Abuja Lawyer, Tunde Adejumo demands information on Corruption allegation on Judiciary from Bureau of Statistics

0

Foremost Abuja Lawyer and a Partner at Glaziers Chambers, Barrister Tunde Adejumo has demanded the names and particulars of the Judges and Magistrates involved in the allegation of Bribery and Corruption pursuant to the Freedom of Information Act from the Nigerian Bureau of Statistics.

It would be recalled that the People’s Gazette published a report where the Nigeria Bureau of Statistics (NBS), in its corruption pattern and trend in Nigeria for 2023, ranked judges as first among collectors of cash bribes among other public officials.

Barrister Adejumo expressed that he was troubled about the report published by the Nigerian Bureau of Statistics on the allegation of corruption in the judiciary as the biggest cash bribes in Nigeria.

The legal expert warned the NBS that failure to accede to his request would cast serious doubts on the report’s credibility and further undermine public trust. Barr. Adejumo urged the NBS to comply with his request within the stipulated statutory time frame and promised to seek an order from the Court to compel the release of the said information.

[Jurisdiction] Industrial Court dismisses case against NURTW

0

Hon. Justice Muhammed Hamza of the Portharcourt Judicial Division of the National Industrial Court has dismissed the case filed by Rivers Drivers Transport Co-operative Union Limited and 2 others, suing for themselves and all the Members of the Co-operative against National Union of Road Transport Workers (NURTW) Elelenwo Branch and 6 others for lack of jurisdiction.

Justice Hanza held that an attempt made by the Rivers Drivers Transport Co-operative Union Limited and 2 others that the genesis of the matter had occurred at a workplace can only be construed when the parties are subject to the jurisdiction of the Court and not where one of the party is not so registered by the Law.

From facts, the Claimants- Rivers Drivers Transport Co-operative Union Limited and 2 others had asked for a determination whether by virtue of Section 40 of the Constitution of the Federal Republic of Nigeria 1999 as amended the association and their members have the right(s) to form their own Association and operate freely in Nigeria without interference from the National Union of Road Transport Workers (NURTW) Elelenwo Branch and 6 others?

The association also sought a Declaration that the NURTW Elelenwo Branch and 6 others do not have the right to force Co-operative and their members to belong to their own association and purchase their tickets.

Likewise, the sum of N10,000,000.00 (Ten Million Naira) only being general damages for losses incurred as a result of seizure and impoundment of their six (6) tricycles (Keke) by the Defendants and obstruction of the smooth running of their business amongst others.

In defence, the 7th defendant- submitted that the Court lacked the jurisdiction to determine the case on the ground that Rivers Drivers Transport Co-operative Union Limited who are not trade Unions cannot maintain an action against the NURTW (a registered Trade Union).

The learned counsel to the 7th defendant-HRH EZE SUNNY WELICHUKWU averred that Rivers Drivers Transport Co-operative Union Limited and 2 others are mere ordinary members of an Association/Co-operative Society and lack the locus to institute an action against the NURTW and urged the Court to dismiss the case in its entirety.

In opposition, the learned counsel to Rivers Drivers Transport Co-operative Union Limited and 2 others maintained that the Court has jurisdiction to entertain the Suit as issues that led to the institution of the case had to do with contention over a workplace, urged the Court to dismiss the Preliminary Objection in the interest of justice.

Delivering judgment after careful evaluation of the submission of both parties, the Presiding Judge, Justice Muhammed Hamza held that the Rivers Drivers Transport Co-operative Union Limited and 2 others are not a registered Trade Union but a Co-operative Society or Association.

Justice Musa stated that where a statute ousts the jurisdiction of the Court; the language of such statute must be construed rather strictly, but once it is crystal clear that the facts of a particular case come squarely within the four corners of the cold embrace of the ouster statute, the hand of the Court are tied and has no alternative except to hold that it lacks jurisdiction.

The Presiding Judge held that an attempt made by the Rivers Drivers Transport Co-operative Union Limited and 2 others to show to the Court that the genesis of the matter had occurred at a workplace only be construed when the parties are subject to the jurisdiction of the Court and not where one of the party is not so registered by the Law.

“However, notwithstanding the position stated above, that does not preclude the right of the Co-operative Society to file suit before this Court in case of intra dispute e.g. non-payment of salaries to an officer(s) of the Society.” The Court ruled.

Bayelsa Governor’s Football Tournament: COC Wields The Big Stick On KRUSADERS FEEDERS FC And AGBERE FC

0

In a move defined by the need to sanitize and uphold the integrity of the tournament, the Central Working Committee (COC) called for a joint session with the Disciplinary and Appeals Committees to deliberate on the protests and counter allegations following the Round of 16 match between Krusaders Feeders FC and Agbere FC.

Krusaders Feeders FC had earlier levelled a protest against Agbere FC who won their R16 match claiming Douyibo Iworiso Peace was ineligible to play for Agbere FC having played in the Nigerian National League with Henserd FC in the 2022/23 season. The Disciplinary Committee found the claims viable and disqualified Agbere FC forthwith. However in an appealed filed by Agbere FC they also levelled a counter allegation against Krusaders Feeders FC for featuring Surveyor Handsome in the game who also played for Henserd FC in the same 2022/23 season as Douyibo Iworiso did.

In a statement signed by DG of the Prosperity Cup Mr Ono K. Akpe, the Appeals Committee also met and upheld the decision of the Disciplinary Committee having gone further to secure the license of the said player: Douyibo Iworiso Peace. However following the counter allegations leveled against Krusaders Feeders FC by Agbere FC the matter had to be referred to the COC.

Following these developments the COC quickly swung into action and after due consultations and extensive deliberations determined that both Krusaders Feeders FC and Agbere FC were no longer worthy of a place in the tournament and disqualified both teams from further participation in the tournament. The COC has hinged itsdecision and actions based on the provisions of Article VIII Sub Rules 6,7,8,9 and 10) of the Rules and Regulations Governing the Bayelsa Governor’s Football Tournament aka Prosperity Cup to wit:

6. Any team that uses an ineligible player in a match shall be disqualified and the match will be awarded to the opposing team.

7. A player that has participated in Nigeria National League (NNL) or Premier League (NPFL) is not allowed to play in the championship.

8. Any amateur (NLO) player that is registered in the current season is not eligible to play.

9. Any player that has played professional or amateur football outside the country is not allowed to play.

10. Any team that violates the above rules shall be automatically disqualified.

Based on the above and premised on Article XXV given the counter allegations by Agbere FC the COC deemed it appropriate to step in and take control of the situation. The actions of the COC are without prejudice but purely based on the need to clean the tournament of all violations as it comes to the notice of the Organizers. The Bayelsa Governor’s Football Tournament aka Prosperity Cup remains the most glamorous and largest grassroots football competition in Nigeria and beyond and everything possible within the armpits of the law to keep it so will be done at all points in time.

The COC hereby warns any team involved in such acts to think twice as no team will be spared the rod of sanctions even on the eve of the final match. Coaches and supporters of teams so penalized are also warned to stop disparaging the integrity of the tournament as severe sanctions will be imposed on such persons.

The COC looks forward to a successful grand finale of the tournament on the 20th of July, 2024 and wishes the best team victory.

President Tinubu Reaffirms Commitment To Niger Delta Development

0

President Bola Ahmed Tinubu has reaffirmed the commitment of his administration to correct the years of neglect of the Niger Delta region through the Renewed Hope Agenda.

Speaking at the Niger Delta Stakeholders Summit 2024 held in Port Harcourt, the President, who was represented by the Senate President, Chief Godswill Akpabio, said that the summit with the theme: “Renewed Hope for Sustainable Development of the Niger Delta Region,” marked a turning point.

He said: “This administration brings renewed hope and prosperity and I believe this is the season we have been waiting for. It is our time to shine. To achieve lasting solutions, we must overcome disunity. Unity among the people of the Niger Delta and the entire nation is not just a choice but a necessity. Through our shared vision, we can overcome the obstacles before us.”

“Mr. President is deeply committed to the development of the Niger Delta. The East-West Road will be a priority. The National Assembly, fully represented here today, will do everything in its power to ensure the completion of this crucial road.

Additionally, the Lagos-Calabar Coastal Road project will not only commence from Lagos but will also start simultaneously from the Niger Delta, ensuring both ends meet to complete the project.”

“The Niger Delta can sustain itself with its agricultural resources, especially in rice production and fish farming. By focusing on rice production, we can ensure that the Niger Delta not only meets its own needs but also contributes to the nation’s food supply. We should not be solely defined by our oil reserves, but also by our agricultural achievements.

The Senate President gave kudos to the NDDC Board and Management for delivering impactful projects in the Niger Delta region, citing the commissioning of the 25.7 km Ogbia-Emakalakala-Akipelai-Etiama-Nembe Road with seven bridges and the 132KV Transmission Line and I32KV/33KV electricity substation at Ode-Erinje in Okitipupa Local Government Area of Ondo State.

He noted that the NDDC also commissioned the Iko-Atabrikang-Akata-Opulom-Ikot Inwang-Okoroutip-Iwochang Road with a 800-metre Ibeno Bridge.
Akpabio said that despite the challenges of developing the Niger Delta region, the NDDC had risen to the challenge by executing projects that have improved the lives of the people. He said that President Tinubu was very pleased with the performance of the current leadership of the NDDC.

The Chairman of the occasion and former President of Nigeria, Dr Goodluck Jonathan, said that as an intervention agency for the oil producing states, the NDDC had the mandate to bring development closer to the people, to foster hope, peace and inclusive governance in the region.

He observed: “NDDC came as a child of necessity whose strategic role also includes to improve the environment, provide infrastructure, and enhance the livelihood of the people in the region.

“With the birth of this current leadership of NDDC, people from the Niger Delta have seen some rays of light. Therefore, I encourage the political class not to over stretch the NDDC for them to be able to perform optimally.”

Also speaking, the Minister for Niger Delta Development, Engr. Abubakar Momoh, said that the Niger delta region must diversify to reduce the reliance on fossil oil.

He reacted to the concerns raised about the deplorable state of some sections of the East West Road, stating that the NDDC had engaged a construction firm to carry out some remedial work, in order to reduce the suffering of road users in Rivers and Bayelsa states.

Speaking earlier, the Governor of Bayelsa State, Senator Douye Diri, lamented the bad condition of the East West Road and appealed to President Tinubu and the Federal Government to act swiftly to end the suffering of commuters at the Okogbe axis of the East-West Road in Rivers State.

Governor Diri, said he was stuck for more than two hours at the bad portion of the road on his way to the Niger Delta Stakeholders Summit in Port Harcourt.

In his own remarks, the former Governor, Cross River State, Mr. Donald Duke, said that the stakeholders’ summit was a platform for a crucial reflection on the productivity of the populace in light of the abundance of hydrocarbons and vast gas reserves.

“However, it is imperative to prioritize the health and welfare of the people above all else. As an intervention agency, fostering collaboration with state governors is essential, and concerted efforts must be made to address the issue of abandoned projects that currently plague the region,” he said.

The NDDC Managing Director, Dr Samuel Ogbuku, assured participants at the summit that their recommendations would be followed studiously to change the fortunes of the Niger Delta region.

Labour Insists On N250,000 Minimum Wage After Meeting Tinubu

0

Comrade Joe Ajaero, President of the Nigerian Labour Congress (NLC), has said the status quo on N250,000 as minimum wage stands.

While the Federal Government and Organised Private Sector agreed on N62,000, labour is insisting on N250,000.

President Bola Tinubu had said he needed time to consult with other stakeholders before sending the bill for the new minimum wage to National Assembly.

Speaking with State House Correspondents after he and other labour leaders met with President Tinubu, on Thursday, Ajaero said labour leaders went for discussion, not negotiation.

He said the meeting would continue next week.

After discussing for over an hour, labour leaders came out of the meeting with the President and told State House Correspondents that they would go back to the people and return to the presidential villa.

Trade Union Congress (TUC) President, Festus Osifo, said they discussed, and after explaining their position, the President also made his remarks.

He did not disclose details of the discussions of the meeting.

Bill To Create New State In South-East Passes Second Reading At House Of Reps

0

A bill seeking to create a new state in the south-east geopolitical zone has passed second reading at the house of representatives.

The proposed legislation, which is co-sponsored by three lawmakers from the region — Amobi Ogah (Abia), Miriam Onuoha (Imo), Kama Nkemkama (Ebonyi), Chinwe Nnabuife (Anambra), and Anayo Onwuegbu (Enugu) — scaled a second reading during plenary on Thursday.

The lawmakers are proposing to alter the 1999 Constitution to create a new state from Abia, Anambra, Ebonyi, Enugu, and Imo.

The new state will be known as Etiti, with Lokpanta as its capital.

The state will have 11 LGAs: Aninri, Awgu, Isuikwuato, Ivo, Oji-River, Ohaozara, Okigwe, Onuimo, Orumba north, Orumba south, and Umu-Nneochi.

In his legislative brief, Ogah said the bill seeks to address a “longstanding” issue of regional parity and administrative efficiency within the south-east.

“The establishment of Etiti state is not just a matter of administrative convenience but a step towards ensuring balanced regional development and effective governance,” Ogah said.

“It responds to the aspirations of the people of a very important region to this country and aligns with the principles of equity and inclusivity enshrined in our democratic ideals.

“Suffice it to say that it is a long overdue step in the right direction to foster equitable representation, enhance governance efficiency, and promote socio-economic development within the region.”

The bill was voted for when it was put to a voice vote by Tajudeen Abbas, speaker of the house.

The bill was read for the first time on July 2.

On Thursday, the senate also introduced a bill seeking to create Tiga, a new state, from Kano.

LEGISLATIVE HURDLES

The national assembly is currently amending the 1999 Constitution.

In January, Benjamin Kalu, deputy speaker of the house of representatives, said work on the amendment of the constitution would be completed in December 2025.

Requirements for state creation and boundary adjustments are among the most challenging provisions in a constitutional amendment process.

Section 8(1) of the constitution stipulates that a new state can only be created if it is supported by “at least two-thirds majority of members (representing the area demanding the creation of the new state) in each of the following, namely — “(i) the Senate and the House of Representatives. (ii) the House of Assembly in respect of the area”.

“(iii) And the local government councils in respect of the area is received by the National Assembly; (b) a proposal for the creation of the State is thereafter approved in a referendum by at least two-thirds majority of the people of the area where the demand for the creation of the state originated.

“(c) The result of the referendum is then approved by a simple majority of all the states of the Federation, supported by a simple majority of members of the Houses of Assembly.

“(d) The proposal is approved by a resolution passed by a two-thirds majority of members of each House of the National Assembly.”

No state has been created since Nigeria returned to democratic rule in 1999.

Inflation: We’re Paying For Consequences Of Ways And Means Loan – Cardoso

0

Olayemi Cardoso, governor of the Central Bank of Nigeria (CBN), says the country is paying for the consequences of the N27 trillion ways and means loan.

On May 23, 2023, the senate approved the N22.7 trillion ways and means loan, thereby securitising the debt following a request by former President Muhammadu Buhari on December 28, 2022, asking the lawmakers to do so.

Speaking on Thursday at the BusinessDay CEO Forum, Cardoso said there was also a situation where money supply into the system was a lot.

He said the country is now bearing the burden of the loan.

“We all saw ways and means soar to N27 trillion and interventions went to N10.5 trillion. It has its consequences. In a large respect, that’s what we’re paying for now,” he said.

In May, the monetary policy committee (MPC) of the CBN raised interest rates from 24.75 percent to 26.25 percent.

According to the CBN governor, the MPC is not oblivious to the fact that the country requires economic growth.

“If these hikes were not done when they were done, if you recall naira to dollar was almost tipping over. This helped to stabilise things. It’s a timing issue,” he said.

“This is not something that I expect will remain with us forever. Fiscal issues being moderated and the ability to soak up the excess liquidity in the system and be able to balance things out over a period of time. That is important for the MPC.”

He said the MPC is focused on taming the inflation rate and stabilising the naira.

Cardoso said the monetary policy rate (MPR) is set by the MPC committee composed of independent-minded people — not the CBN governor.

“These are people not given to emotion but to data. The MPC clarified that the major issue is taming inflation, and they would do what is necessary to tame it,” he said.

Nigeria’s inflation rate is 33.95 percent, buoyed by surging food prices and high energy costs.

Speaking on the issue of foreign exchange (FX) volatility, Cardoso said the bank had to correct some dysfunctions in the financial system, such as illicit flows and those who did not abide by the rules, to ensure market stability.

“Sometimes, there’s pushback from those who want to continue doing things a certain way. There’s also that need to show people that there will be consistency in our ways before the market will settle,” he said.

The CBN governor noted that timely communication and market transparency have restored stakeholders’ confidence, adding that there is no more front-loading of FX requests.

“Even with portfolio investors, we found a good number of them came in, left and came in again,” Cardoso said.

“They were pretty comfortable that there was a plan and that the plan was headed in a direction that they could see, they understood and they trusted.

Cardoso said a lot of the wide swings witnessed in the foreign exchange market “are gradually beginning to smooth out as a result of a better understanding of the market, better transparency, and the comfort that those who are using the market see in it”.
