Industrial Court orders Civil Defence, Correctional Services Board to reinstate Medical Doctor

0
The Presiding Judge, Lagos Judicial Division of the National Industrial Court, Hon. Justice Maureen Esowe has nullified the purported dismissal of Dr Hemeson Edwin from the Service of the Civil Defence, Correctional, Fire And Immigration Services Board.
Justice Esowe held that the allegations of gross misconduct against Dr Edwin contained in the suspension letter are different from those contained in the query letter which means that Dr Edwin was investigated, disciplined and dismissed for a different offence or misconduct an action that is against the Public Service Rules.

The Court ordered the reinstatement of Dr Edwin to office with payment of all his entitlements from the date of suspension 29th November 2019 till date.

From facts, the Claimant- Dr Hemeson Edwin, a medical doctor employed by the Civil Defence, Correctional, Fire And Immigration Services Board on 18th December 2001, and was deployed to different correctional service centres had submitted that he was placed on suspension, and subsequently issued a query letter on alleged misconduct and was later dismissed from the service of the board.

Dr Edwin averred that the disciplinary procedure adopted by the Civil Defence, Correctional, Fire And Immigration Services Board and the Controller General, Nigeria Correctional Services prior to his dismissal as well as his dismissal did not follow the Public Services Rules, and urged the court to grant the reliefs sought.

In defence, the 1st Defendant- the Civil Defence, Correctional, Fire And Immigration Services Board filed a Notice of Preliminary Objection seeking a dismissal of the suit on grounds that it was incompetent and the Court lacked jurisdiction to entertain same as it was statute barred.

However, the 2nd Defendant- the Controller General, Nigeria Correctional Services had in its abandoned pleadings averred that Dr. Edwin was suspended to give room for investigation and to prevent him from tampering with information or documents that could affect or alter the investigation which the court noted that such averments was not supported by evidence and therefore goes to no issue.

In opposition, Dr Edwin’s Counsel, P. O. Otaboh-Oboh, Esq contended that the Civil Defence, Correctional, Fire And Immigration Services Board acted outside the scope of their authority and without the semblance of legal justification of fair hearing before his client’s dismissal which is an exception to the protection conferred by the Public Officers Protection Act, and urged the court to dismiss the objection in its entirety.

In a well-considered judgment after a thorough evaluation of the submissions of both parties, the Presiding Judge, Justice Maureen Esowe held that a party fails or neglects to utilize the opportunity afforded it by the Court to put up its case, such party cannot later be heard to complain of denial of fair hearing.

The Court struck out Dr. Edwin’s claims against the Controller General, Nigeria Correctional Services for being statute barred in accordance with the Nigerian Correctional Service Act which provides a three-month window for instituting a case against the Nigerian Correctional Service or any of its officials.

However, Justice Maureen affirmed that Dr Edwin’s case is not statute-barred against the Civil Defence, Correctional, Fire and Immigration Services Board, and that the action falls within exceptions to the application of the Public Officers Protection Act.

Justice Esowe held that Dr Edwin was suspended on an allegation distinct and different from the allegations levelled against him in the query letter issued by the Nigerian Correctional Service.

The Court held that the Civil Defence, Correctional Fire And Immigration Services Board has not established a serious prima facie case against Dr Edwin to warrant his immediate suspension, and the allegations levelled against him as contained in the suspension letter were unsubstantiated.

“It is declared that the Claimant was not accorded a right to fair hearing by the Defendant in this matter as he was suspended before he was heard and his suspension and dismissal by the Defendants was null and void.”

Pressure Mounts On EFCC To Probe Officials Of Buhari Administration

0

Pressure is mounting on the Economic and Financial Crimes Commission (EFCC) to probe officials who served under former President Muhammadu Buhari.

The calls for the anti-graft commission to take action have been getting louder by the day.

The recent call is from a famous human rights lawyer, Pelumi Olajengbesi, who called for an extensive audit of financial transactions involving all officials who served under former President Muhammadu Buhari.

The appeal comes in the wake of revelations emerging from the trial of ex-Governor of the Central Bank of Nigeria (CBN), Godwin Emefiele, who is embroiled in a $6.2 million fraud case related to the last presidential poll.

Olajengbesi commended the EFCC for exposing the alleged forgery of Buhari’s signature and that of ex-Secretary General of the Federation, Boss Mustapha, in connection with the fraud case.

The human rights lawyer emphasized the need to curb the audacity of those in power and address their criminal influence.

He urged the EFCC not to limit its investigations to Emefiele but to extend it to all principal actors who served under the Buhari administration.

Olajengbesi stressed the importance of establishing deterrents for such behaviour and called for a thorough audit to ensure transparency and accountability.

His words: “The EFCC must not stop at just the former CBN Governor Godwin Emefiele but should carry out an entire audit of principal actors who served under the administration of former President Muhammadu Buhari. There should be a deterrent for bad behaviour.

“Again, the case of the suspended Managing Director/Chief Executive Officer of the Rural Electrification Agency, Ahmad Salihijo, over alleged N1.2bn fraud is fresh and a pointer to the gross abuse of power by those who served under Buhari.

“Emefiele and all those who served under the Buhari administration should be properly audited and given a chance to clear their names as the corruption that manifested under that government is gargantuan.”

Reps Demand Rescue Of 200 Abducted Borno Women

0

The House of Representatives, on Thursday, urged security agencies to rescue about 200 women reportedly kidnapped by Boko Haram terrorists in the Gamboru-Ngala and Dikwa local government areas of Borno State.

The women, who were Internally Displaced Persons, were said to have been kidnapped while they went into the bush in search of firewood.

While residents put the number of the abducted women at about 101, the

United Nations, on Wednesday, said it believed the figure was over 200.

“The exact number of people abducted remains unknown but is estimated at over 200 people,” Ann Weru, Head of Public Information, Office of the Coordination of Humanitarian Affairs of the UN in Nigeria, said in a statement.

Moving a motion on a matter of urgent public importance on the floor of the House on Thursday, the lawmaker representing Bama/Ngala/Kalabalge Federal Constituency of Borno State, Zainab Gimba, described the abduction as worrisome, liking it with the April 2014 abduction of school girls in Chibok.

She said, “I want to bring to the notice of the House that about 300 women were abducted while fetching firewood for domestic and commercial purposes in my constituency.

“I am calling on security agencies to, as a matter of urgency, see to the rescue of these women who went in search of their daily bread.

“The House notes that this is the second biggest number of abductions after the Chibok girls abduction that took place in 2014 even though, some of those girls are still in captivity.”

In his remarks, the Deputy Speaker, Benjamin Kalu, who presided over the plenary session, described the incident as a sad development and called on security agents to step up their search for the abducted women.

“We, as a House, are pained that the families of the abducted persons are going through what they are going through at the moment

“In the spirit of the International Women’s Day Celebration tomorrow (Friday), we pray that these women and those still in captivity be freed from their abductors.

“There is no better way to celebrate the
Women’s Day without calling for the protection and release of these women,” Kalu said.

Following the resolution of the House, the motion was referred to the Committee on Defence and National Emergency Management Agency.

The 7 Division Nigerian Army spokesman, Lt. Col. Ajemusu Jingina, told The PUNCH on Wednesday that the troops had begun a search for the abducted women.

“Troops have already been dispersed to far into the wilderness in search and rescue operations; the air component of the troops are also hovering around the wilderness for the search and rescue,” Jingina said.

“Times without number, we have warned the IDPs never to go out of the sight of security agents but they would never heed.

“Last Sunday, in the typical obstinacy of IDPs, these guys strayed out to as far as 25 kilometres from Ngala just to collect firewood; they were already in danger of any attack by the terrorists,” Jingina told The PUNCH angrily.

Ogun State Governor, Prince Dapo Abiodun has disclosed that over 500 surgeries have been performed on patients under his administration’s Free Surgical Intervention Programme in the last one week.

Governor Abiodun made the disclosure when he received the Committee of Chief Medical Directors and Medical Directors of Federal Tertiary Hospitals in Nigeria who paid him a courtesy call in his office at Oke-Mosan, Abeokuta on Thursday.

The governor said the free surgery programme was designed to provide succour to the poor and vulnerable who could not afford medical bills at this difficult time.

He said his government has also done a lot to improve the healthcare sector in the Gateway State since 2019.

Prince Abiodun said: “We have also implemented our Health Insurance Programme called Ilera Dero and the Ibidero for the women. As of now, because of the prevalent economic situation, we have decided that all our women and children, the poor and vulnerable should go to our Primary Healthcare Centres and secondary or tertiary hospitals in the state. We will register them under our Free Health Insurance Programme.

“Our pregnant women, when they go to the hospital, they get free pre and post-natal attention. After they put to bed, they also get N10,000.”

Governor Abiodun disclosed that the state is creating a database that would track a family or community, and the kind of disease prevalent among them as well as compiling records at the grassroots that would enable the government to predict predominant diseases that are in the family, community or area and treat them appropriately.

Speaking on the situation at the 250-bed hospital located at Oke-Mosan, Abeokuta, the governor noted that his administration is collaborating with a partner, as part of its medical architecture, to run and make it a centre of medical excellence, to engender medical tourism in the country.

Prince Abiodun noted that medical institutions in the state are wearing new looks as his government has employed a large number of medical personnel and purchased new equipment to make them render quality service to the people.

The state helmsman described the relationship between the state’s Ministry of Health and the Federal Medical Centre, Abeokuta, as cordial.

“We do not see the difference between the FMC, Abeokuta, and our own Olabisi Onabanjo University Teaching Hospital (OOUTH), because when there is a problem, we rush the patient to the nearest available medical facility. This has, over the years, helped us in dealing with difficult situations,” he added.

He commended the Committee for initiating the meeting, noting that it would help them review each other’s research, development, and new techniques that could be of assistance in dealing with different types of illnesses and diseases.

Speaking earlier, chairman of the Committee and Chief Medical Director, University of Uyo Teaching Hospital, Uyo, Prof Emem Bassey, commended Governor Abiodun for investing in the health sector, emphasizing that the increased funding, recruitment of different categories of health workers and renovation of over 100 Primary Healthcare Centres across the state, was worthy of note.

FG Begins Construction Of 700 Km Lagos-Calabar Coastal Road

0

The Federal Government has announced the commencement of construction work on the 700km Lagos-Calabar Coastal Highway, spanning 9 States with two spurs leading to the Northern States.

Minister of Works, Engr. David Umahi, announced this during the official handover of the first phase of the project, made up of 47.47 kilometers dual carriageway, to Hitech Construction Company Ltd, and which is to be constructed in concrete pavement.

This was contained in a statement issued by the Special Adviser (Media), to the Minister, Hon. Orji Uchenna Orji, in Abuja, late on Thursday.

According to him, the Minister who was in company with the Federal Ministry of Works’ Controller in charge of Lagos State, Engr. (Mrs) O. I. Kesha, emphasised the need for all contractors handling Federal Government’s road projects to deliver within a record time, noting that the government would not allow variation arising from delays or slow pace of work once mobilization had been done.

Orji quoted the minister as commending Hitech Construction Company Nigeria Ltd for being reputable for quality and speedy delivery of jobs.

The minister he said, acknowledged their efforts in starting work immediately after the contract was awarded.

He quoted Umahi as saying,”They have completed some filling of 1.3 kilometer from the day the project was awarded to them. It shows the speed they are going to deploy to this project.

“Within a couple of weeks, we awarded the project to them, they mobilized a lot of dredging equipment, and you can see that they have recovered 1.3 kilometer of section one of the phase.”

Orji said the Minister who also visited project sites at the Queen’s Drive Ikoyi, the Third Mainland bridge top deck, the under water, the Eddo bridge, the Eko bridge and Carter bridge expressed the determination of the Federal Government to carry out a comprehensive rehabilitation of the bridges which he said are critical links between the Mainland and the Island of Lagos, the economic hub of the country.

Quoting the minister further, statement read, “These repairs are expected to cover not only the top of the bridge but also the under bridge works.

“At the Third Mainland bridge, we have three or four critical elements to be rehabilitated. The first one is the deck, and the deck is about 11 kilometers two. That is dual carriageway, including the ramps, and it has been done by CCECC.

“They have done very beautiful jobs, but we have not concluded. Before the end of March, we’ll be concluding the asphalt milling and the reasphalting.

Umahi added , “But that is not all our commitment there. We are installing the guardrails, we are replacing the lights with solar light, we are going to put some decorative lights too, and then we are going to put CCTV camera both on top and under the bridge to check insecurity and illegal mining of sand, which is causing scouring on the piles and the pipe bits.

“The second job is that some sections of the slab are deflected, and so what we have done is to get an expert to understudy the level of deflection.

“That’s the tendons of the slab that deflected. And so we are going to cut open the slabs, enter and then look at it, scoop it, and then reinstate the tendons of the slab. There’s nothing to worry about. It’s been done at a Eko bridge by Buildwell. So this one is not a threat to us at all.”

The minister also commended what Julius Berger Nigeria Ltd is already doing, which is restoration of deteriorated peirs and peir caps including the cover of peirs and peircaps themselves, and said the piles which he also inspected were the most critical of the works to be done.

Earlier in their respective remarks, the State Controller, Federal Ministry of Works and the representatives of Hitech Construction Nigeria Ltd, Julius Bergger Nigeria Ltd, China Civil Engineering Construction Corporation Ltd, and. Buildwell Nigeria Ltd assured the Honourable Minister that they would continue to work in line with the spirit of excellence, which the Renewed Hope administration of *His Excellency President Asiwaju Bola Ahmed Tinubu is known for.
