[US Election]: Biden officially accepts Democratic Nomination for President, vows to end America’s Season of Darkness

0

Former U.S. Vice President Joe Biden set the tone for his general election battle with Donald Trump by vowing to draw on the best the country has to offer and lead it out of its present “season of darkness”.

He spoke in Delaware as he formally accepted the Democratic presidential nomination at the first virtual convention, forced by the raging COVID-19 pandemic.

He vowed to heal a country battered by a deadly pandemic and an economic catastrophe by uniting all Americans, while warning that President Donald Trump would go on stoking hatred and fear if elected to another four-year term.

“Here and now, I give you my word: if you entrust me with the presidency, I’ll draw on the best of us, not the worst,” Biden said as he accepted the Democratic presidential nomination for an election 75 days away.

“I’ll be an ally of the light, not the darkness.”

The speech – the capstone of a nearly five-decade political career – was delivered inside an empty arena in his hometown of Wilmington, Delaware, at the conclusion of the four-day Democratic National Convention, which was held virtually because of the coronavirus pandemic.

The former U.S. senator and vice president described the current moment as one of historical import, amid a health crisis over the coronavirus, a recession, a national reckoning on race and a battle over the environment.

He promised to represent all Americans and to work “just as hard” for those who do not support him, drawing an implicit contrast with the Republican Trump, who has shown little inclination to appeal beyond his base of voters.

Biden also offered a withering assessment of his opponent’s response to the pandemic.

“Our current president has failed in his most basic duty to the nation: he has failed to protect us,” Biden said.

Several Democrats who challenged Biden for the nomination – U.S. Senators Bernie Sanders, Elizabeth Warren, Amy Klobuchar and Cory Booker; former U.S. Representative Beto O’Rourke; and entrepreneur Andrew Yang – praised Biden’s empathy and leadership in a taped conversation.

Another former rival, billionaire and former Republican Michael Bloomberg, said Trump had failed both as a businessman and as a president.

“I’m not asking you to vote against Donald Trump because he’s a bad guy. I’m urging you to vote against him because he’s done a bad job,” said Bloomberg, the former mayor of New York City.

“And let me tell you a little secret. Donald Trump’s economic plan was to give a huge tax cut to guys like me, who didn’t need it. And then lie about it to everyone else,” he said.

As they have throughout the week, Democrats emphasized the importance of voting amid the pandemic and warned against efforts to suppress the vote. Trump’s repeated, unsubstantiated claims that mail-in ballots are rife with fraud, coupled with cuts to the U.S. Postal Service, have fueled fears that some voters may be disenfranchised.

The Independent National Electoral Commission (INEC) has cleared Ondo State Governor, Rotimi Akeredolu, Peoples Democratic Party (PDP) candidate, Eyitayo Jegede, and 15 others for the forthcoming governorship election in the state.

Others were: Rotimi Akindejoye, Joshua Adewole, Adeleye Peter, Adelegan Oluwaseyi, Martin Olatuteru-Olagbegi, and Olowoloba Dele, among others.

Confirming eligibility of the candidates on Friday, INEC’s National Commissioner and Chairman of Information and Voter Education Committee, Festus Okoye, through a statement, noted that INEC had published the provisional list of candidates comprising 17 political parties for the governorship election in Ondo on July 31.

As gathered, the candidates were cleared after the weekly regular meeting of the electoral umpire held yesterday which deliberation was centered on conduct of the election scheduled for October 10 and other outstanding elections in the country.

He explained that in line with Section 35 of the Electoral Act, 2010 (as amended) and as provided in the Timetable and Schedule of Activities released February 6, withdrawal and substitution of candidates ended at 6 pm on August 18.

The INEC spokesman stated that the commission has published the final list of nominated candidates at its state and local government offices in Ondo and that the list was already its website and social media platforms.

”We have eliminated human interface with most of the electoral processes including submission of names of candidates by political parties including accreditation of relevant stakeholders and applications by ad-hoc staff ahead of the election.

“We don’t want anybody to jeopardise their health during the exercise as the commission will strive to perfect the electoral process within the ambit of the constitution.

“We have also resolved to avoid ugly experiences of the past not to deploy any of our staff and materials without armed security operatives.

“We have interfaced with heads of security agencies and implored them to ask their personnel to act professionally while on election duty.

“We are also using this medium to request you as media executives of your various organisations to similarly implore your reporters and cameramen to exercise restraint and as much as possible refrain from an altercation with security operatives while on election duty,” Okoye said.

JUDGMENT: Industrial Court awards N12m damages against NUC for Unlawful staff interdiction

0

His Lordship, Hon. Justice Oyebiola Oyewumi of the Abuja Judicial division of the National Industrial Court has nullified the fact-finding committee report of the National Universities Commission and letter of interdiction issued to Mr. Victor Uyo dated 30th August 2007 for breach of the Cooperative Society Act, lack of fair-hearing and the contract of employment.

The Court ordered NUC to pay Victor Uyo the sum of N12,478,612.89 being 50% salary for the period of his unlawful interdiction from 6th November 2006 to 31st December 2018 as general damages and N200,000 cost of action within 30 days.

From fact, the claimant’s- Victor Uyo had submitted that he was alleged of the misappropriation of the Co-operative fund that a panel and fact-finding committee was set up to look into the allegation and without giving him a fair hearing found him guilty and consequently placed on interdiction.

He pleaded that his interdiction was for twelve years rather than 3 months as per the Guidelines for appointment, promotion and discipline and as result, he lost promotions and annual increment.

He averred that the Registrar of Co-operative society constituted a panel and exonerated him of all allegations levelled against him but, the defendant failed to accede to the report, filed an application at the Federal High Court and the matter was transferred to the Industrial Court.

He stated that the Industrial Court declared the interdiction as unlawful and he resumed on the 24th of December, 2018. He stated that after his interdiction he was forcefully moved out of the defendant’s premises and his, training manuals and his procurement specialist practice manual were all thrown out of his office and destroyed on the order of the defendant, sought amongst other for an order for the payment of the sum of (Naira equivalent) US$ 30,000,00, US $ 10,668.00 and E 800.00 being fees for tuition/ practice manual cost, 4 weeks 28 days Estacode and return ticket for the repeat training and certification he did at the ILO International Training Centre, in Turin Italy.

In defence, the defendant submitted that the Chief Registrar of cooperative societies equally looked into the matter but his findings were rejected by the National Universities Commission Staff Cooperative Society and challenged in Court for the purpose of being quashed. It pleaded that the judgment was on appeal.

The defendant stated that the suit of the claimant is incompetent that the Court lacks jurisdiction to entertain same on the grounds that the Writ of Summons and the statement of facts were not affixed with a legal practitioner’s seal, and the suit is statute-barred by the Public Officers Protection Act, and Limitation Act.

In reply, counsel submitted that the claimant’s case clearly falls within the exception of the Public Officers Protection Act that if the defendant has not destroyed his career for over 13 years and lost about four to five promotion, he should have been at par with his colleagues who are now Deputy Directors and Directors. That based on this, he arrived at the cumulative sum of N21,129.839.00 for the entire period covered and urged the Court to so hold.

Delivering judgment, the presiding Judge, Justice Oyewumi held that no Court should rely on technicalities to shut out a party before it, that the claimants’ case is neither barred by the limitation Act or the Public Officers Protection Act, dismissed the objection for lacking merit.

“However from the document before the Court, the Appeal has not been entered as there is nothing to show that the Registrar of the Court from which the appeal emanates has forwarded to the Registrar of the appellate Court a compiled Record of this Court and there is no suit Number yet. The import of this is that there is as yet no competent appeal against the decision of Hon. Justice Agbakoba. Therefore, this Court can decide on this claim and will not tread on the jurisdiction of the Court of Appeal to adjudicate on that suit.

“One would have expected that the defendant if so interested in the Cooperative issue, to refer the matter to the Chief Registrar of Cooperative, the body responsible by law to investigate and if the claimant was reported to the management of the defendant by the Chief Registrar of Cooperative to have misappropriated its funds, that is when the defendant would have intervened by setting up an investigatory inquiry. Rather, the defendant acted ultra vires of its powers by taking over the powers/usurping the duties of the Registrar of Cooperative.

“From the circumstances of this suit, it is clear that the claimant’s right to fair hearing was utterly breached by the defendant vide all the reasons stated supra.

“I, however, find no evidence on record to substantiate the claimant’s claim for special damages of N21,129,839. There is dearth of evidence on record on the part of the claimant to substantiate his claim for the above sum.”

JUST IN: Minister Resigns After Breaching COVID-19 Rules

Ireland’s agriculture minister resigned on Friday for breaching government coronavirus guidelines by attending a parliamentary golf society dinner.

Prime minister Micheal Martin said he accepted Dara Calleary’s resignation after just 37 days in the position, calling it “the right decision” and an “error of judgement”.

“People all over the country have made very difficult, personal sacrifices in their family lives and in their businesses to comply with Covid regulations,” said Martin.

“This event should not have gone ahead in the manner it did given the government decision of last Tuesday.”

The event was held on Wednesday, the day after Ireland’s government announced new restrictions to curb the spread of the virus and a new surge in cases.

The Irish Examiner newspaper said Calleary was among 82 people at the Oireachtas (parliament) Golf Society’s 50th anniversary dinner held at a County Galway hotel.

EU trade commissioner Phil Hogan and swathes of other lawmakers and judges were also said to be in attendance.

Just 24 hours earlier, Martin’s government ordered a ban on events or parties at hotel restaurants, and that no more than six people should be seated at a single table when dining.

The Examiner said attendees sat in groups of 10 and the room was divided, to try to follow recommendations limiting diners to no more than 50.

Martin said Calleary acted “out of character” and the former minister apologised unreservedly in a statement on Twitter late on Thursday.

“In light of the updated public health guidance this week I should not have attended the event,” he added.

Calleary is the second politician to serve as agriculture minister in Ireland’s new government formed at the end of June.

His predecessor was sacked after controversy over a drink-driving ban.

In Britain, there has been public outrage that Prime Minister Boris Johnson’s most senior adviser, Dominic Cummings, kept his job despite flouting coronavirus restrictions.

Housing minister Robert Jenrick also escaped sanction for breaking lockdown rules but Scotland’s chief medical officer, Catherine Calderwood, was forced to quit for doing the same.

University professor Neil Ferguson also stepped down from advising the UK government after breaching stay-at-home rules.

The Nigerian Bar Association has withdrawn its invitation to Kaduna State Governor, Nasir el-Rufai, following protests from some lawyers.

The NBA said this in a tweet on Thursday via its Twitter handle @NigBarAssoc.

The tweet read, “The National Executive Committee of the Nigerian Bar Association at its ongoing meeting resolves that the invitation to the Kaduna State Governor, H.E. Nasir El-Rufai, by the 2020 Annual General Conference Planning committee be withdrawn and decision communicated to the Governor.”

A petition to stop the governor from attending the Annual General Conference which was started by a lawyer, Usani Odum, had garnered over 3,150 signatures on Change.Org as of 4 pm on Thursday.

In a separate letter titled, ‘Request to Withdraw the Offer of Platform at the 2020 Annual General Conference of the NBA to Mallam Nasir el-Rufai,’ addressed to the Chairman, Technical Committee on Conference Planning, NBA, Prof. Koyinsola Ajayi, some lawyers said the governor must not be allowed to speak at the conference.

The letter, which was signed by Silas Onu and Auta Nyada, listed 10 allegations against el-Rufai and his son, Bello, who is a Special Adviser to Kaduna Central lawmaker, Senator Uba Sani.

They faulted the NBA for inviting el-Rufai, citing his alleged poor human rights record and his inability to stop the killings, particularly in southern Kaduna.

The lawyers also referenced many controversial utterances of the governor, including a threat during the run-up to the general elections in 2019 that any foreigner that interfered in the poll would leave Nigeria in body bags.

The NBA virtual conference, which holds from August 24-26, 2020, is expected to have Vice-President Yemi Osinbajo and the Attorney-General of the Federation, Abubakar Malami (SAN), in attendance.

Others expected to speak at the event include former Governor Peter Obi of Anambra State, Governor Wike of Rivers State and a former Minister of Education, Oby Ezekwesili.

The theme of the conference is: ‘Am I a Nigerian – A Debate on National Identity, the Indigeneship-Citizenship Conundrum.’
