[Contract for Service] Industrial Court affirms Jurisdiction, orders NNPC to pay N2.8m within 30 days

Hon. Justice (Prof.) Elizabeth Oji of the Lagos Judicial Division of the National Industrial Court has declared the employment contract termination of one Abimbola trading under Bukky Joy-Bright Ventures from the service of Nigerian National Petroleum Corporation as wrongful.

The Court faulted the action of Nigerian National Petroleum Corporation in its relationship determination with Abimbola and the wrongful manner her contract was terminated in flagrant disregard of the renewal of contract.

The Court ordered the Nigerian National Petroleum Corporation to immediately pay Abimbola the accrued and unpaid salaries from January 2020 to June 2020, a period of six months, representing the unexpired period of the contract in the sum of One Million Eight Hundred and Thirty Thousand Naira; N500,000 (Five Hundred Thousand Naira) as general damages for wrongful employment termination and the sum of N500k cost of action within 30 days.

From facts, the claimant- Abimbola had submitted that she entered into an employment service contract agreement with the Nigerian National Petroleum Corporation for cleaning, gardening and waste disposal of the NNPC office and environment.

Abimbola averred that the purported letter of termination of her employment was done in bad faith and also not in accordance with the terms and conditions of service, and asserted that the NNPC is indebted to her in the sum of N3,660,000.00 being her unpaid and outstanding salary for twelve months from July 2019 till June 2020.

In defence, the defendant argued that the agreement between the NNPC and Bukky Joy-Bright Ventures was for “a contract for service” and not “a contract of service”, hence, Bukky Joy-Bright Ventures was never at any time whatsoever an employee, staff or worker of the NNPC, and no employer/employee relationship exists between Abimbola and the NNPC and urged the court to dismiss the case for lack of jurisdiction.

The learned counsel maintained that Nigerian National Petroleum Corporation was not indebted to Bukky Joy-Bright Ventures or Abimbola in anyway, and never violated any term and condition of service as it never engaged Abimbola as its employee or worker, that the NNPC was under no obligation to retain the services of Bukky Joy-Bright Ventures after the expiration of the contract.

In opposition, the learned counsel to Abimbola argued that a business name is not distinct from its owners and submitted that NNPC could not disprove the allegation that her employment was unlawfully terminated, and urged the Court to grant the reliefs sought.

In a well-considered judgment, the Presiding Judge, Justice Elizabeth Oji affirmed the jurisdiction of the Court and held that applying the primacy of facts there is an employment relationship between Abimbola (trading in the name of Bukky Joy-Bright Ventures that facts determine when a person is in a contract of employment or not, and not only the presentation of a contract document.

“The principle of primacy of facts in my view, is also consistent with the definition of contract of employment in section 91 of the Labour Act which recognised agreement, whether oral or written, express or implied, whereby one person agrees to employ another as a worker and that other person agrees to serve the employer as a worker.

“The implication of this definition is that it is the facts that determine when a person is in a contract of employment or not, and not only the presentation of a contract document.  Having had the benefit of considering the facts of this case, and applying the primacy of facts in this case, I find that there is an employment relationship between the Claimant (trading in the name of Bukky Joy-Bright Ventures.” Justice Oji ruled.

The court stated that the termination of service issued by NNPC did not purport to terminate Abimbola’s employment for falling below expectations.  Rather it purports to terminate Abimbola contract on the grounds of its expiration; which is not correct, as the contract was yet to expire by June 2020.

The ongoing Governor Douye Diri Pre-season Football Tournament in Yenagoa, capital city of Bayelsa State, on Wednesday produced another exciting moments in Group A, leading to a make or mar ties on the final group games scheduled for Friday, 16th.

Disappointed from their first game against Sunshine Stars of Akure where they lost by a lone goal, one of the host teams, Bayelsa United pulled out sterling performance to win two goals to one against hard-fighting and determined Abia Warriors.

Technical Adviser of the Prosperity Boys Ladan Bosso made several changes from the team that feature in the first group game, and the lads didn’t hesitate to announce their presence, winning a penalty as early as the third minute, whuch was beautifully converted by Bassey John.

With two minutes left, Ezekiel Ayodele took a bold run into the danger area, and after creating space for himself, shot a beautiful curve to the left corner beyond the reach of the goalkeeper to draw level in the first half.

Several scoring chances where created by both teams, especially from Abia Warriors as they battled hard to find another goal, but it was Bayelsa United’s winger, Rabiu Abdullahi who got the second goal with eight minutes left, leading to the first victory for the Ladan Bosso-tutored side.

The second game in Group A between Sunshine Stars of Akure against Akwa United saw the Owena Whales lost one goal to nil.

Sunshine Stars rued many scoring chances in the first half of the prosperity tournament at Samson Siasia Stadium in Yenagoa, however, succumbed to the only goal in the 54th minute. A counterattack play came the way of Mare Apson, and what was needed was a simple tap into the net.

Akwa United Coach, Baba Ganaru said he was proud of his boys, however the team was still a work in progress, adding that the last game will also experience some changes for other players to prove their worth.

Kenedy Boboye, Coach of Sunshine Stars, expressed displeasure in his players for their inability to convert their chances .

Sunshine Stars will on Friday trade tackles with Abia Warriors while Bayelsa United will confront Akwa United in a battle for top spot tie.

FG Starts Free CNG Conversion For Commercial Vehicles

The Federal Government has commenced the free conversion of petrol and diesel-powered commercial vehicles to compressed natural gas in a bid to cut the cost of transportation nationwide.

It started the exercise in Abuja and Lagos, urging commercial transport owners to key into the scheme by bringing their vehicles to be converted, stressing that the use of CNG would reduce the cost of transportation by over 40 per cent.

Officials of the Federal Ministry of Information and National Orientation, along with those from the Presidential Compressed Natural Gas Initiative, monitored the commencement of the exercise at the Federal Capital Territory, as transporters brought in their vehicles to be converted.

The Federal Government had earlier declared on Thursday that the conversion of petrol and diesel-powered commercial vehicles to run on compressed natural gas was going to be free of charge.

It made this public in Abujall after signing agreements with various companies involved in the conversion of petrol and diesel-powered vehicles to operate on CNG.

It said commercial transporters under their different unions, including the Road Transport Employers Association of Nigeria, the National Union of Road Transport Workers, and the and the Nigerian Association of Road Transport Owners, among others, would benefit from this.

The Programme Director/Chief Executive, Presidential Compressed Natural Gas Initiative, Michael Oluwagbemi, had disclosed this to journalists after the government agency signed agreements with various companies in Abuja.

Speaking at one of the conversion centres during the commencement of the exercise on Friday, the Sales and Business Development Manager, P-CNGI, Lara Ogunleye, said, “Today (Friday), we are at the NASENI Portland Conversion Centre where we have started the conversion for commercial vehicles. The first one that we have seen is from the e-hailing cabs that are part of the conversion scheme.

“The e-hailing cabs are supposed to pay a fraction of the cost of the conversion, while the transport associations have 100 per cent conversion free charge, and the cost of the kits is also 100 per cent free. Today we have started with the e-hailing cabs and the scheme is going to be done across the federation.

“We are starting with Abuja and Lagos. We will keep rolling it out and the announcements will be made as we keep moving to each of the states.”

On the number of cars to be converted nationwide, she said, “We intend to convert over a million cars within the first 12 months. So the conversion cost is free for transport associations, as well as the cost of kits.

“For e-hailing cabs, they are paying a fraction of the cost of the kits, and they are paying 100 per cent of the cost of conversion.”

She added that, “The fraction depends on the location. Right now, we are in Abuja, and they have their own fraction. For private individuals, the cost of conversion differs. It depends on the type of car and the size of the cylinder that goes into your vehicle. But it ranges from N700,000 to about N1.8m.”

Ogunleye urged transporters to take advantage of the offer, as this would help in crashing the cost of transportation across the country.

“So for transport owners across the federation, the cost of conversion is 100 per cent free for you.

“Please go to your transport associations, key in, and as we go to your locations, we will register you, take all your details, advise on the conversion centres that you can go to, present your vehicle, and get a free conversion. All of this is courtesy of the President,” she explained.

Speaking at another conversion centre in Abuja, Udechukwu Ejike, a Bolt driver, explained why he decided to convert his car from the use of petrol to CNG.

“I’m doing this because petrol is far higher in cost than CNG. For instance, in a day I buy petrol of about N25,000 to N30,000, but with CNG I’m to spend between N3,500 and N7,000. I’m happy with this initiative, and I advise everyone to consider converting their vehicles from petrol usage to CNG. It is very cheap and good,” he stated.

Other commercial transporters at the centres alluded to the position of Ejike as they expressed optimism that more of their colleagues would convert their vehicles and help reduce the cost of transportation across the country.

Karl Toriola, chief executive officer (CEO) of MTN Nigeria, says the country’s telecommunications sector is “in a deep crisis”.

Toriola spoke on Tuesday at the telecom investment forum organised by Financial Derivatives Company (FDC) in Lagos.

The telco CEO pointed out the severe sustainability challenges currently faced by telecom operators across the country.

He said despite the growth over the past two decades of liberalisation, the sector is now threatened by rising costs and unsustainable pricing.

Toriola said a price increase has become imperative, stressing that it is now an “absolute necessity”.

He said there is an urgent need to rescue the sector from collapse as it is “in an intensive care unit”.

Speaking on the viability of continued investment in the telecoms sector, Toriola said a fundamental challenge is that the financial returns expected from the industry are now “so low that they threaten its very survival”.

“Nobody is going to put in $1 with the expected return of 60 cents on the dollar,” he said.

Toriola, stressing the need for the sector’s revival, said without apt changes, the flow of new investment into the sector could dry up entirely.

He said the static pricing is no longer tenable.

There’s no way under the surface of the earth, in the kind of inflationary environment and forex devaluation that we’ve seen, that an industry can maintain prices the same for 11 years,” he said.

“The telecoms sector has faced escalating costs across the board — from the cost of capital to the soaring expenses of maintaining infrastructure like base stations and diesel generators.

Without adjustments to pricing, the industry’s ability to function and attract investment is in jeopardy.”

Although he acknowledged recent progress in discussions with regulatory authorities, Toriola said the challenges faced remain critical.

He said stakeholders are beginning to understand the depth of the crisis and are considering necessary interventions, including price increases and concessions.

Toriola said “qualitative action needs to be swift and decisive to prevent the collapse of this industry” as time is of the essence.

NNPCL, FIRS, 13 Others Frustrating NASS, Tinubu’s Government – Senate Panel

The Senate Committee on Public Accounts on Tuesday took a swipe at the top echelons of the Nigerian National Petroleum Company Limited (NNPCL), the Federal Inland Revenue Service (FIRS), the Nigeria Police Force and 12 others, saying they are frustrating the efforts of the National Assembly and President Bola Ahmed Tinubu at making Nigeria better.

The chairman of the committee, Senator Ahmed Wadada Aliyu (SDP, Nasarawa West), told newsmen in Abuja, that the heads of these agencies have consistently refused to respond to queries raised against them over the 2019 audit report.

Daily Trust reports that the committee commenced the consideration of the audit report in October 2023, with a view to presenting its final report to the Senate committee of whole, but some agencies of government have failed to respond to its demands.

Senator Wadada said going forward, any agency that refused to honour invitations of the committee would be reported to the Senate committee of whole during plenary for appropriate actions.

The lawmaker listed other agencies frustrating the Senate and Tinubu’s agenda for Nigeria to include the Office of the Accountant General of the Federation, Nigeria Mining Cadastre Office, Nigerian Upstream Petroleum Regulatory Commission (former DPR) and Federal Ministry of Industry, Trade & Investment.

Others are the FCT Internal Revenue Service, Nigeria Immigration Service, Federal Ministry of Women Affairs, Ministry of Defence and Nigeria Communications Satellite Limited among others.

He said, “The committee is not in doubt of the commitment of the present administration under the stewardship of His Excellency, President Bola Ahmed Tinubu to make Nigeria better. But with the attitude of the aforementioned chief executives, that will not be achievable unless and until we all do the needful.

“The committee is very displeased with the attitude of foot dragging by agencies that are by law, expected to respond to parliamentary invitations and account for their actions.”

…Commissioner for Youth Development Declares Tournament Open

The Governor Douye Diri pre season Football tournament kicked off on Monday in Yenagoa, the Bayelsa State capital ahead of the new Nigeria Premier Football League, NPFL season slated to commence on the 30th of August, 2024.

The pre-season tournament has in attendance seven NPFL teams comprising Rivers United, Abia Warriors, Bendel Insurance, host Bayelsa United, Sunshine Stars, Kwara United and a non league side Krusaders FC of Yenagoa.

In the first match of the day, Bendel Insurance beat Krusaders by a lone goal scored by substitute Chinedu Chukeujiekwe in the 65th minute from a defensive blunder.

Rivers United and Kwara United played out a barren draw in the second game leaving both teams with a one point apiece.

Sunshine Stars piped Bayelsa United 1-0 in the official kick off match. Ismail Ayodele’s lone goal gave Kennedy Boboye’s men the vital three points at the Samson Siasia Stadium.

In the last fixture of the day, Akwa United and Abia Warriors settled for a one all draw. Ezekiel Eddiong put the Promise Keepers ahead on 15 minute from a spot kick but the Abia Warriors side restored parity on 61 minutes from Sheddy’s sweet finish.

Declaring the tournament open, commissioner for Youth Development, Hon. Alfred Kemepado remarked that the tournament is in line with the Prosperity administration’s mantra of creating an enabling environment for the youths to thrive in their chosen careers.

According to him, the tourney is aimed at adding to the corporate value of the state, stating that he was elated to see Bayelsa hosting national competitions, describing the State as a centre of good things.

He noted that the tournament would provide the technical adviser of Bayelsa United, Ladan Bosso the opportunity to select his preferred team before the commencement of the league, pointing out that he was impressed with the quality of football he witnessed.

Chairman Central Organizing Committee, Mr Ono Akpe asserted that the standard of game he saw was beyond a pre-season game, stressing that all the teams gave a good account of themselves.

Mr. Akpe applauded the sports-loving duo of Governor Douye Diri and his deputy, Senator Lawrence Ewhrudjakpo for their immense support to the development of sports in the last five years.

He also commended the Commissioner for Sports Development, Dr Daniel Igali for translating the governor’s vision for sports in the state.

Tuesday is rest day, with the teams returning to action on Wednesday, when Abia Warriors will take on Bayelsa United in the first game at 8:30am while Sunshine Stars entertain Akwa United at 10:30am, Kwara United will slug it out with Krusaders FC at 2:30pm, while Bendel Insurance trade tackles with Rivers United at 4:30pm.

NDDC Refutes Allegations Of Fund Diversion For Political Campaigns

The Niger Delta Development Commission (NDDC) has firmly denied allegations that it is diverting funds meant for contractors to finance the Edo State Governorship Campaign of the All Progressive Congress (APC).

This was contained in a statement signed by Seledi Thompson-Wakama, NDDC Director of Corporate Affairs, on Monday.

The statement noted that the claims, which have been circulating online, are entirely baseless and originate from undisclosed sources.

The commission emphasized that it does not sponsor political parties or candidates contesting in any election. “Our mandate,” the statement stressed, “is to fast-track the development of the Niger Delta region.”

The commission explained that under the leadership of Chairman Chiedu Ebie and Managing Director Dr. Samuel Ogbuku, the NDDC is more committed than ever to its guiding principle of “Making a Difference” in the lives of the people of the Niger Delta.

The commission urged the public to disregard the false stories propagated by what it described as “mischief-makers” attempting to undermine the commission’s ongoing innovations.

In a move to enhance transparency and accountability, the NDDC noted that it has engaged KPMG, a globally recognized business consultancy, to review and strengthen its corporate governance systems, adding that this partnership has been instrumental in establishing a new institutional culture based on sound ethics and good governance.

The statement further mentioned that the commission recently held a meeting with the NDDC Advisory Committee, which includes governors from the nine Niger Delta states, to discuss and monitor the activities of the commission. This meeting is part of the NDDC’s broader efforts to collaborate with stakeholders and development partners to achieve a socially stable, economically prosperous, ecologically regenerative, and politically peaceful Niger Delta region.

Furthermore, the NDDC assured its stakeholders and the public that it remains focused on its mission and will not be distracted by unfounded accusations.
