JUDGMENT: Court Sentence Man To Six Months Imprisonment For $2,500 Fraud in Osun

The Federal High Court sitting in Osogbo, Osun State, has sentenced one Timileyin Awojodu to six months’ imprisonment for fraudulently obtaining the sum of $2,500 from an American.

Justice Peter Lifu had on Monday, July 13, 2020, convicted Awojodu and adjourned till Tuesday for sentencing after the convict pleaded guilty and opted for plea bargain.

The prosecutor from the Economic and Financial Crimes Commission, AbduRasheed Sulaeman, had during trial told the court that the 30-year-old Awojodu posed as a lady with the name, Troy Stone, and defrauded the American.

Sulaeman tendered as exhibits the money recovered from the defendant, one iPhone 7, his confessional statement as well as nude pictures he sent through his mail to the victim.

The defence counsel, Mr Dotun Akinsanmi, pleaded for leniency, saying his client had spent 73 days in the custody of the EFCC.

Delivering the judgment, Justice Lifu found Awojodu guilty and sentenced him to six months’ imprisonment with hard labour.

Justice Lifu said the jail term should run from October 2019, when the defendant was first arrested, adding that the money recovered from him should be returned to his victim in the United States of America.

EFCC Docks Two Suspected Oil Thieves in Port Harcourt

The Economic and Financial Crimes Commission, EFCC, Port Harcourt Zonal Office on Wednesday, July 21, 2020 arraigned Augustine Ofehe, Patience Tony and a barge, before Justice J. E. Inyang of the Federal High Court, Yenagoa, Bayelsa State on two-count charges of conspiracy and illegal dealing in petroleum product.

One of the charges read: “That you Augustine Ofelie and Patience Tony on or about the 15th day of May, 2017 in Bayelsa State, within the jurisdiction of this honourable court, without an appropriate licence to deal in petroleum product to wit: 600,000 litres of Automotive Gas Oil (AGO/diesel), conveyed in a metal barge podium and thereby committed an offence contrary to Section 1(1) (a) and punishable under section 1 (17) (a) of the miscellaneous offences Act, CAP M17 of the revised Edition (Laws of the Federation of Nigeria), 2007 and punishable under section 1 (17) of the same Act.”

In view of their pleas, prosecuting counsel, M. T. Iko prayed the court for a commencement date of trial and for the defendants to be remanded in prison custody.

However, counsel to the first defendant, D. J. Nwoniowei made an oral application for his bail, which was adopted by counsel to the second defendant, H. M Emerenini who added that his client was a nursing mother.

On his own part, counsel to the third defendant ( barge ) said he will formally approach the court for the bail application of the vessel.

Justice Inyang admitted the first and second defendants to bail in the sum of N1million (One million naira only) each, and with reliable sureties in like sum, who must be resident in Yenagoa, and would deposit their two recent passport photographs and valid means of identification with the court.

Additionally the sureties must swear to an affidavit of means and must make their phone numbers available to the court, while their verification would be carried out by the crime investigating officer.

The judge remanded the defendants in EFCC custody and adjourned the matter till October 5, 9 and 12, 2020 for trial.

The first and second defendants, who had no license to deal in petroleum products, were arrested alongside a metal barge podium, loaded with unspecified quantity of illegally refined Automotive Gas Oil by officers of the Nigeria Navy of Forward Operation Base FOMOSO, on May 15, 2017, and handed over to the EFCC for further investigation and prosecution.

JUDGMENT: Man Bags Life Imprisonment for Defiling Two-year Old Girl in Ogun

An Ogun State High Court sitting in Isabo, Abeokuta, has sentenced a 35-year-old man, Adekunle Olalere, to life imprisonment for defiling a two-year-old girl.

Olalere was, on Tuesday, convicted of one count of having sexual intercourse with the victim.

The convict, who resides at No. 18 Bashorun Street, off Unity Road, Olowotedo, Mowe, had pleaded not guilty to the charge.

Delivering his judgment, Justice Abiodun Akinyemi said evidence presented before the court by the prosecution was tenable and found the convict guilty as charged.

“Based on the evidence, I find and hold that the convict had sexual intercourse with the child and is guilty as charged,” Akinyemi said.

The judge sentenced Olalere to life imprisonment.

The Assistant Chief State Counsel, Mrs Oluyemisi Aruleba, had told the court during trial that the convict committed the offence on March 22, 2017, at No. 18 Bashorun Street, off Unity Road, Olowotedo area of Mowe.

According to her, the convict forcefully had sexual intercourse with the two-year-old girl.

Aruleba said the victim’s mother was living with the convict and helping his wife to sell foodstuffs and other items.

The prosecutor said, “The victim’s mother met her two-year-old daughter crying and noticed that she was not walking properly; she checked her daughter’s private parts and noticed that they were swollen.

“She took the child to the hospital, where it was confirmed that there was presence of sperm cells in her private parts and also revealed that the child had been sexually abused by the convict.”

The prosecution counsel said the offence contravened Section 32 of the Child Right Law of Ogun State, 2006.

JUDGMENT: Court Jails Fraudster 10 Years for N200 Million Fraud

Justice J. K.Dagat of the Federal High Court sitting in Kano, Kano State, on Wednesday, July21, 2020 convicted and sentenced Saad Ahmed Madaki to ten years imprisonment.

He was arraigned by the Kano Zonal office of the Economic and Financial Crimes Commission (EFCC) on one- count charge of obtaining money under false pretense.

Troubles came for the convict when he was arrested by the Kano State Joint Task Force, on an allegation that he was connected to terrorism. He was handed over to the Department of State Security Service but was later transferred to the EFCC when he could not be linked to terrorism in any way. However, further investigations showed that he defrauded and obtained the sum of Two Hundred Million Naira (N200,000,000.00) fraudulently from one Auwalu Abdulkadir, a retired Kano State Treasurer.

Upon arraignment on April 4, 2017, he pleaded not guilty to the charge against him which prompted the trial.

Prosecution Counsel, Douglas I. Gift, presented five witnesses and seven exhibits to the court to establish Madaki’s guilt.

Justice Dagat found him guilty as charged. He convicted and sentenced him to ten years imprisonment.

The Judge also ordered him to pay a sum of Two Hundred Million Naira he fraudulently obtained from the petitioner as restitution to the lawful owner.

Andrew Yakubu: Court To Rule On Admissibility Of Exhibit In October

The trial of Andrew Yakubu, former Group Managing Director of Nigerian National Petroleum Corporation (NNPC),  before Justice Ahmed Ramat Mohammed of Federal High Court, Abuja was on Wednesday, July 22, 2020, adjourned till October 14, 2020 for ruling on the admissibility of the testimony, which he gave as prosecution witness in a 2017 trial.

The testimony, presently identified as ‘Exhibit J,’ was given by Yakubu before Justice Nnamdi Dimgba of Federal High Court, Abuja in January 2017 where he stood as prosecution witness in a case where some NNPC officials and Atlantic Energy Brass Development Ltd stood trial for illegal crude oil lifting.

At Wednesday’s sitting, counsel to the Economic and Financial Crimes Commission (EFCC) M.S. Abubakar began with the cross-examination of the defendant, who was to testify on ‘Exhibit J’  as the first defence witness, but was opposed by the defence counsel, Ahmed Raji SAN, who objected to his client’s cross-examination on the exhibit.

To go on with the cross-examination, prosecution counsel argued that the exhibit was relevant in proving whether or not there was a predicate offence of money laundering in relation to count three and four of the charge,  as there was an increase in the defendant’s pecuniary resources which he cannot satisfactorily account for, and therefore urged the court to discountenance the objection and allow the cross-examination of the witness on contents in ‘Exhibit J’ to go on.

The defence counsel, however, told the court that the exhibit was irrelevant as it was tendered solely in respect of count-one and two which was struck out by the court, and that counts three and four, which were sustained by the court did not allege accruement of funds by the defendant. According to Raji, there must be a charge and proof of a predicate offence before a charge of money laundering can be meaningful, adding that the evidence the prosecution wanted to establish through cross examination on ‘Exhibit J’ was to prove an alleged predicate offence.

It could be recalled that Yakubu initially faced prosecution on six-count charges by the EFCC,  of which the court struck out counts one, two, five and six in a no- case submission by the defence, sustaining only counts three and four, which prompted the EFCC to approach the Supreme Court against the ruling, while the defence also approached the apex court on counts three and four, not struck out by the trial court.

The EFCC , on the strength of a whistleblower information,  raided Yakubu’s guest house, situated in Sabon Tasha slum of Kaduna State, and recovered the sums of $9.7 million and £74,000 hid by the defendant  in a fireproof safe.

Two Remanded, One Grants Bail For Allegedly Stealing Plastic Bottles In Osun

The Osun State Magistrate Court sitting in Osogbo on Wednesday remanded two men and granted one other bail for allegedly stealing Plastic Bottles.

According to the charge sheet, Hamzat Rasak (34), Adesina Rasheed (23), Yakubu Taoheed (37) were alleged of stealing some plastic bottles from the factory of Iyanu Plastic Valued Seventy-Two thousand naira (#72,000:00k) only, properties of Fidudusola Olusegun.

The Police Prosecutor, Inspector Adeoye Taiwo disclosed that the suspects committed the offences on 20th July, 2020 at Iyanu Plastic Factory, opposite Heritage Hotel, Estate Area, in Osogbo.

He argued that the offence contrary to section 383 and punishable under section 390(9) of the criminal Code Cap 34 Vol.II , Laws of Osun State, Nigeria.

When the two count charges of felony and stealing were read to the accused persons, the first and second accused person pleaded not guilty while the third accused person pleaded guilty.

The defense counsel for the first and second accused persons, Kehinde Adepoju and the defense counsel for the third accused person, Muftau Abiodun applied for their bail on a liberal term with the assurance of a liable sureties.

While ruling, the Chief magistrate, F.I Omisade thereby remanded the first and second accused persons at Ilesha correctional centre while the third accused person was admitted to bail with the sum of two hundred thousand naira (#200,000:00k) with two sureties in like sum.

He, however, adjourned the case till 27 August, 2020.

Oyo Government Releases School Reopening Exams Timetable

The Oyo State Government has approved the measures that would guide the resumption of schools and associated educational activities in the state.

This indication was given at the end of the State Executive Council meeting on Tuesday.

As a result, promotion for all affected classes would be determined by the first and second term continuous assessment results.

Primary 6, Junior Secondary School 3 and Senior Secondary School 3 students are to proceed on holiday from July 30 and resume for their examinations in some weeks’ time.

The Basic Education Certificate Examination is billed to hold between August 10 and 18, while the Competitive Entrance Examination into the schools of science is to hold on August 19.

Placement and screening test to JSS1 is slated for August 20, while placement test into technical colleges is for August 28.

The SSS 3 class will resume for examination as soon as the West African Examination Council announces the examination date.

The 2020/21 academic session, according to the calendar indicates that the first term will hold between September 21 and December 18, 2020.

FG Approves N75bn Youth Investment Fund

The Federal Government has approved the establishment of a N75bn youth investment fund.

The decision was taken at the virtual meeting of the Federal Executive Council presided over by the President, Major General Muhammadu Buhari (retd.), on Wednesday.

The Minister of Youths and Sports, Sunday Dare, disclosed this to State House Correspondents at the end of the council’s meeting.

The minister said the fund, which he described as “youth bank” was to support youth enterprise among Nigeria’s 68 million youths between ages of 18 and 35.

He said youths within this age group with genuine business ideas would pitch their ideas in any of the 125 microcredit banks across the country.

Qualified candidates, he said, would have access to the funds.

The minister said, “For the first time in the history of Nigeria, the Federal Executive Council today approved the establishment of the Nigerian Youth Investment Fund to the tune of N75bn.

“This fund is meant to create a special window for accessing credit facilities and financing on the part of our youths that will help to fund their ideas, innovations and also support their enterprise.

“The best way to call it is that for the first time, the country will have a youth bank. A fund that will cater specifically for our youths within the stipulated age band, which is going to be between 18 and 35 years.”

VIDEO: You’re A Small Boy In Lagos, Ngige Taunts Faleke

Chris Ngige, Minister of Labour and Productivity, has thrown a jibe at Abiodun James Faleke, Chairman of the House of Representatives Committee on Finance, describing the lawmaker as “a small boy in Lagos”.

Ngige taunted Faleke, the lawmaker representing ‎Ikeja Federal Constituency, during an investigative hearing by the House over the sack of top management and executive committee members of the Nigeria Social Insurance Trust Fund (NSITF).

The minister, who is a former senator, had questioned the level of questioning by the federal lawmakers over his decision to dismiss the NSITF management for allegedly misappropriating N48 billion.

In a remarkable exchange of barbs, Ngige told the lawmakers that he was older than all of them except for Faleke, who might be his age mate.

Faleke immediately responded, saying: “I am 60 plus.”

Ngige retorted, saying that he was seven years older than Faleke and age mate with Bola Ahmed Tinubu, a former Lagos State governor, who the former referred to as the latter’s political mentor.

But Faleke did not back down, shouting that Tinubu won his governorship election for two terms; an apparent dig at Ngige, whose 2003 Anambra governorship election victory was voided in 2005 and 2006 by the courts.

Ngige returned the favour and mocked Faleke for failing in his attempt to become Kogi State Governor, saying: “No problem about that. Just like you won your own in Kogi State very well.  And you are now the deputy governor and governor of Kogi State.”

He went further, describing himself as an elite Lagos boy who lives in the Victoria Island area of the state and Faleke as a “small boy” from Kogi State living in Mushin.

The minister said he will continue to throw jibes at the lawmaker, adding: “Look at this boy. Mushin boy is talking to a VI boy? I live in Victoria Island. Look at Mushin boy, from Kogi o!”
