12 other countries put together except Ghana and Cote d’Ivoire.

Ghana paid about 508,577 million dollars, Cote d’Ivoire 347,262 million dollars, while Benin, Burkina Faso, Cape Verde, Guinea, Guinea Bissau, Gambia, Liberia, Mali, Niger, Senegal, Sierra Leone and Togo paid a total of 879,711 million dollars.

Ghana’s payment represents 17.45 per cent of the total sum, Cote d’Ivoire 11.9 per cent, while the cumulative payment by the other 12 countries represents 30.1 per cent.

Within the period under review, Guinea Bissau paid the lowest amount of 6, 204 million dollars, representing 0.2 per cent of total community levy proceeds in the 16 years under review.

The Community levy was adopted in 1996 by the Authority of Heads of State as the major funding for ECOWAS after the initial contribution regime seemed ineffective.

However, the Community Levy Protocol took effect in 2003 when all member states started its application.

The protocol stipulates that the taxable base shall be all goods originating from third countries (non-ECOWAS countries) imported into the community.

Also in the presentation to Parliament, there were certain exemptions to the tax on imported goods. These included aids and grants to support development projects and goods imported under a financial agreement with foreign partners.

A further look into the community levy data showed that many countries were yet to pay the total sum from their community levy assessments.

Based on the assessment, if all countries had paid in full, the sub-regional body would have gotten more than 3,710 billion dollars as against the 2,913 billion dollars paid, leaving a deficit of 797,215 million dollars.

Based on this assessment, Nigeria had paid 64 per cent of its payments, leaving an outstanding of 36 per cent.

Going by the above, if all countries had paid their complete levy, Nigeria alone would have paid more than 1,842 billion dollars, representing 49.64 per cent of the total Community Levy accrueable to ECOWAS.

2020 NECO, Common Entrance Exams For October 5, 17 – FG

The Federal Government has announced that the 2020 Senior Secondary School Certificate Examinations for SSS3 pupils organised by the National Examination Council (NECO) will start October 5 and end November 18.

It also said the 2020 National Common Entrance Examination will hold on October 17.

This was announced by Emeka Nwajiuba, Minister of State for Education, according to a statement signed by Ben Goong, Director, Press and Public Relations, Federal Ministry of Education, on Wednesday.

“Registration for NECO (SSCE) which is ongoing will end on the 10th of September 2020 and there shall be no extension for registration whatsoever.

“The National Common Entrance Examination (NCEE) which is a one-day examination for intending applicants into Unity Colleges (JSS1) will run in between the Senior Secondary School Examinations i.e. on Saturday, 17th October 2020,” the statement read.

The ministry also stated that the Basic Education Certificate Examinations for JSS 3 pupils also organised by NECO would commence August 24 and end September 7.

It also said the National Business and Technical Examination Board examination would commence on September 21 and end on October 15.

“The minister, therefore, directed all examination bodies to release details of their examination timetables in the next seven days,” the statement added.

Schools in the country have been shut since March due to the novel coronavirus (COVID-19) pandemic.

17 candidates to contest in Ondo State Governorship Election – INEC

The Independent National Electoral Commission (INEC) has announced that 17 political parties have submitted the names of their candidates for the Ondo State governorship election scheduled for October 10.

The commission’s spokesperson, Festus Okoye said the list and credentials of the 17 candidates would be uploaded on its website and published in its state office in Akure on Friday, July 31.

Members of the public who have reasonable grounds to believe that any information given in the affidavit or any of the documents submitted by any of the candidates is false, have been asked to seek redress in court. Okoye said;

“Seventeen out of the 18 registered political parties gave the commission the requisite statutory notice of their intention to conduct primaries and they conducted primaries for the purpose of nominating candidates for the governorship election.

“By section 31 (5) & (6) of the Electoral Act, a person who has reasonable grounds to believe that any information given in the affidavit or any of the documents submitted by any of the candidates is false, may file a suit in court seeking a declaration that such information is false.

“If the Court determines that the information is false, the Court shall issue an Order disqualifying the candidate from contesting the election.”

Zimbabwe Agriculture minister Perrance Shiri dies of Covid-19

Zimbabwe’s Agriculture Minister has died of Covid-19 at 65, a day after two legislators tested positive for the virus.

President Emmerson Mnangagwa announced the death of retired air force marshal Perrance Shiri on Wednesday.

In the annoucement; “I am deeply saddened to inform the nation of the death of the Minister of

Agriculture Retired Air Marshall Perrance Shiri, a long-time friend and colleague,” President Mnangagwa said.

“Comrade Shiri a genuine patriot who devoted his life to the liberation, independence and service of his country.”

Shiri was the commander of Zimbabwe’s Air Force until the 2017 military coup that toppled long time ruler Robert Mugabe.

He then joined President Mnangagwa’s first Cabinet.

A veteran of Zimbabwe’s 1970s liberation war, Shiri was the commander of a North Korean

trained army unit blamed for the massacre of over 20,000 civilians soon after the country’s independence.

They hospitalised him on Tuesday just days after his driver succumbed to Covid-19 at the weekend.
