Court Fines MTN Nigeria N840m For Trademark Offence

0

Justice Akintayo Aluko of the Federal High Court in Lagos has slammed a N840 million fine on MTN Nigeria Communications Limited for infringing on the registered trademark “WEBPLUS,” owned by Citilink Accesscorp Limited.

Justice Aluko, who imposed the fine while delivering judgment on a suit marked HC/L/CS/1124/2014 filed by Citilink, held that MTN’s use of “MTN WEBPLUS” or “MTN WEB+” unlawfully mimicked the plaintiff’s trademark.

The judge awarded N70 million yearly damages, covering Citilink’s loss of business and brand dilution from 2014 to 2025.

The court also ordered MTN to pay the applicant 15 per cent interest per annum on the judgment sum until it is fully paid.

Citilink Accesscorp Limited, in a suit filed on July 17, 2024, accused MTN Nigeria of infringing on its trademark “WEBPLUS,” which was legally registered in 2001 under Class 9 and renewed in 2014.

Citilink had argued that MTN’s use of “MTN WEBPLUS” and similar variants constituted unauthorised usage, misleading the public and damaging its brand.

The applicant joined the Registrar of Trademarks, Patent Designs, as a defendant, representing all entities involved in the production, marketing, and sale of the infringing services.

The applicant had urged the court for a declaration that Citilink Accesscorp Limited is the sole legal owner of the “WEBPLUS” trademark.

The applicant further asked the court for a perpetual injunction restraining MTN from further use of “WEBPLUS” in any form and an order preventing the Registrar of Trademarks from issuing any trademark rights to MTN under “WEBPLUS” or any variation of it.

“An order for seizure by the Bailiff of this Court for the destruction of all the servers of the first defendant which hosted, still hosts, used and still being used for transmitting information, messages, advertisement, marketing details of the first defendant’s MTN WEBPLUS to the general public.

“A demand for N1.5 billion in general damages for infringement and compensation for legal fees and expenses incurred.”

But MTN Nigeria challenged the court’s jurisdiction, arguing that a pending case at the Trademark Tribunal made the lawsuit invalid.

The company also claimed that its application for “MTN WEBPLUS” was made in 2012, when Citilink’s trademark registration had lapsed (between 2008 and 2014).

While stating that the applicant failed to prove trademark infringement, the telecommunications firm insisted that its use of “WEBPLUS” was an honest concurrent use, meaning it had no intention to deceive.

It further stated that the applicant lacked sufficient evidence to justify its financial claims.

In his ruling, Justice Aluko rejected MTN’s defence and upheld the applicant’s infringement claims.

However, the court denied some of the applicant’s additional demands, including the request for the seizure and destruction of MTN’s servers and a claim for N10 million in special damages due to insufficient proof.

Justice Aluko also granted a perpetual injunction against MTN, barring the telecom giant from further use of the disputed trademark.

PDP Governors Head For Supreme Court Over Rivers Emergency Rule

0

Governors under the Peoples Democratic Party (PDP) have instructed lawyers to file a suit against the president to challenge the declaration of emergency rule in Rivers state, TheCable understands.

The suit, to be filed at the supreme court this week, names the national assembly as the second defendant.

On March 18, President Bola Tinubu declared a state of emergency in the south-south state, citing the prolonged political crisis and vandalisation of oil installations.

The president suspended Siminalayi Fubara, governor of the state; Ngozi Odu, his deputy; and all house of assembly members for six months.

Tinubu also appointed Ibok-Ete Ibas, a retired vice-admiral, as the sole administrator for Rivers.

On Thursday, the senate and the house of representatives controversially approved Tinubu’s request for the emergency rule.

The PDP governors vowed to challenge the emergency rule in court at its virtual meeting on Wednesday.

PDP GOVERNORS GO TO SUPREME COURT

The suit will be initiated by PDP governors from Bauchi, Adamawa, Bayelsa, Enugu, Osun, Plateau, and Zamfara states, TheCable can report.

As already reported by TheCable, based on a previous ruling of the country’s highest court, Fubara is unable to join the suit because he would need authorisation from the current administration in Rivers — a clear impossibility as the administrator reports directly to the president who is being sued by the PDP governors.

They are praying the court to declare that based on the provisions of sections 1(2), 5(2), and 305 of the constitution “the President of the Federal Republic of Nigeria has no powers whatsoever or vires to suspend a democratically elected governor and deputy governor of a state in the federation of Nigeria under the guise of or pursuant to the proclamation of a state of emergency in the state of the federation by the president, including the states of the federation represented by the plaintiffs”.

They are also praying the court to declare that the president has no power to suspend a democratically elected house of assembly of a state pursuant to Sections 192 (4) (6) and 305 of the Constitution of the Federal Republic of Nigeria 1999 (as amended).

The plaintiffs also want the apex court to declare the suspension of Fubara, his deputy and members of the Rivers state assembly “unconstitutional, unlawful, illegal and utterly in gross violation of the provisions of the Constitution of the Federal Republic of Nigeria 1999 (as amended)…”

The governors are challenging the appointment of a sole administrator for the state, asserting that the president lacks the constitutional power to make such an appointment. Consequently, they seek the court’s ruling to nullify Ibok-Ete Ibas’ appointment as Rivers state’s sole administrator.

The plaintiffs argue that the defendant’s declaration of a state of emergency in Rivers State did not comply with the constitutional requirements set by Section 305 of the 1999 Constitution of the Federal Republic of Nigeria (as amended).

They assert that the proclamation failed to meet the stipulated conditions and procedures for such a declaration and was made for reasons beyond those specified in the said constitutional provision.

They further argue that the national assembly’s approval of the state of emergency via a voice vote is invalid, insisting that the constitution mandates a two-thirds majority vote from all members of each legislative chamber.

“An order of this honourable court nullifying the proclamation of a state of emergency in Rivers state made by the 1st defendant and wrongfully approved by the 2nd defendant,” the plaintiffs are further seeking.

“An order of this honourable court restraining the defendant, by himself, servants, agents and privies from implementing the unlawful suspension of the governor and deputy governor of Rivers state.

“An order of this honourable court restraining the defendant, by himself, servants, agents and privies from interfering in any manner whatsoever with the execution by the governor and deputy governor of Rivers state of their constitutional and statutory duties, as well as their electoral mandate.

“An order of this honourable court restraining the Defendant from attempting the suspension of any other governor of any state in Nigeria, particularly the plaintiffs and any governor not belonging to the ruling political party, or in any manner whatsoever attempting to interfere with or undermine their constitutional and statutory duties.”

It is unclear if the governors have the locus standi to institute the suit as none of them is affected by the state of emergency.

But insiders say they are determined to test the law “for the sake of posterity”.

Akintayo: Peter Obi ‘The Only Candidate Tinubu Fears’

0

As Nigerians look forward to the 2027 election, Stephen Akintayo, a prominent Nigerian entrepreneur said the only political candidate that President Bola Tinubu fears is Peter Obi, a Labour Party (LP) chieftain.

On Tuesday, March 18, 2025, Akintayo said that a combination of presidential hopeful Obi and Nasir El-Rufai, a former governor of Kaduna state, would give BAT as President Tinubu is fondly called ‘sleepless nights’.

Legit.ng reported that El-Rufai recently left the ruling All Progressives Congress (APC) and joined the Social Democratic Party (SDP).

The 65-year-old stated in a recent interview that the ruling party had abandoned its progressive ideals and accused the APC of straying from its original principles and transforming into a party driven by personal interests.

Since the former Kaduna State Governor joined the SDP, some prominent individuals have joined the 35-year-old party.

However, Akintayo expressed doubts about El-Rufai’s sincerity in the mission to democratically sack Tinubu in the next general election.

He wrote on his X handle: “The only political candidate that @officialABAT Fears is @PeterObi hence a combination of @PeterObi and @elrufai will give @officialABAT sleepless nights. The only problem with this combination is this? Can @elrufai be trusted? From the countless insults from him and his children to his personality. No 1 rule of power; Never outshine your boss! Can an @elrufai VIP refrain from outshining @PeterObi?”

Akintayo added: “Just thinking loud. I am yet to see a formula that will defeat @officialABAT in 2027. This @elrufai move looks like dividing northern votes to still help @officialABAT win. Chai! Again, just thinking loud.”

APC Applauds NASS Over Rivers Emergency Rule, Carpets Atiku, Others

0

The ruling All Progressives Congress (APC) has applauded the National Assembly for the swift approval of President Bola Tinubu’s Proclamation of a State of Emergency in Rivers State as constitutionally stipulated.

The party carpeted the Atiku Abubakar-led leaders and political stakeholders for condemning the presidential declaration, accusing them of seeking to exploit the situation in Rivers State to escalate tension in the country.

A statement in Abuja on Thursday by the APC National Publicity Secretary, Felix Morka praised the lawmakers for demonstrating high sense of patriotism by expeditiously approving the presidential declaration.

The statement reads: “Today, the 10th Assembly demonstrated patriotism by putting the interest of peace and security of the people of Rivers state first, and uniting in the national interest.

“In this regard, we particularly applaud the opposition caucus for rising above partisanship in support of the proclamation.”

Morka emphasised that the President is committed to ensuring peace, maintaining law and order, protecting critical national assets in Rivers state, and ultimately, restoring constitutional order in which all three arms of government – executive, legislature and judiciary – co-exist and perform their constitutionally assigned functions for the well-being and good governance of Rivers state.

Reacting to Abubakar-led opposition leaders’ condemnation of President Tinubu’s action, describing it unconstitutional, the APC spokesman advised Nigerians to ignore them, stressing that they had failed to do anything in the past to defuse the crisis.

Morka said: “We urge Nigerians to ignore roving opposition opportunists seeking to exploit the situation in Rivers state to escalate tension in the country.

“These opposition figures, including former Vice President Atiku Abubakar, former Anambra state Governor, Peter Obi and former Kaduna state Governor, Nasir El-Rufai stood idly by, did nothing to help defuse the crisis that had become a clear and present threat to peace, safety of lives and national assets in Rivers state.

“Today, these self-serving individuals did what they do best – issued a lengthy, convoluted and utterly meaningless statement intended to score their names on news headlines and drum up tension.

“We urge the good people of Rivers state and all well-meaning Nigerians to support President Tinubu in his effort to secure peace, protect lives and property, and eventually restoring effective constitutional governance in the state.”

Congo Offers Trump Minerals Deal In Exchange For Military Aid

0

Donald Trump has been offered a minerals-for-security deal by the Democratic Republic of Congo (DRC), providing access to materials needed by America’s tech industry in return for help to defeat M23 rebels.

Felix Tshisekedi, the DRC president, proposed the US leader gain access to cobalt, lithium, copper and tantalum for a “formal security pact” to help defeat the Rwandan-backed militia.

He told Fox News that a partnership would allow the DRC to extract and process its critical minerals to benefit US companies, while also building up the African country’s defences.

The rebels on Thursday were reported to have also taken the mining hub of Walikale in an area that contains gold mines and the world’s third largest mine for the tin ore cassiterite.

Mr Tshisekedi’s proposal has been seen as an appeal to Mr Trump’s America-first deal-making instincts when deciding foreign policy.

Mr Tshisekedi said: “I think that the US is able to use either pressure or sanctions to make sure that armed groups who are in the DRC can be kept at bay.”

M23 fighters have captured significant parts of the mineral-rich eastern DRC in recent months, including the cities of Goma and Bukavu.

Volodymyr Zelensky, Ukraine’s president, has already been in talks with Washington about offering up his country’s natural minerals to gain American protection as part of a possible ceasefire deal with Russia.

Marco Rubio, the US secretary of state, said that he had also discussed “working with Kazakhstan to deepen economic ties in the energy, telecommunications and critical minerals sectors” in a call with Murat Nurtleu, the country’s foreign minister.

In the DRC, Mr Tshisekedi wrote to Mr Trump last month offering mining opportunities for the new United States sovereign wealth fund, the Wall Street Journal reported.

The letter said: “Your election has ushered in the golden age for America.

“Our partnership would provide the US with a strategic advantage by securing critical minerals such as cobalt, lithium, copper and tantalum from the Democratic Republic of Congo.”

Such minerals are widely used in components and batteries for high-tech devices such as laptops, smartphones and electric vehicles, setting off a scramble between America and China to secure supplies.

Access to natural resources has become a key theme of Mr Trump’s foreign policy since his inauguration two months ago.

As well as discussions with Kyiv over minerals, US talks with Iraq have focused on resuming oil flows for US companies that have been blocked by a dispute between Baghdad, the Kurdish authorities and Turkey.

Mr Trump has also set his sights on Greenland, a Danish possession, largely because of its reserves of rare-earth minerals.

The letter gave no detail about what specific military backing the DRC wanted from Washington.

The M23 push has driven the Congolese army out of much of North and South Kivu provinces and refugees fleeing the area have said troops have often abandoned positions without a fight.

The DRC had attempted to bolster defences around Goma by employing Romanian mercenaries, but they failed to stop the fall of the city and were captured and later released to Rwanda.

Mr Tshisekedi is also reportedly in negotiations with Erik Prince, a Trump ally who founded the Blackwater military contractor company, to help the Congolese government collect and secure taxes from mining operations.

Discussions centre around Mr Prince helping the DRC crack down on fiscal evasion from mining producers and exporters, including by providing security for tax collectors.

Emergency Rule: Ijaw To Meet, Decide On Options For Self-determination – INC Pre

0

Tuesday’s declaration of a state of emergency in Rivers State by President Bola Tinubu has rekindled the quest for self-determination by the Ijaw ethnic nationality in the Niger Delta.

Prof Benjamin Okaba, president of Ijaw National Congress, INC, the Ijaw apex socio-cultural group, told Vanguard: “For Ijaw people, we are not too happy because we see this as another slap on us. But again, our position will be deliberated upon in a wider stakeholders’ meeting that will be convened later.

In that meeting, I am sure the Ijaw people will look at how we have fared in this Nigerian project and what options are left to drive home our quest for self-determination.

“We say it is hasty because the President has so much opportunity to leverage on the calls made by Nigerians from all quarters to call his minister, Nyesom Wike, to order.

Secondly, while Wike himself has been the antagonist, he had boldly stated that he would make governance impossible for the governor, Siminalayi Fubara, in as much as he does not dance to his tune.

“In a recent statement credited to him, he (Wike) said the two conditions he must meet are: ‘Allow him to control all the LGAs in Rivers State, and that he (Fubara) should sign an agreement that he would not contest in 2027.’

“So, the man, Wike, is desperate to capture state power and resources, as we had said earlier, and persistently. He wants to turn Rivers State into his property, and the people of Rivers State are the ones to suffer.

“The governor, who entered into a covenant with the people of Rivers to deliver on sustainable development, cannot mortgage that mandate because he wants to satisfy somebody.

“These are obvious facts flying all over the place, and I thought the President should have looked at all of these. I said it is lopsided—why will you leave Wike and sack Sim? The best thing is to remove everybody who played a role in this.

“Wike has to be sacked, and all the federal appointees from the state also have to be sacked because if you do not sack them, they will use their positions to perpetrate more crises and create more advantageous roles for themselves.

“The cry that they want to take over Rivers State is gradually playing out and is not better for democracy..

“The other issue in this state of emergency is that we have seen right from the beginning that the declaration was one of the options Wike was looking at. He felt if the judiciary cannot remove him quickly; if the House of Assembly could not take him off; then the next option is to create a chaotic situation so that an emergency can be imposed on the state.”

Tinubu prejudiced—Miakpor, retired Delta judge
Reacting, a retired president of Delta State Customary Court, Miakpor Emiaso, said: “I suppose it is an inevitable, yet, unfortunate imperative that we have found ourselves in Rivers State.

“Apart from a few underlying misgivings that I have, it was inevitable. I mean that something had to give way. The way the gladiators in Rivers State were going, we could not continue like that, ridiculing the entire government apparatus and even embarrassing the judiciary as a fallout.

“My misgivings are one; the president’s language declaring the state of emergency has some subtle political bias. If you noticed, the president never mentioned the name of the speaker in the broadcast, nor did he refer to the well-known external influence on the House of Assembly, which is the origin of this crisis.

“As it is now, the state of emergency seems to have given thumbs up for vaunting godfatherism because you could say that now that the president has gone this way, he has not mentioned the external influence, especially Wike, who is the origin of all these. This shows that he has a bias that he needs to cure.

“If the President wants to be viewed as fair, he should move Wike from where he is now; otherwise, Wike will not keep quiet. He will try to reach the administrator to influence him in one way or another.

“Again, I say that the six-month state of emergency is excessive. It is too long, especially when you drafted a retired military officer to run the state as an administrator.”

Ekiyor, ex-IYC president reacts

Similarly, former president of Ijaw Youth Council, IYC, Dr. Chris Ekyor, asserted: “The state of emergency came to me as a rude shock. It gives the impression that the president is answerable to his minister.

“Wike strategically orchestrated all the crises in Rivers State while the president watched. What are the contending issues of the Rivers State’s politics? The defection of 27 lawmakers, and what does the Electoral Act say about such a defection

“I’m concerned about how the judges ruled that the 27 members are legitimate members of the House after defecting and breaching the law. The real problem in Nigeria is the court delivering fair justice.

“If it had been done correctly, the current crisis in Rivers State would have been long resolved. Wike left the issues and threatened the entire Ijaw people over a mere disagreement with his candidate, who became governor of Rivers State. How does that concern the rest of the Ijaw people?

“He insulted Ijaw in Abuja at a media parley. Then he came to the heart of Ijaw land, shot at our women and children with tear gas, and further insulted us by asking, ‘How many dem dey?’
“We did not respond with violence to allow peace to reign, knowing that his goal was to cause the president to declare a state of emergency in Rivers State.

“President Tinubu rebelled against the former president, Olusegun Obasanjo, between 2003 and 2007, as the governor of Lagos State. No state of emergency was declared on him. Under President Yar’Adua, Atlas Cove was blown in 2009; no state of emergency in Lagos?

“How did the president conclude that Fubara is behind the explosions in Rivers State? Why does he not think it is those fighting him? Is there no Joint Task Force, JTF, securing the pipelines anymore? Why is the government spending heavily on pipeline security? Is there any breakdown of law and order in the state to warrant what the president did?’’

Nigeria needs devt, not power struggle — Olawepo-Hashim
Former presidential candidate, Dr. Gbenga Olawepo-Hashim, has called for a swift and peaceful resolution to the ongoing political crisis in Rivers State, warning that the people stand to gain nothing from the power tussle between the suspended Governor, Siminalayi Fubara, and the Minister of the Federal Capital Territory (FCT), Nelson Wike.

In a statement released by his media office in Abuja, Dr. Hashim expressed deep concern over the decision by President Bola Tinubu to declare a state of emergency in Rivers State on March 18, 2025. The declaration led to the suspension of Governor Fubara, his Deputy, Ngozi Odu, and all members of the Rivers State House of Assembly for six months. President Tinubu subsequently appointed Vice Admiral Ibokette Ibas (rtd) as the sole administrator to manage the state’s affairs during this period.

Dr. Hashim described the development as troubling, noting that political disagreements in Nigeria’s past were often driven by ideological differences and national interests rather than personal rivalries and ego battles.

“Political conflicts in the past were driven by ideological differences and national interest, not ego and power games. The current situation in Rivers State reflects a dangerous shift in Nigeria’s political culture that could undermine our democratic order,” Hashim stated.

He called on President Tinubu to exercise greater statesmanship and wisdom in resolving political conflicts to safeguard national stability.

“Nigeria is a multi-ethnic nation with complex fault lines and competing loyalties. Extreme measures like a state of emergency should be applied with caution and fairness to avoid further political and social instability,” he added

Dr. Hashim drew parallels between the Rivers crisis and previous instances where states of emergency were declared in Nigeria since the return to democracy in 1999. He referenced the state of emergency declared by former President Olusegun Obasanjo in Plateau State on May 18, 2004, when Governor Joshua Dariye and the State House of Assembly were suspended following violent clashes between Christian and Muslim communities that claimed over 2,000 lives. Similarly, in response to escalating insurgency and sectarian violence, former President Goodluck Jonathan declared a state of emergency in selected local government areas of Borno and Plateau States on December 31, 2011.

In a more extensive move, Jonathan imposed a state of emergency across the entire northeastern region of Borno, Yobe, and Adamawa States on May 14, 2013, due to the Boko Haram insurgency. However, Hashim noted that the Rivers crisis stands out because it marks the first time a state of emergency has been declared solely due to political infighting rather than large-scale violence or security threats.

Dr. Hashim welcomed the recent position taken by the House of Representatives regarding the supervision of the sole administrator appointed for Rivers State. The House rejected the proposal for the Federal Executive Council, FEC, to oversee the administrator’s actions, asserting that the National Assembly should have supervisory authority to ensure constitutional balance and accountability.

“The decision by the House of Representatives reinforces the principle of constitutional order and legislative oversight. The National Assembly, as the elected representatives of the Nigerian people, should rightfully oversee the actions of the administrator to uphold democratic accountability,” Hashim said.

The Rivers crisis has drawn strong reactions from political and legal stakeholders across the country.

In terms of numbers, no State in Nigeria comes close to what has been achieved in the Prosperity Cup.

Backed by his passion for youth empowerment and growth, Bayelsa State Governor, Douye Diri, has been intentional about the growth of the tournament.
The state is capitalizing on one of its strongest assets – a youth population available and ready to work on its football talents.

Backed by the passion of Diri, it has become the home of grassroots football in Nigeria.
No surprise it has been able to reach the height attained since the inaugural edition in 2015.

“The Prosperity Cup has given hope to the youths. Scouts have come to see raw talents”, he said at the closing ceremony of the 2024 edition.

Truth be told, what has taken place in Bayelsa State, under Diri’s leadership is nothing short of a revolution in the story of grassroot football in Nigeria.

According to him, “the crime rate in the state has reduced drastically as a result of the tournament that has continued to be the vehicle that has engaged the youths positively, stressing that he was pleased with the progress of the tournament after six editions”.

He added that the introduction of the women’s tournament would help to consolidate on the achievements recorded by Bayelsa Queens an promised that the prize money of the women’s tournament would improve in the next edition to further encourage women’s football.

Sustainability
Bayelsa is the only State in Nigeria that has built a sustainable grassroots tournament that is all inclusive.

To underscore its grassroots appeal, matches are played on 24 community fields spread across the state.

Interestingly, the private sector has since identified the Prosperity Cup as a viable investment for the communities and youths.
The importance of the commitment of youths across the state to the Prosperity Cup cannot be overemphasized.

It is a project that has been accepted by all and every year the number continues to increase.
Scouts have been able to identify talents who now play for clubs in Nigeria and Europe.
2025
No fewer than 231 male teams, 22 female teams and 4 para football teams have since registered for the competition.

Speaking on SuperSport’s NaijaMade, a programme dedicated to Nigerian football, on DStv, Director-General of the Prosperity Cup, Ono Akpe, revealed that the prize money for all categores have been increased.

He said: “The prize money has moved to N50million, thanks to our sponsors”.
Akpe added that no boost human capacity building amongst Coaches and Referees, programmes were organised ahead of the 2024 edition.

“A coaching programme that attracted 50 grassroots Coaches was organised. We are grateful to the Nigeria Football Federation for allowing its Technical Director, Austin Eguavoen, a former captain of the Super Eagles, to oversee the Coaching programme.

“In addition, 103 Referees, who will officiate in the Prosperity Cup, went through a refresher course”, Akpe stated.

Expect the best of grassroots football as Diri has provided the platform for the youths to be engaged positively as well as a vehicle to stimulate youth empowerment.
