[Blasphemy]: US agency kicks as Kano court jails 13-year-old boy for 10 years

0

THE United States Commission on International Religious Freedom has faulted the judgment of an Upper Sharia Court in Kano State sentencing a 13-year-old boy, Umar Farouq, to 10 years in prison for making derogatory statements toward Allah in an argument with a friend.

Farouq was convicted on August 10, 202o, by Aliyu Kanu, the same judge who sentenced a Musician, Yahaya Sharif-Aminu, to death for blaspheming Prophet Mohammed.

Baba-Jibo Ibrahim, spokesman for Kano Region Justice Ministry, said the court handed down the death sentence as enshrined in Islamic laws based on irrefutable evidence and the convict’s admission of guilt.

It was reported that although Farouq is a minor by Nigerian law and should not have been tried as an adult, Islamic canons regard anyone who has begun puberty as an adult.

Kano, a predominantly Muslim northern Nigerian state, has Islamic Sharia courts that function alongside civil courts and introduced Sharia law in 2000.

But the United States Commission on International Religious Freedom has condemned the blasphemy laws in Nigeria.

The USCIRF is an independent, bipartisan Federal Government entity established by the US Congress to monitor, analyse, and report threats to religious freedom abroad.

In a statement in reaction to the judgment, the US commission condemned the death sentence handed to Sharif-Aminu for allegedly insulting the Prophet Mohammed.

USCIRF Commissioner, Frederick Davie, stated, “It is unconscionable that Sharif-Aminu is facing a death sentence merely for expressing his beliefs artistically through music. The US Senate should work swiftly to pass Resolution 458, which calls for the global repeal of heresy, blasphemy, and apostasy laws.”

Also, the President of the African Bar Association, Mr Hannibal Uwaifo, described the verdict on Farouq as unconstitutional, calling on the Attorney General of the Federation to stop the Sharia court from making a mockery of Nigerian on the international scene.

Uwaifo said, “I call on the Attorney General of the Federation to step in and to stop this kind of sectional court from making mockery of Nigeria. This is a country where people are stealing billions of naira and being given a pat on the back; then you say someone committed blasphemy, according to your own religion, and then you sentence him to death or sentence a teenager to 10 years’ imprisonment. I think we should stop making a laughing stock.”

In the same vein, two civil society groups have condemned the Shari’a court verdict.

The Convener, Coalition in Defence of Democracy and Constitution, Ariyo-Dare Atoye, said, “What is coming out of Kano is a challenge to section 10 of the 1999 Constitution, as amended. We know that the current Attorney-General of the Federation, Abubakar Malami, is more or less not interested in the secularity of this country.

“What is going on in Kano is an attempt to restructure Nigeria through the back door to create a two-nation in one because the message they are sending to the international community is that there is a part of the country operating a different legal system.”

Speaking in the same vein, the National Coordinator, Human Rights Writers Association of Nigeria, Emmanuel Onwubiko, said the judjement did not conform with human rights conventions and treaties to which Nigeria was a signatory.

He stated, “Section 10 of the constitution prohibits the elevation of any religion as a state religion, so the Kano State government does not have the constitutional rights to legislate Islam as a state religion.”

JUST IN: Bayelsa Governor, Diri Speaks As Tribunal Orders Fresh Election

0

The Bayelsa State Governor, Mr Douye Diri, will appeal Monday’s ruling of the governorship election petition tribunal sitting in Abuja, which nullified his election.

The tribunal ruled that the Independent National Electoral Commission (INEC) wrongly excluded the Advanced Nigeria Democratic Party (ANDP) governorship candidate in the November 16, 2019 election.

Reacting through a statement by his acting Chief Press Secretary, Mr Daniel Alabrah, Diri said he has, consequently, instructed his lawyers to file the necessary papers.

He said he has implicit confidence in the judiciary that he would triumph in the end.

“We trust in the judiciary and we are appealing the judgement. With God on our side, we will get justice.

“This is a court of first instance and I have instructed our lawyers to file an appeal. We have a right of appeal even up to the Supreme Court,” he said.

Diri urged members of the Peoples Democratic Party (PDP) and his supporters not to panic and to continue to remain calm and law-abiding.

Tribunal annuls Bayelsa governorship election

0

The Bayelsa state governorship election tribunal sitting in Abuja has annulled the election of Duoye Diri, governor of Bayelsa state, Equity News can confirm.

King George, candidate of the Advanced Nigeria Democratic Party (ANDP), had asked the tribunal to cancel the election because he was excluded from the November 16, 2019 governorship poll.

On Saturday, a three-man panel of the tribunal had dismissed three petitions challenging the election on the grounds of incompetence and lacking merit

But while delivering judgment on another petition on Monday, the panel held that the election was unlawful due to the exclusion of ANDP and its candidate,.

Yunusa Musa, the judge who read the judgement, ordered the Independent National Electoral Commission (INEC) to conduct a fresh election in Bayelsa within 90 days.

Diri, candidate of the Peoples Democratic Party (PDP), was sworn in as governor after the supreme court sacked David Lyon as governor-elect 24 hours before his inauguration.

The apex court based its rulings on the premise that Biobarakuma Degi-Eremieoyo, running mate of the candidate of the All Progressive Congress (APC), presented forged certificates to the Independent National Electoral Commission (INEC).

INTERVIEW: We’ll focus on human capital development, image making – New Amir, MSSN Lagos

0

It was with an immense sense of fulfillment that the Muslim Students’ Society of Nigeria (MSSN), Lagos State Area Unit sworn in a new executive council led by Mallam Miftahudeen Thanni in a widely followed virtual electoral conference today, August 16, 2020.

This follows the expiration of the term of office of Dr Saheed Ashafa, the immediate past Amir of the most vibrant Muslim Students body in Nigeria, leaving a big void which was filled amid excitement and joy.

Today’s electoral conference which was monitored by Muslim News saw the emergence of Mallam Thanni as the new Amir, expected to mount the saddle and administer the affairs of the society for the next three years.

In an exclusive interview with Muslim News, Mallam Thanni said his new appointment is an amanah (trust) which he, and other members of the cabinet will account for on the day of judgement, praying to Allah to assist them in discharging their responsibilities creditably.

According to him, “Being an amir of this noble organisation is an herculean task. A tasking responsibility that I know I can’t do alone except with the support of my cabinet members. When we join hands together, Allah will make it an easy task for us. We didn’t crave for it; we didn’t contest or campaign to be elected. It was Allah that saddled us with it. It was Allah’s will which we accept in good faith. Allah will assist us.”

Commenting on his plans for the student faith-based organisation with the largest membership in Nigeria, Mallam Thanni, who has both first and second degrees in Political Science, stated that human capital development would be his priority, saying desired results can only be gotten when members are properly empowered.

He also believed that though the MSSN is doing better in the area of image-making, the best is yet to come, affirming that image-making will constitute his second top priority.

He said, “You know that we were only elected today (Sunday). I haven’t met with my cabinet members to discuss our agenda for the next three years. But I can assure you that, the first thing we should do, as a matter of urgency, is human capital development. When people are empowered, they will work assidously in achieving organisational goals.

“The second one is about image-making. MSSN is no small organisation in our society today. But we can still do better by promoting the brand better. Through this religious organisation, we can better the lot of all and sundry in the society — Muslims in particular. You shall get to know more about our agenda by the time we commence work in earnest.”

The Doctoral candidate in Political Science at Lagos State University also dreams of a Muslim students’ body where stakeholders in government at various levels would be partnered with and engaged to explore ways the organisation could be supported.

“We will also ensure that all the strata of the MSSN structure do the job they are supposed to do. For instance, MSSN, Lagos State Area Unit is going to engage the Lagos State government. MSSN at the area councils will interface with their respective chairmen. MSSN at the central branches will engage their councillors accordingly.

“At the zonal level, we have officials supervising the Amir. Each of these zonal officers will have cordial relationship with the senatorial representatives and those representing us at the House of Representatives. We will focus more on the government, on how to better the lot of our members and give back to the larger society.”

JUDGMENT: Industrial Court orders Local Government to pay ex-supervisory Councillor N4.8m Severance, Furniture allowance within 30 days

0

The Presiding Judge, Makurdi Judicial Division of the National Industrial Court, His Lordship, Hon. Justice Salisu Danjidda has ordered Etche Local Government Council to pay its former supervisory councillor, Hon. Emeka Mbonu the sum of N4,855,800.00 as severance/gratuity and furniture allowance within 30 days.

However, Justice Danjidda dismissed Hon. Emeka’s claim for arrears of salaries from June 2009 to March 2011 with interest for lack of evidence.

From facts, the Claimant’s- Hon. Emeka Mbonu had stated that he was appointed as Council Supervisor on 7th August 2008 that there was a shortage in the payment of his monthly salaries which he complained to the Council but nothing was done until his tenure lapsed in 2011. The Claimant felt aggrieved and asked the court for payment of his salaries, allowances and entitlements from August 2008 to May 2009 and from June 2009 to March 2011.

In defence, the Council postulated that Emeka’s appointment as Council Supervisor was terminated in May 2009 hence not entitled to any allowances or entitlements after May 2009 that what the Claimant is claiming as the shortage in his monthly salary from 2008 to 2009 is the statutory tax deductions.

In his contention, Council Counsel N.C. Okonkwo Esq opined as an afterthought on the part of the Claimant who wants to take advantage of the fact that he refused to collect his letter of termination and want to benefit from it by laying claims to salaries and allowances he never worked for, urged the court to hold so.

Counsel contended that the only debt the Council is owing the Claimant is furniture allowance of N2,427,900.00.

Claimant counsel Nwala I.A. Esq submitted that claimant has shown that his entitlements under the fringe benefits law were not paid to him all through his appointment from 2009 to 2011 and he was underpaid from August 2008 to 2009. Counsel argued that the Council acknowledged and promised to pay the debts but never paid even upon several demand letters urged the Court to grant the reliefs sought.

Delivering Judgment, the presiding Judge, Justice Salisu Danjidda held that the Claimant did not deem it fit to present the bank statement for the whole period of August 2008 to March 2011 to show how the deductions were made.

“In as much as there is no evidence of service of exhibit ELG01 (the purported letter of termination), the Claimant did not as much lead evidence to support his claim that he continued to work as a Supervisor beyond May 29, 2009.

“To prove entitlements, an employee must refer the court to the exact Law, instrument or document. And a claim for entitlements of salary or allowances is a claim for special damages which must be specifically pleaded and strictly proved with compelling evidence.

“From the foregoing, therefore, this court is bound by the established principles of law as regards the requirement of proof in civil matters especially for monetary claims, judicial decisions of superior courts and evidence presented. I, therefore, find that the Claimant has tilted the balance of probability in his favour only as regards his severance/gratuity and furniture allowances.”
