The Presiding Judge, Kano Judicial division of the National Industrial Court, His Lordship, Hon. Justice E. D. Isele has struck out Skyline University Pro-Chancellor and 4 others from the suit filed by Dr. Sesan Akinwunmi over his employment termination against the University.
Delivering the ruling, Justice Isele affirmed the jurisdiction of the court to hear the matter between Dr. Akinwunmi, Skyline University, and the Governing Council on merit.
From facts, the claimant- Dr. Akinwunmi had approached the court over his employment termination against the University, its pro-chancellor, vice-chancellor, registrar, governing council, and 2 others.
In defense, the University Pro-chancellor, governing council, and 4 others via motion sought for an order of the Court to strike out their names from the suit for non-disclosure of a reasonable cause of action against them and further that all of them work for the University just like the Dr. Akinwunmi before the termination of his employment.
Demanding further, the applicants’ counsel A. S Gadanya with J. U. Adam Esq urged the court to strike out the suit on the premise that the Statement of Claim is scandalous and vexatious as no dispute between the Claimant and the applicants that the Court lacks jurisdiction to entertain the suit.
In opposition, the Dr. Akinwunmi counsel, I. D. Abdulyakin Esq conceded to the striking out of the names of the applicants but urged the court to retain the names of the University and the Governing Council being the Administrative Organ is very germane to the suit.
After careful perusal of the submissions of both parties, the presiding Judge, Justice Isele affirmed the jurisdiction of the court to hear the matter on merit and further held that the names of the Pro-Chancellor and 4 others be struck out from the suit leaving only the University and its governing council as defendants.
