[UNILAG RAPE]: Man sentenced to 50 years in prison for rape

Justice Abiola Soladoye of the Lagos State Special Offences Court on Monday sentenced an alumnus of the University of Lagos, Akoka, John Osagie Otema, to 50 years’ imprisonment for raping a 19-year-old student of the institution.

Otema was arraigned before the court on three counts bordering on rape and assault occasioning harm contrary to sections 173 and 260 (1) (2) of the Criminal Law of Lagos State, 2015.

He allegedly had sexual intercourse with Student Y without her consent on January 31, 2018 at his home at No. 6, Ajileye Street, in the Bariga area of Lagos; and on January 17, he had unlawful sexual intercourse with Student X around DLI in UNILAG and also physically assaulted Student X by hitting her several times in the face and biting her back.

According to the prosecution, Otema had asked Student X for direction to Moremi Hall and compelled her to enter his car under the pretext of giving her a ride.

Upon entering the car, Otema, however, locked the car doors and drove to DLI, where he assaulted her by punching her in the face several times, biting her back, ordering her to undress and taking her nude photos.

During the trial, the prosecution called six witnesses, which included the two victims.

Delivering her judgment on Monday, Justice Soladoye found Otema guilty of raping and assaulting Student X, while she absolved him of the charge of raping Student Y.

Soladoye, who held that the testimony of Student Y was mischievous, noted that she would not have claimed that Otema raped her if he had paid her the N50,000 agreed upon.

She also held that in addition to the medical report and photographs, Student X, while giving her evidence, identified Otema as the person who bit her back and punched her eyes.

The judge said, “The defendant, John Osagie Otema, in respect of count one is found not guilty, as there is overwhelming evidence before the court that sexual intercourse between the defendant and PW2 (Student Y) was consensual, as it was friendship with benefits.

“For count two, the defendant is found guilty and is hereby sentenced to 50 years in prison as the evidence adduced before this court has been proved beyond any reasonable doubt by the prosecution.

“With regard to count three, the defendant is found guilty and is hereby sentenced to three years in prison, as the prosecution has done its job diligently by proving the charge beyond any reasonable doubt. The sentence will run concurrently.”

A Federal High Court on Tuesday, granted Abia based human rights Lawyer, Emperor Ogbonna, Esq. bail after being in incarceration since March, 2020.

This is sequel to an application filed before the Court by his counsel, Chief Mike Ozekhome SAN, and A. A. Malik SAN who prayed the court that he should be liberally admitted to bail.

Meanwhile, the Court presided over by Hon. Taiwo J. granted him bail on the following terms and conditions:

Production of 2 sureties with evidence of payment of tax and affidavit of means and a surety to commit to bond of 2 million naira and one surety to own verified landed property in FCT, Abuja.

It would be recalled he was earlier granted bail by a Federal High Court sitting at Umuahia, the state capital, on 29th day of April, 2020  but rearrested hours later by the DSS

In addition, DSS produced him for the first time in Court on Tuesday, 11th day of August, 2020.

Internet Fraud: EFCC Secures Conviction Of FBI Suspect

Justice Oluwatoyin Taiwo of the Lagos State Special Offences Court, Ikeja, has convicted and sentenced Abiona Akinyemi Festus to two years imprisonment for internet fraud.

The convict who was prosecuted by the Ilorin Zonal Office of the Economic and Financial Crimes Commission (EFCC) on a two-count charge of internet fraud was on wanted list of the Federal Bureau of Investigations of the United States Department of Justice.

The FBI,  in a petition dated July 10, 2019 had appealed to the Ilorin zonal office of the Commission to ensure Festus’ arrest and prosecution,  for his roles in multi-million naira international scam.

One of the charges read, “That you Abiona Akinyemi Festus (Ella Jones), sometime between January 2011- May 2016 at Lagos within the jurisdiction of this honourable court by means of fraudulent trick used the email address ellajones05@yahoo.com to bypass online security and obtained the sum of N5, 950, 000 (Five Million,  Nine Hundred and Fifty Thousand Naira), only from retirement accounts, held by an insurance company for public workers in the United States of America.”

Festus pleaded guilty to the charges, upon which the Head of Advance Fee Fraud, EFCC, Ilorin zonal office,  Olamide Sadiq,  reviewed the facts of the case, which included that defendant was arrested based on a petition from the FBI linking him to the offence.

Justice Taiwo convicted him as charged and sentenced him to one year imprisonment on each of the two counts with a N300, 000 option of fine on each of the counts.

The judge also ordered him to return the sums of money he cornered to the FBI.

BREAKING: Mali president, prime minister arrested

Mutineering soldiers in Mali on Tuesday detained President Ibrahim Boubacar Keita and Prime Minister Boubou Cisse, one of their leaders said.

“We can tell you that the president and the prime minister are under our control,” the leader, who requested anonymity, told AFP.

He added that the pair had been “arrested” at Keita’s residence in the capital Bamako.

Earlier, soldiers launched a mutiny from the nearby garrison town of Kati.

Another military official, who also declined to be named, said the president and prime minister were in an armoured vehicle en route to Kati.

Lawyer sues Lai Mohammed, NBC for hiking hate speech fine to N5m

Human rights lawyer, Inibehe Effiong, has sued the Minister of Information and Culture, Lai Mohammed; the Federal Government, and the National Broadcasting Commission for arbitrarily amending the Broadcast Code and hiking the fine for hate speech from N500,000 to N5m.

In the originating motion filed before a Federal High Court in Lagos, Effiong challenged the imposition of N5m fine on Nigeria Info 99.3FM Lagos and the threat by NBC to punish other broadcast stations in the country over alleged hate speech.

The suit comes barely days after the NBC fined Nigeria Info for granting an interview to a former Deputy Governor of the Central Bank of Nigeria, Dr. Obadiah Mailafia, who claimed that an unidentified northern governor was a Boko Haram commander.

The NBC had threatened that any TV or radio station that allows elected officials to be insulted on its platform would be fined N5m or shut down.

The NBC board had also alleged that Mohammed hijacked the responsibility of the NBC and unilaterally hiked the fine for hate speech without consultation.

Effiong in his supporting affidavit told the court that the actions of the NBC, the Minister of Information and the Federal Government had gravely affected his freedom of expression and that of broadcast stations, broadcasters and other Nigerian citizens who also appear as guests on radio and television stations to express critical views about the government and public officeholders.

The lawyer argued that “abusing” or “insulting” the government cannot be criminalised in a democracy.

He contended that the expression “hate speech” is not defined under any written law and cannot be invoked or penalized based on the capricious expectations of the Respondents.

He said that to do otherwise “will amount to setting fire to the constitution” and that “those who are paid with taxpayers’ money cannot be insulated or shielded from insults and abuse by those who pay them (the citizens)”.

The activist reminded the court that “Nigeria has passed the era of colonialism and military dictatorship”. He said that Lai Mohammed, NBC and the Federal Government were “seeking to subvert Nigeria’s constitutional democracy with the attendant liberties and foist a civilian dictatorship on the country.”

The lawyer, therefore, prayed the court to make “a declaration that broadcast stations in Nigeria, broadcasters, guests and callers during radio and television programmes are entitled to a fair trial before a court of competent jurisdiction as guaranteed by Section 36 of the Constitution of the Federal Republic of Nigeria, 1999 (as amended) and Article 7 of the African Charter on Human and Peoples’ Rights (Ratification and Enforcement) Act, Cap. A9 L.F.N. 2004 before a sentence of fine or other penalties can be imposed on them over comments, views or opinions expressed on radio and television”.

He further prayed the court to make an order of perpetual injunction restraining the NBC, the Minister of Information and the Federal Government from imposing fines or other penalties on broadcast stations in Nigeria for comments or opinions expressed by citizens during radio or television programmes.

The lawyer also asked the court to nullify and set aside the penalty of fine or other penalties imposed on broadcast stations by the NBC.

Effiong equally asked that the court should set aside the provisions of the extant National Broadcasting Code and any amendment made thereto, which purports to prohibit, criminalize or penalize comments or views expressed by citizens about the government and public office holders considered by the NBC, Lai Mohammed and the Federal Government to be “abusive”, “insulting” or “hate speech”.

Former Eagles Captain, Mikel, Joins Stoke City

Former Super Eagles captain, John Obi Mikel, has joined English Premier League side, Stoke City, after leaving Turkish side Trabzonspor by mutual consent in March.

The 33-year-old midfielder made 249 Premier League appearances for Chelsea in an 11-year spell, which ended when he left Stamford Bridge in 2017.

He won the Champions League and Europa League, two Premier Leagues, three FA Cups and the League Cup during his time with the London club.

Confirming his signing, Stoke City Manager, Michael O’Neill, said that Mikel’s experience was needed in the team following his trajectory of a glittering career with both club sides and the national team.

“We’re delighted to bring John to the Club. His playing career speaks for itself and underlines his caliber as a player.

“I was really impressed with him when we met for the first time and he outlined what he wants from the next phase of his career.

“We spent four hours talking and he made it clear he wants to get back into the Premier League and finish his career there and hopefully he can do that with Stoke City,” the manager told the club’s website.

“The Nigerian international midfielder joins Morgan Fox, James Chester and Steven Fletcher in checking in at the bet365 Stadium ahead of the 2020/21 Championship season,” a statement obtained via the club’s website stated.

EFCC Rearrest Mompha Over Money Laundering

The Economic and Financial Crimes Commission (EFCC) has rearrested Ismaila Mustapha, also known as Mompha.

He was rearrested on Friday at the commission’s Ikoyi office when he had gone to pick his five wristwatches, one Apple Air Pod, one iPhone 8 mobile phone and one pair of sunglasses, seized from him by the anti-graft agency.

His lawyer, Gboyega Oyewole, has told The Punch that he will challenge the rearrest in court.

“I am filing processes tomorrow (Tuesday); they didn’t tell us why they are detaining him. They have not told us the basis for this re-arrest. As far as we are concerned, the EFCC is seeking to overreach the court because this is coming after we filed our no-case submission to the charges.

“When they had the opportunity to amend their charges they didn’t and they are claiming that there is a new charge,” he was quoted to have said.

The medium also quoted Dele Oyewale, the spokesman of the anti-graft agency, as saying the rearrest is related to internet fraud and not money laundering, the previous case.

JUST IN: FG okays Lagos, Abuja for international flight resumption

The Federal Government has approved Lagos and Federal Capital Territory (FCT) Abuja airports for resumption of international flights in the country.

It said that the airports would be opened on 29th of August, 2020 and that protocols and procedures would be <span class=”e_604770573″>announced before approved date for resumption.</span>

The Minister of Aviation, Hadi Sirika, who made the announcement on Monday in a statement released on his official social media handle, stated that the two airports were chosen to ensure gradual reopening of international flights into and out of the country.

He said: “Glad to announce the resumption of international flights from the 29th of August, 2020. Beginning with Lagos and Abuja as we did with the domestic flight resumption. Protocols and procedures will be announced in due course. We thank you for your patience”.
