JUDGMENT: Court Jails Man Six months for Fraud in Maiduguri

Justice Aisha Kumaliya of the Borno State High Court, Maiduguri, on Wednesday sentenced one Bashir Ali to six months in prison for fraud.

The convict was prosecuted by the Maiduguri Zonal Office of the Economic and Financial Crimes Commission, EFCC, on a one-count charge of misappropriation to the tune of N484, 600.00 (Four Hundred and Eighty-four Thousand, Six Hundred Naira).

The charge read, “That you, Bashir Ali sometime in 2018 at Maiduguri, Borno State within the jurisdiction of this honourable court, being entrusted with dominion over certain properties to wit: N484,600.00 to Tanya Afro-Vet Consult Limited being the proceeds of sales of livestock feeds and drugs, did dishonestly misappropriate the entire sum and thereby committed an offence contrary to Section 311 of the Penal Code Laws of Borno State Cap 102 Vol.3 0f 1994 and punishable under Section 312 of the same Law.”

He pleaded guilty, upon which prosecution counsel, Benjamin Lawal Manji, prayed the court to convict and sentence him accordingly, while defence counsel, M.H Myshelia, pleaded with the court to temper justice with mercy.

Justice Kumaliye convicted and sentenced Ali to six months imprisonment with N20, 000.00 fine option. The convict is also to pay up the outstanding balance of N154, 600 to his former employers, failure of which he would have to spend six years in prison.

Ali’s journey to prison followed a petition to the EFCC from Dr. Yazeed Kolo, CEO, Tanya Agro-Vet Consult Limited, in which he alleged that the convict, who was a staff of the company, made sales of livestock feeds and drugs to the tune of N484, 600.00 which he converted to his personal use.

Nigeria records 2.8MW increase in electricity generation

As part of its commitment to making Nigeria better in the area of electricity distribution, the Minister of Power, Sale Mamman, has disclosed that the country’s electricity generation increased to 5377.8 mega watt.

He explained that the new feat was achieved at the beginning of August 2020 and that the record was the peak of the country’s generation.

The Minister, through a post on his social media page on Thursday, said that the feat showed and increase of 2.8mw as against the 5,375mw recorded on the national grid in 2019.

Mamman said that the recorded peak at 5,377.8MW of electricity was successfully evacuated to distribution load centers for onward distribution to homes across the country.

He, however, lauded efforts of President Muhammed Buhari as well as other stakeholders in the sector involved making the project visible while assuring Nigerians that the ministry would continue to improve on its achievement by improving electricity supply in the country.

“On the 1st of Aug 2020 the National Grid made history, by attaining a new record peak generation of 5,377.8MW of Electricity which was successfully evacuated to distribution load centers. Kudos to all involved. We are constantly striving to make Electricity better for Nigerians,” the minister wrote.

Manchester City Sign Nathan Ake From Bournemouth

Manchester City have signed centre-back Nathan Ake from Bournemouth for a reported fee of £40 million.

Ake has put pen to paper on a five-year deal, keeping him at City until the summer of 2025.

The Netherlands international described joining Pep Guardiola’s side as a “dream”.

He said: “City have been the best side in England over the course of the last decade.

“Coming here is a dream for me. This is a top side full of world-class players. Everywhere you look in this squad there are big names with international pedigree.

“Pep is a manager admired across the world – what he’s done in the game speaks for itself. The success he’s had is unbelievable and the style of football he plays really appeals to me.

Man remanded in custody after Court appearance over reckless driving, murder in Osun

A Magistrates’ Court sitting in Osun State has remanded a 30-year-old man driver, Patrick Umeh for reckless driving and alleged murder.

The Osun State Police Command on Wednesday dragged Mr. Patrick Umeh before Osun State Magistrate Court sitting in Osogbo.

According to the Charge sheet, Patrick Umeh (30) being the driver of Toyota bus with the registration number FKJ 797 XX, droved same in the high way in a manner that was dangerous to the public and cause the death of Aderoki Sefiu.

Patrick Umeh was also accused for driving recklessly and having no regards to the traffic rules.

The Police Prosecutor, ASP Fagboyinbo Abiodun told the court that the defendant committed the offences on 3rd, August, 2020 at about 3:30pm at Agunbelewo area, Osogbo .

He argued that the offences contrary to and punishable under section 4 of the Federal High way act Cap 34 Vol II. laws of Osun State 2003.

When the four count charges were read to the defendant, he pleaded not guilty to the offences.

The defence counsel, Odeh Emmanuel thereby applied for his bail on a liberal term.

He noted that the relative of the deceased is no longer interested in the case.

While ruling, the Chief magistrate, Mr Isola Omisade ordered the defendant to be remanded at Dada Estate police station pending the ruling on the application for bail.

However, the case was later adjourned till 6 August, 2020 for ruling on bail.

Woman Slumps In Osun Court During Trial For Face Mask Violation

A woman, Tolulope Olagunju, who is standing trial before an Osun State Magistrates’ Court in Osogbo, for not wearing a face mask on Tuesday slumped during court session.

Olagunju was arraigned alongside an expatriate, Elisan Mohammed, and 54 others arrested for not wearing face masks in public in Osogbo.

Shortly after her charge was read, Olagunju, who was standing near the dock, slumped and was helped to a seat inside the court by another defendant.

Addressing the court, the police prosecutor, Mr Adekunle Adeniyi, said the 56 defendants on August 4, 2020, at 11.30am engaged in conduct likely to cause a breach of public peace by not following laid down guidelines in respect of the COVID-19 pandemic.

He said the offence was contrary to and punishable under Section 249(d)(3) of the Criminal Code Laws of Osun State of Nigeria 2002.

The prosecution also accused one of the defendants, Siju Ajewole, of obstructing the cause of justice by resisting lawful arrest and assaulting an NCDC officer, Mrs Fadare Grace.

All the defendants pleaded guilty to the charges.

The defence counsel, Najite Okobe, urged the court to caution and discharge them.

The Magistrate, Mr Adebayo Ajala, convicted the 56 defendants and sentenced 53 of them to two hours of community service without an option of fine.

Ajala also sentenced Ajewole, who was arraigned for assault, to extra two hours of community service or an option of N2,000 fine.

He, however, cautioned and discharged Olagunju, a pregnant woman, and one Damilare Ajani, on health grounds.

Appeal Court refuses to stop Farouk Lawan’s $3m ‘bribery’ trial

The court of appeal sitting in Abuja has dismissed an application filed by Farouk Lawan, a former lawmaker, seeking to discontinue the $3 million bribery charges preferred against him by the federal government.

Lawan was the chairman of the house of representatives ad hoc committee probing the multi-billion naira fuel subsidy fraud in 2012.

He was accused of demanding $3 million from Femi Otedola to remove Zenon Petroleum and Gas Limited (Otedola’s company) from the list of oil companies allegedly involved in the fuel subsidy fraud in 2012.

Lawan, who was arraigned on three counts of bribery by the Independent Corrupt Practices and other related offences Commission (ICPC), was alleged to have collected $500,000 bribe from Otedola.

He filed a no-case-submission after the prosecution closed their case having called five witnesses to give evidence.

However, Angela Otaluka, judge presiding over the trial, ordered Lawan to enter defence after ruling that no-case-submission filled by his counsel had no basis.

Aggrieved, Lawan went before the court of appeal seeking to upturn the trial court’s judgment in his favour.

Delivering judgment in the appeal on Tuesday, Olabisi Ige, who read the decision on behalf of a three-man panel, held that the decision of the lower court was well founded.

The panel also held that the language of the trial judge, which Lawan complained about, did not place the defendant in any disadvantage position.

The appellate court added that the prosecution has made a “prima facie” case against Lawan which he must answer to.

“I am of the view that the rejection of the no-case submission is well founded and that the ruling of the lower court has not occasioned any miscarriage of justice against the appellant,” Ige said.

“The language of the lower court calling on the appellant to enter upon his defence to make his defence if any has in no way placed the appellant in any disadvantage or jeopardy
“I am of the firm view and I have no doubt that the oral and documentary evidence presented by the prosecution sufficiently linked the appellant to the charges against him and to warrant his being called upon to make his defence.
“Prosecution evidence was not slanted in favour of the prosecution. In all, all the four issues raised in this appeal are hereby resolved against the appellant. His appeal, being un-meritorious is hereby dismissed.”

FCT High Court judge, Okeke, is dead

The High Court of the Federal Capital Territory on Tuesday lost one of its judges, Justice Jude Okeke.

Justice Okeke, aged 64, died at the National Hospital in Abuja.

Some court officials, who asked not to be named because they had no authorisation to speak on it, said the deceased had complained of chest pain some days ago after which his condition deteriorated.

The spokesperson for the National Hospital, Dr Tayo Haastrup, confirmed that Justice Okeke died on Tuesday.

Justice Okeke, who until his demise occupied the ninth position in the hierarchy of the FCT High Court judges, handled the corruption case instituted against a retired judge of the Federal High Court, Justice Adeniyi Ademola, along with his wife, Olubolade, and a Senior Advocate of Nigeria, Joe Agi.

Justice Okeke, in a ruling on April 5, 2017, upheld the defendants’ no-case submissions and dismissed the charges.

On February 28, 2018, the Abuja Division of the Court of Appeal affirmed the dismissal of the case which was instituted by the Attorney-General of the Federation and Minister of Justice, Mr Abubakar Malami, as speculative.

[OSUN]: Oyetola flags off N200M market reconstruction, unveils plans for GDP boost

MIn fulfilment of his campaign promises, Osun State Governor, Adegboyega Oyetola, has flagged off reconstruction of N200 million Atakumosa market in Ilesha town, as part of his plan to boost the state”s Gross Domestic Product (GDP).

Oyetola stated that reconstruction of the market razed by fire would contribute effectively to the socio-economic and commercial activities, thereby, boosting the state annual GDP.

At launch of first phase of the market reconstruction yesterday, the governor assured traders that the reconstructed market would have modern facilities including boreholes, toilets, and waste bins, to meet international standard.

He noted that the efforts by the government through the state’s Community and Social Development Agency (CSDP), would bring succour to the displaced traders after suffering huge financial losses when fire razed the market and destroyed goods worth millions of naira.

“As our contribution to the ongoing initiative, our Government shall in addition to this CSDP assisted initiative, build another 250 stalls, which will be delivered before the end of this year.

“This project, which is supported by the Osun CSDP will see to the construction of a total of 400 stalls comprising lock up shops and open markets with boreholes, toilets and waste bins to meet international standard”, the governor added.

Oyetola, who expressed his delight at impact his policies and programme was already having on citizens, assured residents that the Osun Development Agenda was designed to cater for citizens’ welfare and boost standard of living in the state.

He noted that the market reconstruction project was an indication that the agenda was centered on the citizens’ development, saying, Atakumosa market was gutted by fire that destroyed traders’ valuables and means of livelihood.

“First, it happened at a time when the State of Osun was passing through serious financial and economic challenges and at a time when we were rubbing minds on how to further increase access of people of the state to improved social and economic infrastructure.

“Second, the incident was very painful in view of its devastating effect on the livelihood of the masses in the market. The effect is better imagined.

“I am, therefore, happy that, today, we are able to fulfil our electoral promise, as well as our role as government to provide security and welfare for the people by kick-starting the first phase of the reconstruction of the market which is worth about N200million. This will bring relief to our poor and vulnerable market men and women in Atakumosa market when completed”, he added.

Aside from the construction, the governor also presented cheques to 10 groups of traders, as an intervention fund to aid their post-coronavirus recovery in the state.

“At this juncture, I must remind us all and in particular the beneficiaries of this intervention that part of today’s project adopts Community/Group Driven Development (CDD) approach, which means you are the drivers of this market reconstruction project.

“I urge you to continue in this laudable lane as you cannot afford to fail in this enormous assignment, which is the way to go in this challenging period”, Oyetola added.
